Section 15.9. Employees shall be granted two rest periods 8.02 Two breaks of ten (10) minutes duration each day; one prior to lunch period and one between lunch period and end of work each, but not more, shall be allowed during the regular shift. Regular time Time of these breaks to shall be determined mutually agreed upon and the entire crew may take the break simultaneously. Where work is scheduled for a period of ten (10) hours, a third rest break will be taken.
8.03 Where there is no running tap water available, drinking water in approved sanitary containers shall be provided. Paper cups will be supplied. Drinking water shall be local potable water - if not available, purified bottled water will be supplied by the com- panyEmployer.
Section 15.108.04 If requested the Employer shall provide a termination slip upon termination, which shall state the reason for the employee's termination, and whether or not the employee is eligible for rehire. A copy of the termination slip shall be supplied within three (3) calendar days upon request of the Union.
8.05 Adequate time will be allowed prior to quitting time for pickup of tools.
8.06 Suitable accommodation for meals and a place for employees' tools and clothing will be provided by the Employer on all jobs. Such lock-up shall have tables, benches, adequate lighting and ventilation and provision for continuous twenty-four (24) hours per day heat for drying clothing. It shall be kept clear of construction materials and equipment. Where flush toilets are not available, portable facilities must be provided.
8.07 In case of fire, burglary or marine wreck (as defined by the Insurance Act) on property or premises provided by the Employer, the Employer shall protect the value of an employee's work clothes up to a total of six hundred dollars ($600.00). The Employer shall also provide insurance for the employees' required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory their rights to submit a claim shall be waived.
8.08 On pile driving work, crane operators will come under the authority of the pile driving xxxxxxx, and will be expected to take orders from this xxxxxxx only.
8.09 If a crew is required to work after the regular shift in excess of two (2) hours overtime, a lunch and hot coffee will be provided by the Employer. There will be no loss of time to the employees during this period and work will continue. If site conditions allowthe Employer takes the employees to a restaurant in lieu of the above, adequate facilities they shall not be considered working during that period. Where it is impractical to have a hot meal, a meal allowance shall be included on the next regular pay cheque. The meal allowance shall be twenty-three dollars ($23.00) If the employee continues to work after this lunch or meal, they shall be provided within with a meal at four (4) hour intervals thereafter on the same basis as provided above.
8.10 The Employer shall pay all costs of obtaining operators' licences required under the Motor Vehicle Act for employees covered by this Agreement.
8.11 No employee will be permitted to use their own motor vehicle in a manner which is unfair to other members or against the best interests of the Union.
8.12 All Operating Engineers who request coveralls shall have these supplied by the Employer and replaced upon normal wear and tear. Mechanics shall be supplied with rain gear by the Employer and replaced upon normal wear and tear. Employees are expected to take reasonable care of coveralls supplied. Shop crews only shall have coveralls supplied and cleaned by the Employer. In the event that an employee does not return the coveralls or rain gear supplied to them by the Employer, the Employer shall deduct this cost from the employee. Essential protective clothing including welder’s gloves, rigging gloves, rigging belts, respirators, high visibility vests, protective vests or leather jackets and noise abatement devices shall be supplied at no charge to the employee. In the event that an employee does not return the foregoing items supplied to them by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any money owing to the employee. Life jackets, hard hats, suspensions for hard hats, welder’s goggles, fire retardant coveralls for welders and magnifying glasses for welder’s helmets will be provided by the Employer where necessary on a charge out basis at cost, such cost to be deducted from the employee’s earnings and refunded at such time as the employee returns the items to the Employer in reasonable condition, subject to normal wear and tear. The Employer agrees to the replacement of glass and other reasonable repairs to welding helmets for employeesdamage occurring to the employee’s helmet while in the employ of the Employer.

WORKING CONDITIONS. Section 15.11. Employees’ linens, uniforms or other articles of wearing apparel required by the Employer shall be furnished, maintained and laundered at the Employer’s expense. The contractor University shall provide the employees with one pair of working shoes once per calendar year. The working shoes shall be worn while at work. 3. The Employer agrees to provide sanitary and Federal healthsafe lockers, sanitation and safety lawswhich are not accessible to the public, and regulationsto insure safeguarding of possessions of employees on the premises. Workers The Employer shall also provide sanitary and adequate dressing rooms and space where employees may eat their meals.
4. The Employer shall not be permitted to work on unsafe scaffolds, with unsafe equipment, where proper safeguards are not provided, under conditions which are unsafe, deduct any money from the wages or injurious to health. All defective equipment, scaffolding, tools andcollect any money from any Employee for busboy’s breakage or any other purpose except as required by law.
Section 15.25. Employees shall make reasonable effort to process credit card charges accurately, where such practices now prevails, but in no event shall they assume responsibility for the validity of the card or the failure of the Employer to be allowed such time as necessary to collect, clean and store tools in reimbursed for the designated place before quitting timeamount of said charges for any reasons.
Section 15.36. Each worker The Employer shall offer Employees, whose regular job classification duties are not required during special banquets or catering functions, the opportunity to work, with the following understanding:
(a) The Employees must be entitled qualified to pickperform the duties and this determination is within management’s sole discretion. Crossing training will be provided at no cost to Faculty House, cross training, will take place during the Employees’ own time or during slow work-up time periods and will be at the end of each day which shall not be less than five (5) nor more than fifteen (15) minutes, exact time to depend on accessibility to actual place of work and to be established by mutual agreement at the job site conference by a represen- tative of the individual employer and a representative of the Union. WORKING CONDITIONS. Section 15.11. Any replacement Superintendent shall receive the contract wage, except where it includes extra pay attributable to years of service, special competence or special consideration beyond job requirements.
2. The contractor and members of the Union shall comply with all applicable provisions of State and Federal health, sanitation and safety laws, and regulations. Workers Superintendent shall not be permitted required to:
(a) renew cables on elevators or build block or hollow tile walls,
(b) run elevators except during relief period, lunch period, and emergencies and except that in any building employing three or less employees during the daytime, exclusive of the Superintendent, the Superintendent in such buildings shall do all the duties which the Superintendent has heretofore been accustomed to do,
(c) do any xxxxxx work except in a building employing three employees or less during the daytime, exclusive of the Superintendent, in which case the Superintendent should continue to do work the Superintendent has heretofore performed,
(d) perform work on unsafe scaffoldsa scaffold that is not directly over a roof, with unsafe equipment, where proper safeguards are not provided, under conditions which are unsafesetback, or injurious to health. All defective equipmentwithin the building,
(e) perform work on the inside of any fuel oil, scaffoldingpressure or hermetically sealed tank,
(f) build cutting tables, tools andmachine stands or dress racks, or
Section 15.2. Employees shall be allowed such time as necessary to collect(g) do any work that conflicts with State, clean and store tools in the designated place before quitting timeFederal or Municipal laws.
Section 15.33. Each worker The Superintendent shall not be penalized or discriminated against for attending arbitrations, hearings or meetings, but this privilege shall not be construed so as to interfere with the orderly operation of the building.
4. There may be added to the duties of the Superintendent more or less miscellaneous and relief work for which the Superintendent’s additional compensation distinguishes such employee from other classes of workers on the premises, subject to the grievance and arbitration procedures provided herein.
5. The Arbitrator may consider exceptional cases in which the Union claims that excessive work or the utilization of unique skills or painting is required of the Superintendent and may relieve the Superintendent of, or require additional compensation for, such excessive work.
6. No Superintendents leaving their positions of their own accord shall be entitled to pick-up time accrued vacation allowance unless they have given the Employer at least thirty (30) days written termination notice.
7. The Union may question the end propriety of each day which the termination of the Superintendent’s services and demand such employee’s reinstatement or severance pay, if any, as the case may be, by filing a grievance under Article VII of this Agreement. The Arbitrator shall give due consideration to the Superintendent’s management responsibilities and to the need for cooperation between the Superintendent and the Employer.
8. No provision of this Agreement shall be so construed as to reduce the wages or lower the rate of pay of the Superintendent or to lower or worsen the terms or conditions of the Superintendent’s employment. This provision shall not be less than five (5) nor more than fifteen (15) minutesconstrued as to in any way prevent the exercise by the Employer of its normal management prerogatives to make changes in equipment, exact time schedules, shifts, number of employees and duties necessary and incident to depend on accessibility to actual place of work the operation, maintenance and to be established by mutual agreement at the job site conference by a represen- tative servicing of the individual employer and a representative building not inconsistent with the letter or the spirit of the Union. Employees receiving notice any other specific provision of discharge shall be allowed to pick-up time prevailing on the job, to assemble their toolsthis Agreement.

