Without limiting clause 9. 5.2 or the Minister’s discretion under the Act, the Commonwealth will continue its existing policy9 for agreeing prices of the First New Brand where the originator brand of a Pharmaceutical Item (Existing Brand) has or had an Effective Price, subject to the new 60% cap. Without limiting clause 9. 2.6, the Occupant acknowledges that Tariffs are based on a rate per Room. The Occupant agrees that if they are sharing a Room with another occupant (and sharing a proportion of the Tariff with another occupant) they will be liable for the full (100%) Tariff if the other occupant vacates the Room.
Without limiting clause 9. 4.1, the Scheme Operator may, from time to time and in the Scheme Operator’s discretion, make, amend and revoke rules and regulations relating to all or part of the Common Property, including rules and regulations relating to permitted hours of use, booking procedures and user charges.
Without limiting clause 9. 1, the Parties will comply with applicable data protection principles. In particular, Institution and Investigator will only process Personal Data pursuant to the terms of this Agreement and in accordance with the Protocol, and will adopt the appropriate technical and organisational security measures in order to protect the Personal Data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access and against all other unlawful forms of processing. 9.2. Zdravotnické zařízení a zkoušející budou zejména zpracovávat osobní údaje výlučně v souladu s ustanoveními této smlouvy a v souladu s protokolem a přijmou příslušná technická a organizační bezpečnostní opatření ve snaze chránit osobní údaje před nahodilým nebo protizákonným zničením nebo nahodilou ztrátou, změnou, neoprávněným odtajněním nebo přístupem a proti všem protiprávním formám jejich zpracování.
