Voiding of Warranty. The warranty shall not apply to any part or component of the vehicle that has been subject to misuse negligence, accident, or that has been repaired or altered in any way so as to affect adversely its performance or reliability, except insofar as such repairs were in accordance with Contractor’s maintenance manuals and the workmanship was in accordance with recognized standards of the industry. The warranty shall also be void if the purchaser fails to conduct normal inspections and scheduled preventive maintenance procedures as recommended in Contractor’s maintenance manuals.

Exceptions and Additions to Warranty The warranty shall not apply to the following items: • scheduled maintenance items • normal wear-out items Fleet Defects Occurrence and Remedy: A Fleet Defect is defined as cumulative failures of twenty-five (25) percent of the same components in the same or similar application in a minimum fleet size of hundred (100) or more scooties where such items are covered by warranty. A Fleet Defect shall apply only to the base warranty period in sections entitled “Complete Scooty,” “Propulsion System” and “Subsystems.” When a Fleet Defect is declared, the remaining warranty on that item/component stops. The warranty period does not restart until the Fleet Defect is corrected. The Manufacturer/Authorized Dealer/Supplier of Two Xxxxxxx/Three Xxxxxxx shall correct a Fleet Defect under the warranty provisions. After correcting the Defect, the Client and the Manufacturer/Authorized Dealer/Supplier of Two Xxxxxxx/Three Xxxxxxx shall mutually agree to and the Manufacturer/Authorized Dealer/Supplier of Two Xxxxxxx/Three Xxxxxxx shall promptly undertake and complete a work program reasonably designed to prevent the occurrence of the same Defect in all other scooties and spare parts purchased under this Contract. Where the specific Defect can be solely attributed to particular identifiable part(s), the work program shall include redesign and/or replacement of only the defectively designed and/or manufactured part(s). In all other cases, the work program shall include inspection and/or correction of all of the scooties in the fleet via a mutually agreed-to arrangement. The Manufacturer/Author...

The warranty also shall be void if the CITY fails to conduct normal inspections and scheduled preventive maintenance procedures as recommended in the Contractor’s maintenance manuals and if that omission caused the part or component failure. The CITY shall maintain documentation, auditable by the Contractor, verifying service activities in conformance with the Contractor’s maintenance manuals.

Voiding of Warranty. The express warranty set forth above shall not apply to failure of the Product if the Product has been subjected to: (i) physical abuse, misuse, improper installation, abnormal use, power failure or surge, or use not consistent with the operating instructions provided by Enable-IT; (ii) modification (including but not limited to opening the Product housing) or repair by any party in any manner other than as approved by Enable-IT in writing; (iii) fraud, tampering, unusual physical or electrical stress, unsuitable operating or physical conditions, negligence or accidents; (iv) removal or alteration of the Product serial number tag; (v) improper packaging of Product returns; or (vi) damage during shipment (other than during the original shipment of the Product to the End User from Enable-IT, if applicable).

Voiding of Warranty. The warranties set forth in this Article 10 will not apply and will become null and void if Customer, any Authorized User, or any other person provided access to the Licensed Software Programs by Customer or any Authorized User breaches any provision of this Agreement.