Section 15.109.04 Chemical or flush toilets shall be provided from the commencement of work on all jobs. If site conditions allowWhere the sewer or chemical toilets are not available, adequate sanitary toilet facilities shall be provided as called for in local sanitary regulations. Toilet houses shall be painted, at least on the inside, and cleaned out daily. Toilet paper will be provided.
9.05 Where there is no running tap water available, drinking water in approved sanitary containers shall be provided. Paper cups will be supplied. Salt tablets shall be supplied during the summer months.
9.06 If requested by the Union or employee, the Employer will provide within three (3) calendar days, a reasonable termination slip which shall state the reason for the employee’s termination and whether or not he is eligible for rehire.
9.07 Adequate time will be allowed prior to quitting time for employeespicking up tools.
9.08 A lock-up shall be provided for employees for drying clothes, and dressing room, as well as lunch room. The lock-up shall have tables, and benches with provision for drying clothes. Such lock-up shall have windows and venting with adequate lighting and provision for continuous heat twenty-four (24) hours a day. The Employer shall be responsible for having the lock-up cleaned out daily and kept cleared of building material and other construction paraphernalia. Additional shelters shall be provided for employees to eat their lunch as may be required.
9.09 In case of fire or burglary on property or premises provided by the Employer, the Employer shall protect the value of an employee’s work clothes up to a total of three hundred and fifty dollars ($350.00). The Employer shall also provide fire and burglary insurance for the employees required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory his rights to submit a claim shall be waived.
(a) All mechanics, welders, servicemen, tire servicemen, drill doctors, steel sharpeners, bodymen painters, and mechanics and welder apprentices who request coveralls shall have these supplied and cleaned by the Employer. There shall be one change a week available in the employee’s proper size. Employees are expected to take reasonable care of coveralls supplied. In the event that an employee does not return the coveralls supplied to him by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any monies owing to the employee. When requested, coveralls shall be supplied on a temporary basis to employees who assist on work as described above, or where the Employer and the Union mutually agree that coveralls are required.
(b) Employees entitled to receive coveralls as provided herein may obtain an additional change of coveralls in any one week providing the condition of the coveralls requires a change. The shop xxxxxxx shall use discretion in authorizing the additional change.
(c) All shops shall provide adequate clean-up facilities.
9.11 The Employer shall pay the cost of obtaining operators’ licences other than those required under the Motor Vehicles Act for employees covered by this Agreement.
9.12 No employee will be permitted to use his own motor vehicle in a manner which is unfair to other members or against the best interest of the Union.
9.13 Each employee being terminated will be given one (1) hour’s notice of termination by the Employer or one (1) hour’s pay allowed in lieu thereof. Heavy duty mechanics and apprentice mechanics may utilize this hour to gather together their tools and put them in shape for their next job.
9.14 When a mechanic leaves the employ of the Employer, the Employer shall be required to pay cost of shipping mechanic’s tools. Tools shall be shipped within forty-eight (48) hours of his leaving his employment, subject to the same conditions as govern transportation. When an Operating Engineer elects to transport his own tools to and from the jobsite, the employee shall be paid the rate of two dollars and seventy-five cents ($2.75) per one hundred (100) pounds per one hundred (100) miles. (e.g. $2.75 x 528 pounds x 273 miles = $39.64). Where the Employer fails to comply with the above, the employee shall be deemed to be still on the payroll of the Employer and shall receive his usual wages and all other conditions of this Agreement until there is compliance with these provisions.
9.15 Where an employee is involved in an accident while on the job and as a result is unable to perform his work, he shall receive a full day’s pay for the day of the accident.

