Common use of Unsafe Work Conditions Clause in Contracts

Unsafe Work Conditions. No Employee shall be disciplined for refusal to work on a job which in the opinion of: (a) A member of a safety committee; or (b) A person designated by a safety committee; or (c) A safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act.

Unsafe Work Conditions. No employee shall be disciplined for refusing to work when confronted by a person who, in the employee's reasonable estimation, poses an immediate hazard to the employee's physical safety.

(a) No Employee employee shall be disciplined for refusal to work on a job which in the opinion of: (a1) A a member of a safety committeethe Health and Safety Committee; or (b2) A person designated by a safety committee; or (c) A Worksafe BC safety officer after following an on-site inspection and following discussion with a representative of the Employer, OC does not meet the standards established pursuant to the Workers' Compensation ActAct and regulations. (b) Where employees act in conformity with Section 3.12 of the Occupational Health and Safety Regulations, such employees shall not be subject to disciplinary action.

Unsafe Work Conditions. No Employee employee shall be disciplined for refusal to work on a job which in the opinion of: (a) A member of a safety committee; or (b) A person designated by a safety committee; or (c) A safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the applicable standards established pursuant to the Workers' Compensation ActAct or other situation which a member of the Joint Health and Safety Committee reasonably believes is unsafe, or which an authorized staff person of the Workers' Compensation Board has stated is unsafe. No employee shall be disciplined for refusing to work when confronted by a person who, in the employee's reasonable estimation, poses an immediate hazard to the employee's physical safety.
