Use of MSF Curricula. Sponsor shall teach MSF’s most current curricula, in accordance with MSF’s most current standards, terms and conditions, as may be amended from time to time at the sole discretion of MSF (“MSF Curricula” or “MSF Courses”). Sponsor shall comply with each of the following requirements: 1. Sponsor shall use MSF’s Basic RiderCourse (“BRC”) as Sponsor’s primary curriculum. Sponsor may also offer non-MSF curricula, so long as such curricula are never promoted as being sponsored by MSF or taught by MSF-certified RiderCoaches. 2. Sponsor shall use only MSF-certified RiderCoaches, who are active and in good standing with MSF, to teach MSF Curricula. 3. Sponsor shall use only MSF-recognized training sites (“Ranges”), which are recognized for Sponsor’s use by MSF (affiliated with Sponsor’s RERP Agreement), and kept active and in good standing with MSF, to conduct training using MSF Curricula. A Range may be shared by multiple sponsoring organizations, provided that each sponsoring organization shall maintain a separate active RERP Agreement, and that each sponsoring organization shall separately obtain MSF’s recognition of such range affiliation under its RERP Agreement. A Range may also be used to teach multiple MSF Course offerings, provided that the sponsoring organization shall obtain separate recognition from MSF for each course offering (e.g., MSF 3-Wheel BRC requires separate Range recognition from 2-Wheel BRC). Sponsor shall immediately notify MSF in writing in the event that it ceases use of an MSF-recognized Range. 4. For Sponsors who maintain a training motorcycle fleet, Sponsor shall provide a separate training motorcycle for use by each student who has not brought their own motorcycle, unless sharing is explicitly permitted by the MSF Curricula (e.g., MSF 3-Wheel BRC). Sponsor-provided training motorcycles must meet all MSF criteria as published in the current MSF RiderCoach Guide. 5. Sponsor shall provide a separate DOT-compliant helmet for use by each student who has not brought their own DOT-compliant helmet. 6. Sponsor shall ensure that its Range site is equipped with a basic first aid kit, an operational telephone (landline or mobile), and emergency medical phone numbers. 7. Sponsor shall ensure that all training motorcycles are properly maintained and kept in safe operating condition for the safety of all students. 8.   • Use of websites (a) The Guarantor may satisfy its obligation to deliver any public information to the Lenders by posting this information onto an electronic website designated by the Guarantor and the Administrative Agent (the “Designated Website”) by notifying the Administrative Agent (i) of the address of the website together with any relevant password specifications and (ii) that such information has been posted on the website; provided, that in any event the Guarantor shall supply the Administrative Agent with one copy in paper form of any information which is posted onto the website. (b) The Administrative Agent shall supply each Lender with the address of and any relevant password specifications for the Designated Website following designation of that website by the Guarantor and the Administrative Agent. (c) The Guarantor shall promptly upon becoming aware of its occurrence notify the Administrative Agent if: (i) the Designated Website cannot be accessed due to technical failure; (ii) the password specifications for the Designated Website change; (iii) any new information which is required to be provided under this Guaranty is posted onto the Designated Website; (iv) any existing information which has been provided under this Guaranty and posted onto the Designated Website is amended; or (v) the Guarantor becomes aware that the Designated Website or any information posted onto the Designated Website is or has been infected by any electronic virus or similar software. If the Guarantor notifies the Administrative Agent under Section 8.3(c)(i) or Section 8.3(c)(v) above, all information to be provided by the Guarantor under this Guaranty after the date of that notice shall be supplied in paper form unless and until the Administrative Agent is satisfied that the circumstances giving rise to the notification are no longer continuing.

  • Use of Materials There should be no limitations or restrictions by Union upon a Contractor's choice of materials or design, nor, regardless of source or location, upon the full use and utilization, of equipment, machinery, packaging, precast, prefabricated, prefinished, or preassembled materials, tools or other labor saving devices, subject to the application of the California Public Contract and Labor Codes. Generally, the onsite installation or application of such items shall be performed by the craft having jurisdiction over such work.

  • Use of First Samples Drawn For the purposes of all samples (Discovery Sample(s) and Full Sample(s)) discussed in this Appendix, the Paid Claims selected in each first sample shall be used (i.e., it is not permissible to generate more than one list of random samples and then select one for use with the Discovery Sample or Full Sample).

  • Use of Data by User Registry Operator will permit user to use the zone file for lawful purposes; provided that (a) user takes all reasonable steps to protect against unauthorized access to and use and disclosure of the data and (b) under no circumstances will Registry Operator be required or permitted to allow user to use the data to, (i) allow, enable, or otherwise support the transmission by email, telephone, or facsimile of mass unsolicited, commercial advertising or solicitations to entities other than user’s own existing customers, or (ii) enable high volume, automated, electronic processes that send queries or data to the systems of Registry Operator or any ICANN-­‐accredited registrar.

Such a nurse shall designate to the Medical Center, prior to the announcement of such absence, the date by which compensation for PTO is to be discontinued. b.