When working with material or equipment which is contaminated with human waste, the contractor must furnish suitable facilities for the workers to wash and disinfect their hands immediately before the lunch period and this time (ten (10) minutes) shall not be considered as part of the lunch period time. Workers working with toxic materials such as epoxies, solvents, paint, adhesives, chemi- cals, radiation sewage gasses and irritants such as fiberglass blankets, insulation or sound attenuation shall be furnished with proper instructions, safety procedures, protective equip- ment, respirators, showers and washing facilities and/or any other measure necessary to maintain maximum safety.
Section 15.7. First Aid Kits and other approved emergency equipment shall be kept in convenient and easily accessible places at all times, and shall be in the charge of an accredited First Aid Operator.
Section 15.8. Should an employee be taken to any medical facility due to a lost time injury, the Union Representative responsible for the area the job is located in shall be notified (by phone or fax or e-mail) as soon as practical. In the event the job has a Xxxxxxx, he or she shall be notified of the injury as soon as practical.
Section 15.9. Employees shall be granted two rest periods 8.02 Two breaks of ten (10) minutes duration each day; one prior to lunch period and one between lunch period and end of work each, but not more, shall be allowed during the regular shift. Section 15.108.04 If requested the Employer shall provide a termination slip upon termination, which shall state the reason for the employee's termination, and whether or not the employee is eligible for rehire. A copy of the termination slip shall be supplied within three (3) calendar days upon request of the Union.
8.05 Adequate time will be allowed prior to quitting time for pickup of tools.
8.06 Suitable accommodation for meals and a place for employees' tools and clothing will be provided by the Employer on all jobs. Such lock-up shall have tables, benches, adequate lighting and ventilation and provision for continuous twenty-four (24) hours per day heat for drying clothing. It shall be kept clear of construction materials and equipment. Where flush toilets are not available, portable facilities must be provided.
8.07 In case of fire, burglary or marine wreck (as defined by the Insurance Act) on property or premises provided by the Employer, the Employer shall protect the value of an employee's work clothes up to a total of six hundred dollars ($600.00). The Employer shall also provide insurance for the employees' required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory their rights to submit a claim shall be waived.
8.08 On pile driving work, crane operators will come under the authority of the pile driving xxxxxxx, and will be expected to take orders from this xxxxxxx only.
8.09 If a crew is required to work after the regular shift in excess of two (2) hours overtime, a lunch and hot coffee will be provided by the Employer. There will be no loss of time to the employees during this period and work will continue. If site conditions allowthe Employer takes the employees to a restaurant in lieu of the above, adequate facilities they shall not be considered working during that period. Where it is impractical to have a hot meal, a meal allowance shall be included on the next regular pay cheque. The meal allowance shall be twenty-two dollars ($22.00). If the employee continues to work after this lunch or meal, they shall be provided within with a meal at four (4) hour intervals thereafter on the same basis as provided above.
8.10 The Employer shall pay all costs of obtaining operators' licences required under the Motor Vehicle Act for employees covered by this Agreement.
8.11 No employee will be permitted to use their own motor vehicle in a manner which is unfair to other members or against the best interests of the Union.
8.12 All Operating Engineers who request coveralls shall have these supplied by the Employer and replaced upon normal wear and tear. Mechanics shall be supplied with rain gear by the Employer and replaced upon normal wear and tear. Employees are expected to take reasonable care of coveralls supplied. Shop crews only shall have coveralls supplied and cleaned by the Employer. In the event that an employee does not return the coveralls or rain gear supplied to them by the Employer, the Employer shall deduct this cost from the employee. Essential protective clothing including welder’s gloves, rigging gloves, rigging belts, respirators, high visibility vests, protective vests or leather jackets and noise abatement devices shall be supplied at no charge to the employee. In the event that an employee does not return the foregoing items supplied to them by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any money owing to the employee. Life jackets, hard hats, suspensions for hard hats, welder’s goggles, fire retardant coveralls for welders and magnifying glasses for welder’s helmets will be provided by the Employer where necessary on a charge out basis at cost, such cost to be deducted from the employee’s earnings and refunded at such time as the employee returns the items to the Employer in reasonable condition, subject to normal wear and tear. The Employer agrees to the replacement of glass and other reasonable repairs to welding helmets for employeesdamage occurring to the employee’s helmet while in the employ of the Employer.

(d) That no employee shall be required to apply such materials unless all of the conditions for application recommended by the Health Department or a reputable laboratory are posted at the time of application.
SECTION 2. Rollers can be used in all materials.
SECTION 3. There shall be no limit on the length of spray extension poles.
SECTION 4. Employees who report for work at the time they are instructed by the Employer must be ready and Federal healthable to work and shall be neat in appearance when reporting to work or no show up time will be allowed.
SECTION 5. Journeyman Painters shall report to work with the usual tools of the trade-duster, sanitation putty knife, broad knife, hammer, screw driver, pliers, clean white overalls and safety lawsan extra pair of clean white overalls, caps and white shirts.
SECTION 6. Paperhangers will supply their own hand tools, excluding table, trusses, and regulationspaste machine.
SECTION 7. Workers shall not be permitted If an employee fails to report to work on unsafe scaffoldswith the necessary tools or clothing, with unsafe the Employer may buy such tools or clothing, present them to the employee, and deduct their cost from said employee's pay.

WORKING CONDITIONS. Section 15.117:01 On all energized circuits and portions of equipment (excluding neon signs and circuit testing) carrying four hundred (400) volts or over, as a safety measure two (2) or more Journeymen must work together. In no event shall Apprentices work on energized circuits.
a) If an Employee is not instructed to go direct to a jobsite, in town, at the start of a day's work, and reports to the shop instead, his time for pay purposes will include travel time to the jobsite, sites, and return to the shop.

Section 15.108.04 If requested the Employer shall provide a termination slip upon termination, which shall state the reason for the employee's termination, and whether or not the employee is eligible for rehire. A copy of the termination slip shall be supplied within three (3) calendar days upon request of the Union.
8.05 Adequate time will be allowed prior to quitting time for pickup of tools.
8.06 Suitable accommodation for meals and a place for employees' tools and clothing will be provided by the Employer on all jobs. Such lock-up shall have tables, benches, adequate lighting and ventilation and provision for continuous twenty-four (24) hours per day heat for drying clothing. It shall be kept clear of construction materials and equipment. Where flush toilets are not available, portable facilities must be provided.
8.07 In case of fire, burglary or marine wreck (as defined by the Insurance Act) on property or premises provided by the Employer, the Employer shall protect the value of an employee's work clothes up to a total of eight hundred dollars ($800.00). The Employer shall also provide insurance for the employees' required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory their rights to submit a claim shall be waived.
8.08 On pile driving work, crane operators will come under the authority of the pile driving xxxxxxx, and will be expected to take orders from this xxxxxxx only.
8.09 If a crew is required to work after the regular shift in excess of two (2) hours overtime, a hot meal will be provided by the Employer. There will be no loss of time to the employees during this period and work will continue. If site conditions allowthe Employer takes the employees to a restaurant in lieu of the above, adequate facilities they shall not be considered working during that period. Where it is impractical to have a hot meal, a meal allowance shall be included on the next regular pay cheque. The meal allowance shall be twenty-five dollars ($25.00). If the employee continues to work after this lunch or meal, they shall be provided with a hot meal at four (4) hour intervals thereafter on the same basis as provided above. If the employee continues to work after this lunch or meal, they shall be provided with a hot meal within four (4) hour intervals thereafter on the same basis as provided above.
8.10 The Employer shall pay all costs of obtaining operators' licences required under the Motor Vehicle Act for employees covered by this Agreement.
8.11 No employee will be permitted to use their own motor vehicle in a manner which is unfair to other members or against the best interests of the Union.
8.12 All Operating Engineers who request coveralls shall have these supplied by the Employer and replaced upon normal wear and tear. Mechanics shall be supplied with rain gear by the Employer and replaced upon normal wear and tear. Employees are expected to take reasonable care of coveralls supplied. Shop crews only shall have coveralls supplied and cleaned by the Employer. In the event that an employee does not return the coveralls or rain gear supplied to them by the Employer, the Employer shall deduct this cost from the employee. Essential protective clothing including welder’s gloves, rigging gloves, rigging belts, respirators, high visibility vests, protective vests or leather jackets and noise abatement devices shall be supplied at no charge to the employee. In the event that an employee does not return the foregoing items supplied to them by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any money owing to the employee. Life jackets, hard hats, suspensions for hard hats, welder’s goggles, fire retardant coveralls for welders and magnifying glasses for welder’s helmets will be provided by the Employer where necessary on a charge out basis at cost, such cost to be deducted from the employee’s earnings and refunded at such time as the employee returns the items to the Employer in reasonable condition, subject to normal wear and tear. The Employer agrees to the replacement of glass and other reasonable repairs to welding helmets for employeesdamage occurring to the employee’s helmet while in the employ of the Employer.

