Third Party Deliveries. Buyer will cooperate with Seller’s efforts to obtain an Acknowledgment and Release, relating to the Bond Documents, substantially in the form of Exhibit F-3 hereto, duly executed by Issuer. It shall be a condition to Seller’s obligation to close hereunder (which Seller may waive in writing in its sole discretion) that Issuer shall have duly executed and delivered such Acknowledgement and Release.
Third Party Deliveries. Except to the extent that any of the RMT Firm Customers exercise their contractual right to require Xxxxxxxx Production RMT Company LLC to provide to them Gathering and Processing services as set forth in their respective agreements, as referenced in Section 7.4, Xxxxxxxx shall not commit Guaranteed Capacity for third party Gas at the following Delivery Points or connecting pipelines:

Third Party Deliveries. TimberWest acknowledges that FCCL may from time to time direct the delivery of Chips to third parties as part of FCCL's Chip sales and trading program and in each such case the procedures employed by such third party concerning measurement and testing of Chips will apply except that such third party procedures will be consistent with standard industry practices and will not be more onerous than similar procedures employed by FCCL.
