Unused Earned Vacation. As soon as practicable following the Retirement Date, the Company shall pay the Employee, in a lump sum, an amount equal to his unused 1999 vacation entitlement.

Unused Earned Vacation. By no later than three (3) weeks following the date of execution of this Agreement, the Company shall pay Executive, in a lump sum, an amount equal to his accrued but unused 2002 vacation entitlement.
Unused Earned Vacation. If this contract is terminated or non-renewed, unused and earned vacation time shall be paid to the Superintendent on a pro-rated basis, up to a maximum of twenty-five (25) days at his per diem rate of pay (based upon a 1/260 work year). Upon the death of the Superintendent, unused but earned accumulated vacation days shall be paid to the Superintendent’s beneficiary or estate. Payment for unused accumulated vacation days shall be made within thirty (30) days of the date of separation. If this contract is renewed, the Superintendent shall be permitted to carry over (10) unused earned vacation days. In the event the Superintendent terminates the contract upon notice to the Board, the Board shall not prevent the Superintendent from using any remaining vacation days. However, at the Board’s discretion, should termination or non-renewal occur, the Board reserves the right to require the Superintendent to use his full vacation allotment.

  • Accrued Vacation It is further agreed by the parties hereto that, upon sale or transfer of ownership of any store or upon dissolution of business, vacation pay for all months worked for which no vacation pay has been given shall be immediately paid to all employees coming under this Agreement, regardless of length of time said employee has been with the Employer.

  • Pro-Rated Bonus Pro Rated Bonus" shall mean, a bonus equal to the product of (i) the bonus Employee did not receive but would have received under Section 1.4(b) if he had remained an employee through the end of the Employment Term, it being understood that the amount of such bonus Employee would have received shall be determined by reference to the average amount of bonus actually awarded to other officers who were at the same or comparable level of responsibility as Employee immediately prior to his termination, and (ii) a fraction, the denominator of which is 365 and the numerator of which is the number of days in the fiscal year being considered through the date of death, determination of disability or notice of termination of employment, whichever is applicable. In the event that a majority of SCI officers do not receive a bonus for the fiscal year being considered, then the Pro Rated Bonus shall not be applicable and Employee shall not be entitled to a Pro Rated Bonus. The Pro Rated Bonus, if any, payable to Employee shall be paid within 90 days after the date that bonuses, if any, are awarded for a majority of SCI officers for the year being considered.