WORKING CONDITIONS. Section 15.19:01 Call Out – Compensation
(a) Twelve-month employees who receive holiday pay for school holidays listed in the Agreement (e.g. New Year’s Day, Xxxxxx Xxxxxx Xxxx Day) and who are called out to their worksites to perform work on such holidays will be paid double time for all time worked in addition to their holiday pay.
(b) Twelve-month employees who are not on duty and are called out to their worksites to perform work on a non-holiday (e.g. after regular working hours, weekends, scheduled day off) shall be compensated in accordance with the Fair Labor Standards Act, but shall be guaranteed a two (2) hour minimum.
(c) Custodians responsible for turning off alarms shall be compensated in accordance with the FLSA but shall not be guaranteed a minimum.
Section 9:02 Duty Schedule Bargaining Unit members shall be assigned a schedule of specific duties to be performed on a routine basis.
Section 9:03 Employee Training Employees shall be trained to perform duties which are new to them. Training shall take place during regular working hours. If not, employees will be compensated for training time spent outside of regular working hours.
Section 9:04 Equipment Needed The contractor Board shall provide each employee with materials, supplies and equipment with which to perform his duties.
Section 9:05 Equitable Distribution of Overtime Overtime shall be offered on an equitable basis, but nothing herein shall require the employer to equalize overtime among members of the Union Bargaining Unit.
Section 9:06 Facilities
(a) Telephone messages shall comply with all applicable provisions be conveyed to employees. Emergency messages shall be conveyed immediately.
(b) Separate restrooms for adults and students shall be maintained at each school site.
(c) A telephone will be made available for necessary calls during duty time in some appropriate area of State the school.

WORKING CONDITIONS. Section 15.1Until such time as changed by the Joint Trade Board the following conditions shall remain in effect:
(A) The Employer shall furnish fresh drinking water during working hours and shall supply a standard type commercial sanitary water container manufactured for that purpose which dispenses water through a spigot and also paper cups in a commercial cup dispenser.
(B) If five or more employees are employed on the job, they are to be provided with a suitable dry, watertight place in which to change their clothes, separate from the paint and tool shop. Each shanty shall be provided with benches with no less than three feet of wall space for each employee for proper dressing facilities and shall be raised sufficiently off the ground, to keep the floor dry. Heated dressing areas shall be provided during the winter period.
(C) The Employers shall furnish a sufficient supply of clean pails of water, soap powder and clean sterilized white rags and an adequate facility for washing. Ten minutes shall be allowed for washing, at the lunch period if the employees are brought in, and at quitting time. The contractor Employers shall further provide all substances required for adequate cleaning following employee exposure to lead, and members any and all other hazardous materials and will provide adequate washing stations and showers in accordance with OSHA regulations.
(D) Each Employer shall supply burlap covering for scaffolds where necessary for safety.
(E) Employers shall provide adequate safety equipment and first aid kits. The names, addresses and telephone numbers of the Union doctors available for first aid shall be posted on all jobs. The Employer shall comply with all applicable provisions of State and Federal health, sanitation and safety laws.
(F) Sanitary toilet facilities shall be available on all jobs.
(G) The Employer agrees to provide protective clothing when using substances designated by the Joint Trade Board as requiring such protective clothing.
(H) The labeling of original containers or materials to show the ingredients thereof, such as material safety data sheets, is favored.
(I) It shall be the duty of the Xxxxxxx to enforce the use of safety harnesses and to discharge any employee refusing to wear and properly use a safety harness where required by law or regulations. Workers shall not be permitted to work on unsafe scaffolds, with unsafe equipment, where proper safeguards .
(J) Employees who are not provided, under conditions which are unsafethe influence of drugs or alcohol during working hours, or injurious to health. All defective equipment, scaffolding, tools and

