Umpire Selection. The procedure to be used in the selection of an Umpire shall be as follows: 26.09.01 The Foundation and the Union shall exchange lists of persons knowledgeable in position evaluation. 26.09.02 In the event that one (1) or more persons are named on both lists, the selection shall be made from those persons. 26.09.03 In the event that the Foundation and the Union cannot agree on an Umpire, the matter shall be referred to the Executive Committee of the Labour Relations Board who shall appoint a qualified person to act as an Umpire. 26.09.04 The Umpire shall act on all appeals submitted to them for a period of one (1) year commencing from the date of their appointment. After such period, the Foundation and the Union shall review the performance of the Umpire upon mutual agreement, appoint them for an additional term of one (1) year or, where no agreement exists, shall initiate the aforesaid procedure of the selection of a new Umpire. 26.09.05 The Foundation and the Union shall share equally the Umpire’s fees and other expenses of the hearings. 26.09.06 The Foundation and the Union shall appoint one (1) representative to assist the Umpire in their review of matters brought before them under the provisions of this section.

Umpire Selection. 1. Upon initial contact with the Policyholders’ Appraiser, the two (2) Appraisers shall attempt to select a mutually acceptable Umpire. The Citizens’ Appraiser shall inform Citizens of the names of all Umpires who have been suggested or recommended by the Policyholders’ Appraiser to allow Citizens the opportunity to confirm whether the proposed Umpires are qualified to serve, as per the policy terms and conditions. The Citizens’ Appraiser shall not propose any Umpire to the Policyholders’ Appraiser or representative without first advising Citizens of the proposed Umpire to allow Citizens the opportunity to confirm whether the proposed Umpire is qualified to serve as per the policy terms and conditions. The Citizens’ Appraiser shall forward to Citizens any information that calls into question any Policyholders’ Appraiser or Umpire’s qualifications to serve on the Appraisal Panel. 2. An Umpire shall be selected within ten (10) Business Days of the Appraiser Appointment.
Umpire Selection. Upon the written request of the Union on behalf of the employee concerned made to the Company, or upon the written request of the Company made to the Union, any such grievance which has not been settled to the satisfaction of the parties concerned after being carried through the relevant steps of the grievance procedure of this Agreement shall be referred to an Umpire. Such Umpire shall be chosen either by mutual agreement of the parties involved or, failing such agreement within five (5) regular work days (excluding Sundays and holidays or days observed therefor) from the date of the written request for arbitration by the Minister of Labour for the Province of Ontario. If the Union requests the arbitration and fails within sixty (60) days from the date of the written request therefor to request the appointment of an Umpire by the Minister of Labour, such failure shall constitute dismissal of the grievance.

Umpire Selection. Within fifteen (15) business days after a Notice of Dispute is given each Party shall select two (2) prospective umpires from among: (a) any retired judge of the United States District Court; (b) any retired managing senior partner of a law firm with no less than twenty-five (25) partners; or (c) such other persons with such qualifications upon which the Parties agree. The umpires shall be free from bias and conflict of interest with respect to either Party and shall be in a position to immediately hear the dispute and render a prompt resolution, but in no event later than six (6) months from the date of the Notice of Dispute. Within fifteen (15) business days after each Party has selected its prospective umpires the Parties shall agree to one (1) umpire from among the four (4) prospective umpires to hear the dispute. In the event that the Parties do not agree on an umpire, the prospective umpires shall name the umpire.
