Unaccounted for Gas. (a) Notwithstanding any other provision of this Agreement, ActewAGL’s obligation under this Agreement to purchase a Quantity of UAG is subject to and only applies to the extent that ActewAGL has timely access to verified and sufficiently accurate data at each Receipt Point to be able to calculate the LG Quantity.
(b) ActewAGL will calculate an LG Quantity on the basis of the available data at the time.
(c) ActewAGL may update the LG Quantity at any time to reflect updated data for an LG Period. However, ActewAGL is not obliged to recalculate the LG Quantity for a LG Period once 12 months have elapsed since the end of that LG Period.
(d) ActewAGL will purchase UAG equal to:
(i) ActewAGL’s forward estimate of the LG Quantity for an LG Period; less
(ii) the difference between the Quantities of UAG ActewAGL has previously purchased for any earlier LG Period and the LG Quantity for that LG Period.
(e) ActewAGL will purchase UAG on a competitive commercial basis. This basis will be determined by ActewAGL, acting reasonably, and may include utilising a competitive open tender for the supply and/or haulage of Gas over any period, as reasonably determined by ActewAGL.
(f) ActewAGL will recover all costs of purchasing UAG through the Reference Tariffs in accordance with the provisions of the Access Arrangement.
(g) ActewAGL may, by notice, terminate its obligations under clause 9.4(a) and this clause 9.5 with effect from the date that parties other than ActewAGL assume the responsibility to purchase UAG in relation to the Network. Such termination may be subject to conditions reasonably required by ActewAGL and will not prejudice the right of ActewAGL to recover the cost of UAG in accordance with the Access Arrangement.
Unaccounted for Gas. (a) Notwithstanding any other provision of this Agreement, the Service Provider’s obligation under this Agreement to purchase a Quantity of UAG is subject to and only applies to the extent that the Service Provider has timely access to verified and sufficiently accurate data at each Receipt Point to be able to calculate the LG Quantity.
(b) The Service Provider will calculate an LG Quantity on the basis of the available data at the time.
(c) The Service Provider may update the LG Quantity at any time to reflect updated data for an LG Period. However, the Service Provider is not obliged to recalculate the LG Quantity for a LG Period once 12 months have elapsed since the end of that LG Period.
Unaccounted for Gas. (a) The User accepts risk of loss of all Gas injected by it into the Distribution System and the Service Provider is not liable to the User for Unaccounted for Gas other than as provided for in this clause 4.10.
(b) The parties acknowledge that, in accordance with Rule 317 of the National Gas Rules and the Distribution UAFG Procedures made pursuant to that rule (and in accordance with any other relevant Regulatory Instruments from time to time) AEMO will from time to time calculate the amounts (if any) payable by the User to the Service Provider or by the Service Provider to the User on account of Unaccounted for Gas (Reconciliation Amounts) .
(c) Subject to any provisions to the contrary in Regulatory Instruments, the party liable to pay a Reconciliation Amount must pay that Reconciliation Amount to the other party within 30 days of being notified by AEMO that such amount is payable.
(d) If a Reconciliation Amount is not paid in full in accordance with this clause 4.10(c) or, where the time by which the amount is payable is set by a Regulatory Instrument, not paid in full by the time required by that Regulatory Instrument, the party who has failed to make the payment must pay interest on the outstanding amount from the day that the Reconciliation Amount was due for payment until payment in full of the Reconciliation Amount plus all accrued interest. Interest will be calculated at the Default Rate applicable on the first day of the month in which the invoice was issued and will be capitalised on the first day of each following month and calculated on actual days elapsed and a 365 day year.
Unaccounted for Gas. Unaccounted For Gas" shall mean the thermal equivalent of the difference between the sum of all input volumes of Gas to the System and the sum of all output volumes of Gas from the System, which difference shall include but shall not be limited to Gas vented (other than gas that can be attributed to an offending Shipper), Line Heater Gas and Gas lost as a result of an event of Force Majeure, the ownership of which cannot be reasonably identified. Unaccounted For Gas shall not include Fuel Gas (to the extent that compression is installed), which will be separately determined. Unaccounted For Gas shall be determined pursuant to Section 36 of these General Terms and Conditions.
Unaccounted for Gas. For each Contract Month:
(a) the Shipper will reimburse the Transporter for all costs and expenses (including Taxes) incurred by the Transporter in procuring the replacement for any negative amount of UFG allocated to the Shipper in accordance with the provisions contained in the Network Code; and
(b) the Transporter will reimburse the Shipper for the price of any positive amount of UFG allocated to the Shipper in accordance with the provisions contained in the Network Code less any costs and expenses (including Taxes) incurred by the Transporter in selling such amount of UFG.
Unaccounted for Gas. Networks must replace gas which is lost while in its control.
Unaccounted for Gas. The ‘forecast unaccounted for gas percentage’ for the unaccounted for gas shall be as provided for in the Rate Handbook.
Unaccounted for Gas. Unaccounted For Gas" shall mean the thermal equivalent of the difference between the sum of all input volumes of gas to the System and the sum of all output volumes of gas from the System, which difference shall include but shall not be limited to gas vented (other than gas vented pursuant to Section 3.6) and gas lost as a result of an event of Force Majeure, the ownership of which cannot be reasonably identified, but shall not include Fuel Gas.
Unaccounted for Gas. In order to ensure the lowest cost to end-users EnergyAustralia believes JGN’s ability to source gas directly from the Short Term Trading Market under Clause 9.5(e)(ii) should be limited to where it is cheaper than utilising an open tender process.
Unaccounted for Gas. Charges for the Contract Transportation Service and the Volume Transportation Service will incorporate the level of Unaccounted for Gas set out in section 4.2.3 of the Access Arrangement.