WORKING CONDITIONS. Section 15.14.01 It is understood and agreed that the employee on shift shall be responsible only to the Chief Engineer, Assistant Chief Engineer, or Acting Chief Engineer, or in his/her absence, the Superintendent or Manager.
4.02 Unless relief is provided and acting on instructions of the Chief Engineer, Assistant Chief Engineer, or Acting Chief Engineer, or in his/her absence, the Management, Refrigeration Operator shall remain in the vicinity of the engine room at all times during their respective shifts, except in the course of their regular duties elsewhere in the plant. Regular duties, such as taking temperatures and attending the boilers, shall be carried out promptly.
4.03 Employees when not doing work covered by their own classification shall do such work as instructed by the Chief Engineer, Assistant Chief Engineer, Acting Chief Engineer, or in his/her absence, the Management, such as maintenance work.
4.04 The Chief Engineer shall have full supervision, within the provisions of the Boiler and Pressure Vessel Act, of the employees coming under the jurisdiction of this Agreement engaged in operation, maintenance or installation of equipment pertaining to the existing plant.
4.05 A schedule of shifts for crewing during the salmon season and the xxxxxxx season shall be drawn up prior to the start of each season, after consultations between the employees concerned and Management. Section 15.2. Employees the first shift of the day shall be allowed such day shift. The weekly days of rest will normally be Saturday and Sunday. The decision to change to two or three eight hour shifts or to two twelve hour shifts will depend on the processing period, and the ability and availability of the crew. Such decisions will be made after consultation with the crew and/or its representative as time permits. Given the different operating/processing needs at the Prince Rupert Plant, different shifts may be utilized at each operation during the same time period.
4.06 An employee required to perform preparatory work necessary for processing operations may be called to commence work up to three (3) hours prior to the regular start time. Section 15.108.04 If requested the Employer shall provide a termination slip upon termination, which shall state the reason for the employee's termination, and whether or not the employee is eligible for rehire. A copy of the termination slip shall be supplied within three (3) calendar days upon request of the Union.
8.05 Adequate time will be allowed prior to quitting time for pickup of tools.
8.06 Suitable accommodation for meals and a place for employees' tools and clothing will be provided by the Employer on all jobs. Such lock-up shall have tables, benches, adequate lighting and ventilation and provision for continuous twenty-four (24) hours per day heat for drying clothing. It shall be kept clear of construction materials and equipment. Where flush toilets are not available, portable facilities must be provided.
8.07 In case of fire, burglary or marine wreck (as defined by the Insurance Act) on property or premises provided by the Employer, the Employer shall protect the value of an employee's work clothes up to a total of six hundred dollars ($600.00). The Employer shall also provide insurance for the employees' required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory their rights to submit a claim shall be waived.
8.08 On pile driving work, crane operators will come under the authority of the pile driving xxxxxxx, and will be expected to take orders from this xxxxxxx only.
8.09 If a crew is required to work after the regular shift in excess of two (2) hours overtime, a lunch and hot coffee will be provided by the Employer. There will be no loss of time to the employees during this period and work will continue. If site conditions allowthe Employer takes the employees to a restaurant in lieu of the above, adequate facilities they shall not be considered working during that period. Where it is impractical to have a hot meal, a meal allowance shall be included on the next regular pay cheque. The meal allowance shall be twenty-two dollars ($22.00). If the employee continues to work after this lunch or meal, they shall be provided within with a meal at four (4) hour intervals thereafter on the same basis as provided above.
8.10 The Employer shall pay all costs of obtaining operators' licences required under the Motor Vehicle Act for employees covered by this Agreement.
8.11 No employee will be permitted to use their own motor vehicle in a manner which is unfair to other members or against the best interests of the Union.
8.12 All Operating Engineers who request coveralls shall have these supplied by the Employer and replaced upon normal wear and tear. Mechanics shall be supplied with rain gear by the Employer and replaced upon normal wear and tear. Employees are expected to take reasonable care of coveralls supplied. Shop crews only shall have coveralls supplied and cleaned by the Employer. In the event that an employee does not return the coveralls or rain gear supplied to them by the Employer, the Employer shall deduct this cost from the employee. Essential protective clothing including welder’s gloves, rigging gloves, rigging belts, respirators, high visibility vests, protective vests or leather jackets and noise abatement devices shall be supplied at no charge to the employee. In the event that an employee does not return the foregoing items supplied to them by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any money owing to the employee. Life jackets, hard hats, suspensions for hard hats, xxxxxx’s goggles, fire retardant coveralls for welders and magnifying glasses for welder’s helmets will be provided by the Employer where necessary on a charge out bas is at cost, such cost to be deducted from the employee’s earnings and refunded at such time as the employee returns the items to the Employer in reasonable condition, subject to normal wear and tear. The employer shall operate such heating and air conditioning equipment and/or fans, under its control, in order to maintain comfortable working temperatures in a manner consistent with the foregoing provision. Adequate lighting shall be provided in public areas to allow employees access to the areas they are to service.
Section 5. It is agreed that there shall be no limitation on the type of work now being performed by any employee in a member office building.
Section 6. Each employee shall be entitled to pick-up twenty (20) minutes of paid, nonworking time at the end of each per day which shall be taken in two rest periods.
Section 7. The Employer shall not impose an unreasonable workload upon any employee or add on any duties over a reasonable work load. In the event an employee is absent the remaining employees may be temporarily assigned to do part of the work assignments of the absent employees but they shall not be less expected to perform their regular full work loads and the extra work. Employees shall not be directed to do part of the work assignments of the absent employees unless and until they have first been instructed, in writing (and if reasonably practicable, in Spanish and/or Polish), as to what portions of their regular work assignment shall not be done in order to do the extra work. Copies of these instructions shall be provided to the xxxxxxx and the building manager. If the instruction is not given in writing or if copies thereof are not provided to the xxxxxxx, any discipline imposed upon employees for failure to perform the extra work shall be rescinded. The Employer shall either hire a temporary replacement or assign relief coverage (other than regularly-assigned cleaning employees) to perform the duties of any regularly- assigned general cleaning employee whose recurring job responsibilities cannot be postponed and who is absent for five (5) nor consecutive working days; provided, that in those buildings with regular night general cleaning staffs of 40 or more employees, the Employer shall hire temporary replacements or assign relief coverage if more than fifteen 20% or 12 employees (15whichever is less) minutes, exact time to depend on accessibility to actual place of work and to be established by mutual agreement at the job site conference by a represen- tative of the individual employer and a representative of the Union. WORKING CONDITIONS. Section 15.14.01 It is understood and agreed that the employee on shift shall be responsible only to the Chief Engineer, Assistant Chief Engineer, or Acting Chief Engineer, or in his/her absence, the Superintendent or Manager.
4.02 Unless relief is provided and acting on instructions of the Chief Engineer, Assistant Chief Engineer, or Acting Chief Engineer, or in his/her absence, the Management, Refrigeration Operator shall remain in the vicinity of the engine room at all times during their respective shifts, except in the course of their regular duties elsewhere in the plant. Regular duties, such as taking temperatures and attending the boilers, shall be carried out promptly.
4.03 Employees when not doing work covered by their own classification shall do such work as instructed by the Chief Engineer, Assistant Chief Engineer, Acting Chief Engineer, or in his/her absence, the Management, such as maintenance work.
4.04 The Chief Engineer shall have full supervision, within the provisions of the Boiler and Pressure Vessel Act, of the employees coming under the jurisdiction of this Agreement engaged in operation, maintenance or installation of equipment pertaining to the existing plant.
4.05 A schedule of shifts for crewing during the salmon season and the xxxxxxx season shall be drawn up prior to the start of each season, after consultations between the employees concerned and Management. The contractor and members first shift of the Union week shall comply with all applicable provisions of State and Federal health, sanitation and safety lawsbe Monday, and regulationsthe first shift of the day shall be day shift. Workers The weekly days of rest will normally be Saturday and Sunday. The decision to change to two or three eight hour shifts or to two twelve hour shifts will depend on the processing period, and the ability and availability of the crew. Such decisions will be made after consultation with the crew and/or its representative as time permits. Given the different operating/processing needs at the Prince Rupert Plant, different shifts may be utilized at each operation during the same time period.
4.06 An employee required to perform preparatory work necessary for processing operations may be called to commence work up to three (3) hours prior to the regular start time. Nothing in this Article will limit the Company=s right to call in an employee more than three (3) hours before the regular start time as long as overtime is paid in accordance with the terms of this Article and others in the Agreement. A maximum of three (3) hours at time and one-half shall be paid on any one day Monday to Friday inclusive.
4.07 If the preparatory work referred to in Article 4.06 is expected to exceed three (3) hours, the employee designated for the shift in which those hours may fall, shall be called in to perform such work until the commencement of the next normal shift.
4.08 Where the company proposes a short change from the twelve-hour shift schedule, the Graveyard engineer on the day after the short change would work 6:00 PM to 4:00 AM. The Day Shift engineer would work 8:00 AM to 6:00 PM. On the second day, the engineers would work the regular Day Shift and Afternoon Shift. Under this Article, Article 7.05 would not apply.
4.09 Where work becomes more year round (i.e. approximately nine (9) months or more), the Company may elect to introduce a rotating shift schedule whereby overtime is to be paid only in accordance with Article VII B Hours of Work and Overtime. The shift schedule shall be arranged following consultation between Management and the employees. Under a 3 shift per 24-hour basis, the following schedule shall apply: Day Shift - 8:00 AM to 4:00 PM Afternoon Shift - 4:00 PM to 12:00 AM Graveyard Shift - 12:00 AM to 8:00 AM
4.10 Upgrading Assistance B By mutual agreement between the Company and the employee, the employee may take a course to upgrade his/her certificate or to improve his/her knowledge in keeping with technical changes related to his/her current job and certificate.
4.10.1 In considering an employee=s request for upgrading, the Company shall ascertain its relevancy in terms of present requirements at the plant or future requirements due to anticipated expansion or technical change. Where the Company agrees to an employee upgrading his/her certificate the Company will pay a minimum of 90% of the difference between the employee=s regular rate of pay and the amount allowed by Canada Employment and Immigration Commission, for the period of time required to complete the Standardization Curriculum course. It is understood that where an employee can reduce the time spent by personal study prior to taking the course, the Company will encourage him/her to do so and assist where possible. The Company shall pay the full cost of the 3rd class correspondence course and required books and materials upon successful completion of the course. Any amount paid by the Company remains a debt of the employee to the Company for two full years of employment after completion of the upgrading course. For employees with less than two years of service with the Company, the employee=s debt to the Company will diminish 50% after the first year, 100% after the second year. For employees with more than two years of service, the employee=s debt to the Company will diminish 50% after 6 months and 100 % after 1 year. The Company may request the employee to sign a contractual agreement before commencing assistance payments, and arrange with the employee to receive periodic proof of attendance at the school of instruction.
4.10.2 The Company shall not normally be permitted obligated to work on unsafe scaffoldsreimburse employees for cost of tuition or materials for short-term courses for personal and/or correspondence study, with unsafe equipmentexcept where courses are required to be taken by an employee prior to attempting a higher level of certification.
4.10.3 The Company will not pay for education normally acquired in a public school, high school or university, nor will the Company pay for repeat courses where proper safeguards are not providedan employee has attempted the same course and failed.

