Common use of Transfer Outside of Bargaining Unit Clause in Contracts

Transfer Outside of Bargaining Unit. (a) An employee, who is transferred to a position with the Employer outside of the bargaining unit for a period of six (6) months or less, or for an academic year, shall continue to accumulate seniority for the period of the transfer. (b) An employee who is transferred to a position with the Employer outside of the bargaining unit in excess of the period set out in (a) but for no more than twelve (12) months or for a period required to replace a pregnancy and parental leave, or sick leave shall retain seniority but not accumulate seniority held at the time of the transfer. In the event the employee is returned to a position in the bargaining unit, the employee shall be credited with seniority held at the time of transfer and resume accumulation from date of the return to the bargaining unit. If such employee returns to the bargaining unit within twelve (12) months, the employee shall be placed in a job consistent with the employee’s experience, seniority and original branch. (c) In the event that an employee is transferred to a position with the Employer outside of the bargaining unit for a period in excess of the period in (b), the employee will lose all seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, the employee’s seniority will accrue from the date of the return to the bargaining unit. (d) An employee may decline such offer to transfer. (e) Any of the periods of time referred to above may be extended by agreement of the Parties. (f) No employee will be temporarily assigned duties of positions outside the bargaining unit without the employee’s consent.
