Common use of Vacation on Layoff Clause in Contracts

Vacation on Layoff. Employees who are laid off shall receive vacation pay for the calendar year in which the layoff occurs on the basis of one-twelfth (1/12) of their vacation entitlement for that year for each month greater than one-half worked to the date of layoff, or at that percentage of wages earned during the calendar year set by the Employment Standards Act, whichever is greater, provided that adjustment will be made for any overpayment of vacation.