14:07 The Employer shall supply a clothes locker, coveralls and laundering of same to those employees employed in the servicing and repair of equipment. All employees working under this Collective Agreement shall be supplied with gloves. The gloves shall remain the property of the Employer and will be replaced without charge when worn out gloves are presented for exchange. Operators will be issued coveralls for use when required. Employees employed in the welding trade shall receive a better quality of coveralls, leathers as well as fire retardant coveralls (or parkas) during the winter months.
14:08 At no time will an employee be required to work shift. Regular time in a lesser wage classification than that for which he was hired unless the employee agrees to the lesser wage classification in writing.
14:09 All employees employed as mechanics, welders, apprentice mechanics, apprentice welders, tire mechanics (tire men), service truck and lubricator persons and shop labourers will receive an industrial clothing allowance of these breaks three hundred dollars ($300.00) tax free per year, to be paid annually on November 1st in the form of a prepaid voucher at a local industrial clothing supplier to be determined by the com- panyEmployer. WORKING CONDITIONS. Section 15.18:01 Call Out – Compensation
(a) Twelve-month employees who receive holiday pay for school holidays listed in the Agreement (e.g. New Year’s Day, Xxxxxx Xxxxxx Xxxx Day) and who are called out to their worksites to perform work on such holidays will be paid double time for all time worked in addition to their holiday pay.
(b) Twelve-month employees who are not on duty and are called out to their worksites to perform work on a non-holiday (e.g. after regular working hours, weekends, scheduled day off) shall be compensated in accordance with the Fair Labor Standards Act, but shall be guaranteed a two (2) hour minimum.

Section 8:02 Duty Schedule Bargaining Unit members shall be assigned a schedule of specific duties to be performed on a routine basis.
Section 8:03 Employee Training Employees shall be trained to perform duties which are new to them. Training shall take place during regular working hours. If not, employees will be compensated for training time spent outside of regular working hours.
Section 8:04 Employee Uniforms The contractor and Board will provide new uniform shirts, for custodial employees, every year which will be required to be worn while at work. Additional shirts can be bought by the employee at the Board’s cost.

WORKING CONDITIONS. WORKING CONDITIONS. Section 15.11. Any machine under the jurisdiction of the Operating Engineers shall not be less operated without an Engineer and/or Crew present, however, should a piece of equipment become disabled and in need of repair, the Engineer and/or Crew may be assigned to another unassigned piece of equipment until the original piece of equipment has been repaired. Under no circumstances will the Engineer and/or Crew be laid off because an unassigned piece of equipment is unavailable unless the disabled machine is not to be repaired or the disabled machine is returned to the shop for repair.
Section 12. The Operating Engineer shall not leave his/her job during working hours without permission except during lunch hour or because of conditions beyond the Operating Engineer’s control.
Section 13. All legal holidays as prescribed in this Agreement falling on Sunday shall be observed on the following Monday. Any work performed on that day will be paid at the prescribed overtime rates.
Section 14. When any pump installation is installed and connected, whether temporary or permanent, it shall be manned by an Operating Engineer when used to xxxxxxx for said maintenance purposes.
Section 15. When an Engineer and/or Crew is called back to work after completing a shift to move a machine on that job only, they shall receive a minimum of four (4) hours at time and one-half (1½) pay. If the machine is put into production they shall receive eight (8) hours’ time and one-half (1½) pay.
Section 16. No employee shall be required to work more than five (5) nor consecutive hours without a lunch break. When unscheduled overtime work of more than fifteen two (152) minuteshours is required, exact lunch will be provided by the Employer or the employees will be reimbursed in the amount of four dollars ($4.00).
Section 17. No employee shall be transferred from one Employer to another without the consent of the Employer for whom he/she is working and the Union except under unusual circumstances or in an emergency, nor shall a Contractor transfer an employee from his payroll to that of another without notification to and with the consent of the Union.
Section 18. Any Operating Engineer who fails to show up for work or leaves his/her work without notifying his/her Union or Business Representative, if it is within his/her power to do so, shall be paid only for the time worked.
Section 19. All machines and equipment that are not listed in the Agreement shall be placed in a classification decided by the Joint Committee comprised of the Union and the Contractor.
Section 20. As new equipment is developed and made available for use, a reasonable amount of time shall be allowed the Engineer to depend on accessibility familiarize himself/herself with this particular equipment.

