Use of Electronic Data. 3.1 Maersk provides Electronic Document Printing Facilities for the sole use of the Registered User and Individual User(s) to whom it is made available. Any other use of electronic data provided via its Electronic Document Printing Facilities including copying and forwarding, whether or not permitted by the terms of this Agreement and/or the procedures from time to time in use by Maersk, is at the Registered User's sole risk and responsibility. 3.2 If requested by the Registered User, Maersk may at its sole discretion agree to make available to another registered user (the "Nominee") some or all of the data which it provides via its Electronic Document Printing Facilities. This will be at the Registered User's sole risk and responsibility, and any xxxxx xxxx of lading forms required by the Nominee should be obtained from Maersk direct, not by the Registered User. 3.3 The Registered User shall indemnify and hold harmless Maersk and its affiliates, associates and agents against any claims, losses, actions, proceedings, damage or liabilities whatsoever (including damages or compensation paid by them to compromise or settle a claim) and all legal costs or other expenses, suffered by them as a result of: (i) The Registered User and/or an Individual User making available to another person any electronic data provided by Maersk, or copy thereof; and/or (ii) Maersk making available electronic data to a Nominee pursuant to clause 3.2 above.

Use of Electronic Data. Interchange (EDI) The SPEC 2000 Protocol shall be used for any EDI transaction. Buyer and XXXX shall implement security procedures to ensure proper use of this communication. A message will be considered received only at the point where it is in a format which can be accepted by the receiving computer according to ATA SPEC 2000 rules on transmissions. If garbled transmissions are received, the receiver shall promptly notify the sender through use of the S1REJECT command.

The Bavarian Data Protection Act is hereby applicable, whose regulations are observed in the collection and any use of data. b. Use of Data for the Purpose of Controlling and Public Relations The TUM-GS uses any acquired data in an anonymous form for internal and external6 con- trolling purposes. Additionally the TUM-GS releases regular publications on research pro- jects, in agreement with all involved parties. This aims to generate interest from collabora- tors regarding the work and research of TU München. The use of data for statistical purposes is done in accordance to the Bavarian Data Protec- tion Act and the German Federal Law for Data Protection. This will be at the Registered User's sole risk and responsibility, and any xxxxx xxxx of lading forms required by the Nominee should be obtained from Sealand – A Maersk Company direct, not by the Registered User. 3.3 The Registered User shall indemnify and hold harmless Sealand – A Maersk Company and its affiliates, associates and agents against any claims, losses, actions, proceedings, damage or liabilities whatsoever (including damages or compensation paid by them to compromise or settle a claim) and all legal costs or other expenses, suffered by them as a result of: (i) The Registered User and/or an Individual User making available to another person any electronic data provided by Sealand – A Maersk Company, or copy thereof; and/or (ii) Sealand – A Maersk Company making available electronic data to a Nominee pursuant to clause 3.2 above.

Use of Electronic Data. 3.1 Xxxxxxxx Remote Document Printing Facility is for the sole use of the Authorised User and Approved User(s) to whom Authorised User has made it available within their organisation. Any other use of electronic data provided under this Facility including copying and forwarding, whether or not permitted by the terms of this Agreement and/or the procedures announced by Xxxxxxxx from time to time, is at the Authorised User's sole risk and responsibility. 3.2 On the express written request of the Authorised User, Xxxxxxxx may – at its sole discretion and subject to additional indemnities agreed to by the Authorised User and the Nominee – agree to make available to another Authorised user (the "Nominee") some or all of the data which it provides under this Facility. 3.3 Such extension of Facility shall be at the Authorised User's sole risk and responsibility, and any xxxx of lading stationery required by the Nominee should be obtained from Xxxxxxxx directly and the Authorised User is prohibited from issuing Cordelia’s Xxxx of Lading stationery to any of its Nominees. 3.4 Such sharing of the Xxxx of Lading stationery – unless expressly approved and permitted in writing by Xxxxxxxx and that too only in emergent situations – by the Authorised User will be considered a breach of this Agreement and may lead to summary withdrawal of the Facility by Xxxxxxxx. 3.5 The Authorised User shall indemnify and hold harmless Xxxxxxxx Container Shipping Line and its affiliates, associates and agents against any claims, losses, actions, proceedings, damages or liabilities whatsoever (including damages or compensation paid by them as a compromised settlement of a claim) and all legal costs or other expenses, suffered by them as a result of: 3.5.1 The Authorised User and/or an Approved User allowing another entity or person, directly or indirectly, to avail of or use any data provided electronically by Xxxxxxxx, or copy thereof; and/or 3.5.2 Xxxxxxxx providing data electronically to a Nominee pursuant to clauses 3.2, 3.3 above.
