Types of Grievance Employee Grievances. An Employee grievance is a claim by an Employee, who is solely affected, that the terms and conditions of this Agreement have been violated, misapplied or misinterpreted. Group Grievances Any dispute affecting a group of Employees which is taken up on their behalf by the Union constitutes a group grievance. A group grievance may be presented directly at Step 1 (as defined in Article 19.05) within twenty (20) working days of the date when the circumstances giving rise to the grievance could reasonably have become known by the Employees. Union Grievances A grievance arising directly between the Union and the Employer, which could not form the subject of an individual or group grievance, may be presented as a Union grievance directly at Step 3 (as defined in Article 19.07) within twenty (20) working days of the date when the circumstances giving rise to the grievance could reasonably have become known by the Union. Employer Grievances A grievance arising directly between the Employer and the Union may be presented as an Employer grievance directly at Step 3 (as defined in Article 19.07) to the Union within twenty (20) working days of the date when the circumstances giving rise to the grievance could reasonably have become known by the Employer. The Employer acknowledges the right of a representative of the Union to be present at all complaint and grievance meetings.