The Chairman of each meeting shall make a report in triplicate, copies going to the Company office, the Union office, and the bulletin boards. necessary to attend meetings of the Committee, and the time so spent shall be deemed to be work time for which he shall be paid straight time while on shift or time and one half if off shift for all applicable provisions of State hours in attendance at the safety meetings (call out time not applicable). All required safety equipment (excluding safety boots) is provided at the employee's induction, and Federal health, sanitation on-the-job familiarization and safety lawstraining is provided by immediate supervisor.
10:01 (b) The Company agrees that Local 3l-X representatives will attend all future X. X. Xxxx Forest Products Ltd./Communications, Energy and Paperworkers Union Safety Conferences. Six (6) delegates from Local 3l-X may attend the conference. These delegates will be compensated for any loss of wages incurred as a result of attending the Conference.
10:02 It is agreed that there shall be properly equipped first-aid kits sufficient for normal requirements, located on the operation.
10:03 The Company agrees to provide a statement for each weekly pay period to all employees, showing all credits, deductions, hours of work and the rate per hour, all hours worked at premium rate, and regulationsthe type of work performed by the employee during such pay period.
10:04 All hand tools and equipment required on the job will be made available to all employees on loan. Workers When an operator of equipment is required by the Company to do a mechanical repair job, he will be furnished such tools as are required. All tools and equipment not returned will be charged for in full. Worn out or broken tools will be replaced with serviceable tools free of charge provided that the worn out or broken tools are returned. The Company will provide free insurance against damage by fire or theft of tradesmen's tools normally required by tradesmen to the full replacement value of such tools. Employees will be required to furnish the same tools which were required in the past. Tradesmen, to be eligible for above insurance, must provide the Company with a list of their tools. Employees' damaged or broken tools must be reported to the supervisor and arrangements are made for replacement. The same policy applies to tools lost by fire or theft. However, there may be some delay in the replacement as we must investigate the circumstances.
10:05 The Company agrees that it will furnish on loan, all mandatory safety equipment and personal safety apparel save and except safety boots. The Company further agrees to sell to employees safety boots at ninety–five dollars ($95.00) below invoice price to the Company. The wearing of safety equipment and apparel will not become a condition of employment unless it has been agreed to by the Company and the Union or is mandatory under Government legislation. The Company will provide quality work gloves for all employees.
10:06 With a mill-wide compulsory safety eyeglass policy, the company, will provide all safety glasses, including industrial prescription safety glasses.
10:07 The Company agrees to supply on loan, raincoats and oilers aprons, however, this shall not apply to normal personal items, such as shoes, pants, etc.
10:08 The Company and the Union agree that Labour Management Consultation Meetings could be permitted held on a monthly basis, unless circumstances arise that would necessitate immediate meetings or discussions on matters involved. The purpose of these meetings will be to work on unsafe scaffoldsdiscuss with the Union ways and means of improving conditions for all employees covered by this Agreement, with unsafe equipment, where proper safeguards are not provided, under conditions which are unsafe, or injurious the interpretation of this Agreement and to healthprovide information and discuss issues related to the Company operations. A. The Employer shall provide a clean lunch and rest room that:
(1) does not have a door opening directly into a toilet facility;
(2) is separate from any place where there is the possibility of food being contaminated by a dangerous substance; and
(3) is not used for any purpose that is incompatible with its use as a lunchroom;
B. The Employer shall provide a clean lunch and restroom that is adequately provided with:
(1) light, heat and ventilation;
(2) hand cleansing and drying facilities in close proximity;
(3) sufficient tables and seating facilities for the use of the employees;
(4) suitable covered receptacles for the disposal of food; and
(5) is kept in a sanitary condition.
13:06 The Employer shall provide, where necessary, rain coats, rubber boots, safety helmets, eye and ear protection for use of all employees, such equipment to be under the care of the employee and shall be returned in good condition, save normal wear and tear, on termination of employment and/or at the Employers request.
13:07 The Employer shall supply all power tools, miter boxes and staplers if required on the job site.
13:08 An employee injured while performing his work for the Employer shall suffer no loss of earnings for the hours he would have worked but were necessarily lost on the day that the accident occurred, if on medical advice, he is sent home or to the hospital or for medical aid.
13:09 The Employer shall supply proper and sufficient power tools and accessories as well as adequate power supply to productively and safely perform the required tasks by carpenters.
13:10 Skill saws and drills when required shall be provided within a reasonable time for employeesby the Employer at the rate of one

9.03 Essential protective clothing including welder’s gloves, protective vests or leather jackets, noise abatement devices, and rainwear shall be supplied at no charge to be determined the employee. In the event that an employee does not return the foregoing items supplied to him by the com- panyEmployer, the Employer shall charge the cost of same to the employee and deduct this cost from any money owing to the employee.
Section 15.109.04 Chemical or flush toilets shall be provided from the commencement of work on all jobs. If site conditions allowWhere the sewer or chemical toilets are not available, adequate sanitary toilet facilities shall be provided as called for in local sanitary regulations. Toilet houses shall be painted, at least on the inside, and cleaned out daily. Toilet paper will be provided.
9.05 Where there is no running tap water available, drinking water in approved sanitary containers shall be provided. Paper cups will be supplied. Salt tablets shall be supplied during the summer months.
9.06 If requested by the Union or employee, the Employer will provide within three (3) calendar days, a reasonable termination slip which shall state the reason for the employee’s termination and whether or not he is eligible for rehire.
9.07 Adequate time will be allowed prior to quitting time for employeespicking up tools.
9.08 A lock-up shall be provided for employees for drying clothes, and dressing room, as well as lunch room. The lock-up shall have tables, and benches with provision for drying clothes. Such lock-up shall have windows and venting with adequate lighting and provision for continuous heat twenty-four (24) hours a day. The Employer shall be responsible for having the lock-up cleaned out daily and kept cleared of building material and other construction paraphernalia. Additional shelters shall be provided for employees to eat their lunch as may be required.
9.09 In case of fire or burglary on property or premises provided by the Employer, the Employer shall protect the value of an employee’s work clothes up to a total of three hundred and fifty dollars ($350.00). The Employer shall also provide fire and burglary insurance for the employees required tools to a total value of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory his rights to submit a claim shall be waived.
(a) All mechanics, welders, servicemen, tire servicemen, drill doctors, steel sharpeners, bodymen painters, and mechanics and welder apprentices who request coveralls shall have these supplied and cleaned by the Employer. There shall be one change a week available in the employee’s proper size. Employees are expected to take reasonable care of coveralls supplied. In the event that an employee does not return the coveralls supplied to him by the Employer, the Employer shall charge the cost of same to the employee and deduct this cost from any monies owing to the employee. When requested, coveralls shall be supplied on a temporary basis to employees who assist on work as described above, or where the Employer and the Union mutually agree that coveralls are required.
(b) Employees entitled to receive coveralls as provided herein may obtain an additional change of coveralls in any one week providing the condition of the coveralls requires a change. The shop xxxxxxx shall use discretion in authorizing the additional change.
(c) All shops shall provide adequate clean-up facilities.
9.11 The Employer shall pay the cost of obtaining operators’ licences other than those required under the Motor Vehicles Act for employees covered by this Agreement.
9.12 No employee will be permitted to use his own motor vehicle in a manner which is unfair to other members or against the best interest of the Union.
9.13 Each employee being terminated will be given one (1) hour’s notice of termination by the Employer or one (1) hour’s pay allowed in lieu thereof. Heavy duty mechanics and apprentice mechanics may utilize this hour to gather together their tools and put them in shape for their next job.
9.14 When a mechanic leaves the employ of the Employer, the Employer shall be required to pay cost of shipping mechanic’s tools. Tools shall be shipped within forty-eight (48) hours of his leaving his employment, subject to the same conditions as govern transportation. When an Operating Engineer elects to transport his own tools to and from the jobsite, the employee shall be paid the rate of two dollars and seventy-five cents ($2.75) per one hundred (100) pounds per one hundred (100) miles. (e.g. $2.75 x 528 pounds x 273 miles = $39.64). Where the Employer fails to comply with the above, the employee shall be deemed to be still on the payroll of the Employer and shall receive his usual wages and all other conditions of this Agreement until there is compliance with these provisions.
9.15 Where an employee is involved in an accident while on the job and as a result is unable to perform his work, he shall receive a full day’s pay for the day of the accident.
9.16 The Employer shall allow time off work without pay for any man who is serving on a Union Committee, or for purpose of serving as a Union delegate to any conference or function provided that this can be done without cost to the Employer. Any employee who acts within the scope of the above paragraph shall not lose his job, or be discriminated against for so acting.

