Common use of Transfer and Seniority Outside Bargaining Unit Clause in Contracts

Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without the employee’s consent. If an employee is transferred to a position outside of the bargaining unit, the employee shall retain the employee’s seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. Such employee shall have the right to return to a position in the bargaining unit within a twelve (12) month period. If an employee returns to the bargaining unit within twelve (12) months, the employee shall revert to the employee’s former position. If the former position no longer exists the employee shall be placed in a position of equal classification or where none are available a position of lesser classification consistent with the employee’s seniority.
