Withdrawal of Property. All Property held by the Custodian shall be surrendered only in accordance with Directions except as otherwise provided in this Agreement. The Custodian shall have no duty or responsibility in respect of the application of the Property so withdrawn, or withdrawn on termination of this Agreement.
Withdrawal of Property. Broker acknowledges and agrees that (a) Owner may, with or without cause, withdraw the Property, or any portion thereof, from the market or lease the Property, or any portion thereof, to a different tenant, in each case, without liability or notice to Broker, and (b) Owner has not in any way committed or represented to Broker that it will enter into (or attempt to enter into) a Lease with Tenant, it being understood that any decision to enter into (or attempt to enter into) a Lease shall be at the sole discretion of Owner.
Withdrawal of Property. Licensee agrees that Licensor may withdraw any Property hereunder which would infringe or reasonably be claimed to infringe the right of a third party, provided that Licensor purchases the Licensed Product and other materials utilizing such withdrawn Property which cannot be sold or used by Licensee at their Replacement Value as defined in Paragraph 6(d) hereof.
Withdrawal of Property. The Declarant reserves the right to amend this Declaration unilaterally at any time so long as it holds an unexpired option to annex property pursuant to this Article, without prior notice and without the consent of any Person, for the purpose of removing certain portions of the Properties then owned by the Declarant or its affiliates or the Association from the provisions of this Declaration, to the extent originally included in error or as a result of any changes whatsoever in the plans for the properties desired to be effected by the Declarant, provided such withdrawal is not unequivocally contrary to the overall, uniform scheme of development for the Properties.
Withdrawal of Property. During the Declarant Control Period, Declarant reserves the right to unilaterally amend this Declaration to withdraw any portion of the Community from the coverage of this Declaration whether originally described in Exhibit "A" or added by Supplemental Declaration, however, the withdrawal of any property shall require the consent of the affected Owner(s), if other than Declarant If the property is Common Area, the Association shall consent to such withdrawal upon Declarant's request.

The Declarant reserves the right to amend this Declaration unilaterally at any time so long as it holds an unexpired option to annex property pursuant to this Article, without prior notice and without the consent of any Person, for the purpose of removing certain portions of the Properties then owned by the Declarant, the Cliffs Valley North Declarant or any affiliate of either or both of them or by the Association from the provisions of this Declaration, to the extent originally included in error or as a result of any changes whatsoever in the plans for the Properties desired to be effected by the Declarant, provided such withdrawal is not unequivocally contrary to the overall, uniform scheme of development for the Properties.
Withdrawal of Property. 5.1 If you withdraw any Lot after the Contract has been signed, we reserve the right to recover from you any expenses incurred.
5.2 If you withdraw any Lot from sale after the Lot has been catalogued, we reserve the right to charge you a withdrawal fee of up to 35% of the lower estimate (or reserve price, if there is one) plus any expenses incurred.
5.3 We retain the right to withdraw Lots at our discretion at any time for any reason.
Withdrawal of Property. Subject to the terms and conditions of any Control Agreement applicable to the Custody Account or the Deposit Account, all Property held by the Custodian shall be withdrawn and transferred by the Custodian only in accordance with Instructions except as otherwise provided in this Custody Agreement or in accordance with an order of a court or other governmental authority having jurisdiction of the Custodian. The Custodian shall have no duty or responsibility in respect of the application of the Property so withdrawn, or withdrawn on termination of this Custody Agreement.
Withdrawal of Property. If the property becomes unavailable for rental the owners shall strive to give as much notice as possible and shall make effort to find alternative accommodation. The tenants shall be refunded their total rental fee (except under circumstance covered under force majeure). The owners do not accept any further claim for monies out with this sum.
Withdrawal of Property. The Property is offered for sale subject to withdrawal from the market, change in offering price, prior sale or rejection of any offer because of the terms thereof, lack of satisfactory credit references of any Prospective Purchaser, or for any other reason whatsoever without notice. The Property is being offered without regard to race, creed, sex, religion or national origin.
