Unit Realignment. Following the determination of staff needs for the next school year, the Special Education Program, Non-Public Schools Program, English as a Second Language (ESL) Program, and the Preschool Early Intervention Program will conduct their own Unit Realignments to determine Employee(s) positions. Unit Realignment, except for English as a Second Language (ESL) Teachers, will be held no later than the third Wednesday in April. English as a Second Language (ESL) Unit will be conducted per Article X, Section 17 – English as a Second Language. At this time, all staff within the Unit will meet. Unit Realignment information will include but is not limited to; the seniority list with the most senior employee listed first and the least senior last, those without position, those with 50% change, leave positions, new positions, geographical areas of positions, proxy forms and retirements. A copy of the seniority list will be physically available for each employee upon entering the Unit Realignment meeting. All Employees of the Unit will receive the above Unit information 7 calendar days prior to their respective scheduled Unit Realignment. Unit Realignment will occur within: • AIU-Operated Special Education Schools (one for each school in operation) • School Districts (one for each district contracted) • Non-Public Schools Program • Preschool Early Intervention Program (including Speech/Language) • Speech/Language Program (Special Education and Non-Public Schools) • Hearing Program • Vision Program • Special Education Transition Consultants • Travel Instructors • Reading Coaches • English as a Second Language (ESL) • Pupil Personnel Services Only Employees without position within their unit will proceed to Central Realignment. Those Employees wishing to transfer to an open position may attend and participate in Central Realignment. At the conclusion of Unit Realignment and no later than May 7, all Bargaining Unit members will receive a Central Realignment packet, which includes but is not limited to: • Seniority List – including certifications possessed by the member and the certifications needed for the position (overall and by Unit and Support Areas) • All open positions • All leave positions • All new positions • Assignments of all members of the Bargaining Unit • List of people without positions, their seniority date, and last position • Proxy Forms • Names of Administrators and an AIUEA contact, their program, and telephone numbers and any other pertinent contact in...

The Union agrees that it will not make such request more often than once in a calendar year. 1.04 The parties recognize that employees of the Employer in supervisory positions, or above the rank of Supervisor, may (when the situation so requires) help employees covered by this collective agreement in order to maintain the quality of service to customers, and in this case may also perform work currently done by current employees of the bargaining unit. Such work must not, however, cause the elimination of any position now covered in the collective agreement. (a) will not apply. Notwithstanding the foregoing, an employee of the Employer working in a position not covered by the collective agreement, may continue work presently being performed but shall not assume additional duties if this would cause the elimination of a position now covered in the collective agreement.
