WARRANTY RESTRICTIONS. This warranty does not apply if the Software, (a) has been altered, except by HGS; (b) has not been installed, operated, repaired, or maintained in accordance with instructions supplied by HGS; (c) has been subjected to abnormal physical or electrical stress, abnormal environmental conditions, misuse, negligence, or accident; (d) is licensed for beta, evaluation, testing or demonstration purposes; or (e) any Software for which HGS does not receive a license fee.

WARRANTY RESTRICTIONS. 10.1. Irrespective of clause 5.3 we guarantee that the services during the respective runtime are provided substantially in accordance with the respective data sheet. You must inform us immediately of any non-fulfilment.
WARRANTY RESTRICTIONS. 3.1 JLT's liability, according to the warranty set out in this JLT Limited Warranty, is limited to defects which appear within the Warranty Period. The Customer shall without undue delay notify JLT in writing of any defect which appears, and failure to so notify JLT shall mean that the Customer loses his right to have the defect remedied.
WARRANTY RESTRICTIONS. In order for warranty to remain in full effect, reasonable care and conditions within the floor and its facility must be properly maintained. This includes, without limitation, following MFMA (Maple Flooring Manufacturer’s Association), Xxxxxxxxx Flooring Company’s & manufacturer’s guidelines as follows. Not following these guidelines will void warranty. Sweep the floor daily with a properly treated dust mop to keep it free from dust, grit, and abrasive particles. The Owner MUST use products recommended by Contractor, use of any other chemicals WILL void the warranty. The heating/ventilating/air condition system must be functioning
WARRANTY RESTRICTIONS. No warranty shall apply if the Software or the Juniper Platform (or other hardware on which the Software operates) (a) has been altered, except by Juniper; (b) has not been installed, operated, repaired, or maintained in accordance with documentation and instructions made available by Juniper; (c) has been subjected to unreasonable physical, thermal or electrical stress, misuse, negligence, or accident; or (d) has been licensed solely for the non- commercial purposes set forth in Section 5c of this XXXX or if the Software is beta software or otherwise has not been commercially released. In addition, neither the Software nor any Juniper hardware system on which it may be installed is designed or intended for (i) use in the design, construction, operation or maintenance of any nuclear facility, (ii) navigating or operating aircraft;

WARRANTY RESTRICTIONS. The warranties in this Section 1 do not apply if the Equipment or Software (1) has been altered by any party other than ScienceLogic, (2) has not been installed, operated, repaired or maintained in accordance with any installation, handling, maintenance or operating instructions supplied by ScienceLogic, (3) has been subjected to unusual physical or electrical stress, misuse, negligence or accident, or (4) has been used in such a way that ScienceLogic cannot reasonably reproduce the error. Warranty Disclaimers THE WARRANTIES IN THIS SECTION 1 ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SYSTEM INTEGRATION, DATA ACCURACY, NONINFRINGEMENT, AND NON-‐INTERFERENCE WITH RESPECT TO THE PRODUCTS AND THE USER DOCUMENTATION. YOU ASSUME RESPONSIBILITY FOR SELECTING THE PRODUCTS TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE USE OF, AND RESULTS OBTAINED FROM, THE PRODUCTS. WITHOUT LIMITING THE FOREGOING PROVISION, SCIENCELOGIC DOES NOT WARRANT THAT USE OF THE PRODUCTS WILL BE ERROR-‐FREE OR UNINTERRUPTED, THAT SCIENCELOGIC WILL CORRECT ALL PRODUCT DEFECTS OR THAT THE PRODUCTS WILL MEET YOUR REQUIREMENTS.
