Beta Software. If We identify the Software licensed to You as “Beta” Software, this section, Sections 11.1 (with all references to “Evaluation Software” being replaced with “Beta Software”) and 11.3 apply. We have no obligation to You to further develop or publicly release the Beta Software. Support is not available for Beta Software. Upon Our request, You agree to provide feedback regarding testing and use of the Beta Software, including error or bug reports. You grant Us a perpetual, non-exclusive, royalty-free, worldwide license to use, copy, distribute and make Derivative Works and incorporate the feedback into any Product, at Our sole discretion. Upon receipt of a later unreleased version of the Beta Software or release by Company of a publicly released commercial version of the Beta Software, You must return, destroy, or delete permanently all earlier Beta Software that You have received from Us.
Beta Software. If the Service released to Customer has been identified by Tanium as "Beta Software," then the provisions of Section 11.1 (Evaluation Software) will apply, in addition to this Section 11.3. Customer is under no obligation to use any Beta Software; doing so is in Customer’s sole discretion. Because Beta Software can be at various stages of development, operation and use of the Beta Software may be unpredictable. Customer acknowledges and agrees that: (1) Beta Software has not been fully tested; (2) use or operation of Beta Software should not occur in a production environment; (3) Customer’s use of Beta Software will be for purposes of evaluating and testing new functionality and providing Feedback to Tanium; and (4) Customer will inform its personnel regarding the nature of the Beta Software. In addition, Tanium has no obligation to Customer to (1) further develop or release the Beta Software or (2) provide support for the Beta Software. If Tanium releases another version of the Beta Software, Customer will return or destroy all prior version(s) or release(s) of the Beta Software that it received from Tanium.

If McAfee identifies the Software licensed to Company as “Beta” Software, this section, Sections 11.1 (with all references to “Evaluation Software” being replaced with “Beta Software”) and 11.3 apply. McAfee has no obligation to Company to further develop or publicly release the Beta Software. Support is not available for Beta Software. If requested by McAfee, Company will provide feedback to McAfee regarding testing and use of the Beta Software, including error or bug reports. Company xxxxx XxXxxx a perpetual, non-exclusive, royalty-free, worldwide license to use, copy, distribute and make Derivative Works and incorporate the feedback into any McAfee Product, at McAfee’s sole discretion. Upon receipt of a later unreleased version of the Beta Software or release by McAfee of a publicly released commercial version of the Beta Software, Company must return, destroy or delete permanently all earlier Beta Software received from McAfee.
Beta Software. Access to beta versions of new Synergy/DE software and the opportunity to provide input toward the released product.

If the Software You have received has been identified "Beta" Software in the applicable Subscription Agreement Addendum, then the provisions of Section 9a above shall apply accordingly. The purpose of releasing Beta software is to solicit feedback and help aPersona test new features or changes to existing features for a future release. aPersona has no obligation to You to further develop or publicly release the Beta Software since some aspects of a particular Beta release may or may not be suitable for commercial release. If requested by aPersona, You may provide feedback to aPersona regarding testing and use of the Beta Software, including error or bug reports. You agree to grant aPersona a perpetual, non-exclusive, royalty-free, worldwide license to use, copy, distribute, make derivative works and incorporate Your feedback into any aPersona product at aPersona's sole discretion. Upon receipt of a later unreleased version of the Beta Software or release by aPersona of a publicly released commercial version of the Beta Software You agree to return or destroy all earlier Beta Software received from aPersona.
Beta Software. Malwarebytes, at its sole discretion, may make available optional Software, including but not limited to utilities for supporting the usage of the Software, beta features that can be enabled within the Software, beta releases, pilots, limited releases, previews, or evaluations of Software (collectively “Beta Software”). Unless a particular Beta Software includes its own separate and specific terms and conditions, this Agreement shall govern the usage of Beta Software. MSP is not required to use Beta Software and such BETA SOFTWARE IS PROVIDED “AS-IS” WITHOUT ANY INDEMNIFICATION, WARRANTY, MAINTENANCE, OR SUPPORT OF ANY KIND. FURTHERMORE, MALWAREBYTES SHALL HAVE NO LIABILITY OF ANY TYPE WITH RESPECT TO THE BETA SOFTWARE UNLESS SUCH EXCLUSION OF LIABILITY IS NOT ENFORCEABLE UNDER APPLICABLE LAW, IN WHICH CASE IT’S LIABILITY WITH RESPECT TO THE FREE TRIAL SHALL NOT EXCEED $1,000.00. Beta Software is not fully tested and may have significant issues posing risks associated with its usage. Malwarebytes strongly recommends MSP back up any data. MSP agrees that where it elects to use Beta Software, Malwarebytes shall not be liable for any damage arising from such use. Where MSP decides to use the Beta Software in compliance with this Agreement, Malwarebytes grants a non-exclusive and non- transferable license to execute the Beta Software in accordance with its Documentation solely as allowed under Sections 2.1-2.2. The license term of the Beta Software shall be designated by Malwarebytes, in the event no term is designated, the license shall be valid for thirty (30) days. Malwarebytes may terminate the Beta Software license with or without cause upon 10 days’ notice, or immediately in the event of MSP’s breach of this Agreement.

Beta Software. Viewpoint may make non-production versions of Software (“Beta Software”) available to Customer upon mutual agreement. All Beta Software will be clearly designated as Beta Software at the time it is made available to Customer. Beta Software is intended for testing and evaluation purposes only. Viewpoint may, but is not obligated to, provide Software Assurance for the Beta Software. Section 4.1 shall not apply to the Beta Software. Viewpoint may discontinue Beta Software at any time in Viewpoint’s sole discretion and has no obligation to make it generally available. Notwithstanding Section 9 or Section 10, Viewpoint will have no liability for any harm or damage arising out of or in connection with any Beta Software, including any obligation or liability with respect to Customer Data. Any configurations or Customer Data entered into Beta Software, and any customizations made to Beta Software by or for Customer, may be permanently lost. If Customer provides any comments, ideas, suggestions, or proposals relating to the Beta Software to Viewpoint (“Feedback”), Customer hereby irrevocably assigns all right, title, and interest in and to the Feedback to Viewpoint. Customer acknowledges and understands that it will not receive any compensation for providing Feedback.
Beta Software. If You have requested use of or have access to Software or features that are identified by Magnet Forensics as pre-commercial, preview release, evaluation, pilot, "alpha", or "beta" software ("Beta Software"), the license rights set out above with respect to Your use of such Beta Software apply only to the extent necessary to enable You and the Users to test and provide Feedback to Magnet Forensics regarding the Beta Software. You acknowledge and agree that Magnet Forensics may terminate Your use of Beta Software at any time and may include technical measures in the Beta Software that renders it inoperable and You agree that You will not circumvent such technical measures. You further acknowledge and agree that the Beta Software is provided “AS IS” with none of the representations, warranties, or indemnities provided in the Agreement. In consideration of the grant of license for the Beta Software, You agree that You will provide Magnet Forensics with Feedback on Beta Software as Magnet Forensics reasonably requests without any compensation.
