Common use of Unsafe Work Conditions Clause in Contracts

Unsafe Work Conditions. a) No employee shall be disciplined for refusal to work on a job which in the opinion of: i) a member of a safety committee, or ii) a person designated by a safety committee, or iii) a safety officer after an on-site inspection and following discussion with a representative of the Employer, does not meet the standards established pursuant to the Workers' Compensation Act. A worker may refuse to perform work where he/she has reasonable grounds to believe and does believe that the particular work is dangerous to his/her health and safety, or the health and safety of another worker or another person. Where a worker refuses to do such work no other worker may be asked to perform that job until the matter has been investigated by the Health and Safety Committee and satisfactorily settled. The Employer or any person acting on behalf of the Employer shall not take or threaten any discriminatory action against any employee or employees for refusing to do such work.
