Common use of Vacation on Termination Clause in Contracts

Vacation on Termination. Employees who leave the service after completion of twelve (12) consecutive months of employment shall receive vacation pay for the calendar year in which termination occurs on the basis of one-twelfth (1/12) of their vacation entitlement for that year for each month greater than one-half worked to the date of termination, or at that percentage of wages earned during the calendar year set by the Employment Standards Act, whichever is greater. Provided that in all cases of termination of service for any reason other than for retirement or superannuation or on attaining maximum retirement age, adjustment will be made for any overpayment of vacation.
