Waiver Agreement. We have agreed with you that the hire contract conditions varied by this Waiver Agreement under which you are relieved of your responsibility to us for loss of or damage to plant hired to you. The Waiver Agreement is subject tothetermsspecified below.

Waiver Agreement. Any of the assignments and/or scheduling requirements contained in this Agreement may be waived or modified by mutual agreement of the administration and the teacher(s) whose program, schedule or assignment will be affected by such waiver or modification.

Waiver Agreement. Each of the Lenders has reviewed that certain waiver agreement attached as SCHEDULE 9.17 hereto and by its signature below agrees to be bound to the terms contained therein and authorizes the Administrative Agent to execute such waiver agreement on its behalf.
Waiver Agreement. The RENTER agrees to hold BIM its successors or assigns harmless for any and all injury, loss or damage to the said watercraft, or to any person or guest aboard or to any third person or their property not on board. Term watercraft refers to hull, super-structure, engine, controls and items located therein. In accepting and agreeing to operate this said watercraft according to rules of BIM, which said rules are considered part of this agreement, the RENTER does hereby waive and relinquish any and all claims for damage, injury or loss, of any kind, character or description, against BIM, its successors, or assigns, its officers, agents or employees, arising out of injury, damage or loss, either to the person or property of the RENTER, or the person or property of any quest or other person aboard, or to any third person or their property no on board. RENTER agrees to hold BIM, its successors, or assigns, its officers, agents or employees harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing contract by RENTER, including expense incurred in connection with attempting to collect delinquent rent and in the event of suit by RENTER, to recover possession of said rental property and/or enforce any terms, conditions and/or provisions hereof. It is understood and agreed that venue and any action hereunder shall be in the county of BIM.
Waiver Agreement. A. The University and the Association for the life of this Agreement each voluntarily and unqualifiedly waives the right and each agrees that the other shall not be obligated to bargain collectively with respect to any subject or matter not specifically referred to or covered in this Agreement. All rights and duties of both parties are specifically expressed in this Agreement, and such expression is all-inclusive. This Agreement constitutes the entire Agreement between the parties, with respect to all terms included herein.
B. If any law or judicial order or administrative or executive order or ruling shall so conflict with or shall so restrict or affect the performance of this Agreement or any Article or Articles thereof in accordance with its terms so as to make it either impossible for such performance or in the judgment of the University unduly burdensome, then the University may at its option terminate the affected Article or Articles thereof by written note to the Association, and the University shall in good faith commence negotiations of a new Article or new Articles which were terminated.