The Employer shall provide lunchroom facilities complete with heat and light, separate from any tool and storage facilities.
15.04 Employees who work beyond ten (10) hours shall be entitled to a meal after ten (10) hours worked and every four (4) hours worked thereafter. If more than one (1) meal occurs in the period worked by the employee and the work is expected to continue, the Employer, where possible, shall provide the additional meal at no expense to the employee. The employee shall be considered working during the time spent consuming the meal. Where mutually agreed between the employee and Employer, fifteen dollars ($15.00) non-taxable (added to net pay) may be paid in lieu of these breaks each meal.
(a) The Employer shall supply and replace protective clothing, essential to the protection of employees and their regular work clothes from circumstances such as caustic chemicals, oil spills etc.
(i. e. slickers, gloves, hip boots, coveralls, welders leather gloves, vests or leather jackets), at no cost to the employees. The employees shall contact their immediate supervisor to advise of the item in need of replacement and return the items to be determined replaced.
(b) The Employer shall supply and replace rubber boots, that are insulated, oil and acid resistant, steel toed and steel shanked, to employees, at no cost to the employees. The employees contact their immediate supervisor to advise of the item in need of replacement and return the items to be replaced.
(c) The Employer shall ensure that four (4) pair of coveralls are available, per regular employee. The employees shall contact their immediate supervisor to advise of the item in need of replacement and return the items to be replaced. The Employer shall have coveralls repaired and laundered, at no cost to the employees. The Employer shall provide clean coveralls for casual or temporary employees.
15.06 The Employer will provide a termination slip within three (3) calendar days, if requested by the com- panyUnion or the employee, which shall state the reason for the employee's termination, and whether or not he is eligible for rehire.
Section 15.1015.07 One (1) hour's notice of termination shall be given by the Employer. This hour shall be used by the employee to gather his belongings together and to turn in any tools or goods belonging to the Employer. If site conditions allow, adequate such notice is not given then one (1) hour at straight time shall be paid in lieu thereof.

15.10 In case of fire, burglary or marine wreck (as defined by the Insurance Act) on property or premises provided by the Employer, the Employer shall protect the value of an employee's work clothes up to a total of three hundred and fifty dollars ($350.00) The Employer shall also provide insurance for the employees' required tools to a total of the tools, tool for tool, make for make, provided an inventory of tools and clothing is filed with the Employer. The Employer shall supply the required forms and obtain the inventory from each employee. The employee shall receive a signed copy of the inventory from the Employer. Coverage will commence at the date of the filing of the inventory with the Employer. Where an employee fails to file an inventory his rights to submit a claim shall be waived.
15.11 Hard hats, suspensions for hard hats, welders’ gloves and welders’ goggle will be provided by the Employer where necessary. The employees shall contact their immediate supervisor to advise of the need for replacement and return the items to be replaced. The Employer agrees to the replacement of glass and other reasonable time repairs to welding helmets for employeesdamage occurring to the employee's helmet while in the employ of the Employer. Employees shall receive one hundred twenty five ($125.00) per year as a Safety Boot Allowance, payable upon completion of two hundred (200) hours worked per year.

WORKING CONDITIONS. Section 15.11. Reasonable space shall be provided on Company bulletin boards in all departments covered by this Agreement, for the use of the Union in posting bulletins and notices for the attention of its members. Such posting will be confined to notices of Union meetings, results of elections and similar noncontroversial subjects.
a) The parties hereto agree to comply in all respects with the safety rules, regulations, and practices prescribed by the Company. At a minimum, the Company’s safety practices will be in compliance with OSHA regulations. Failure to abide by such safety rules, regulations and practices shall be grounds for discipline both by the Company and the Union.
b) It is agreed that in the first bi-weekly paycheck following May 1 of each year, the Company will provide an allowance of $150.00 to each employee. This allowance will be in lieu of payment by the Company to an employee for personal protective equipment such as safety shoes and prescription safety glasses, license renewals and any government-mandated physical examinations. The contractor Company shall continue to provide, at its cost, hard hats, rubber gloves, protectors, overshoes, non-prescription safety glasses, and work gloves, as well as any other personal protective equipment that an employer is required to provide, at its cost, to its employees under applicable OSHA regulations.
c) Effective May 1, 2006, for designated employees of the Illuminating Company, the Company will provide an allowance of $1250 to each employee to be used by April 30, 2011 for the purchase of flame retardant clothing. The account shall be drawn on as the employee deems necessary and may be carried forward for the term of the agreement if not exhausted. Any employee who enters a classification requiring flame retardant clothing in a year, in which no money is credited to the account, shall receive an amount of $250 to purchase flame retardant clothing and $250 for any subsequent year of the agreement. The Company will advise the Union of its action upon any submitted safety recommendations. For the purposes of this section, the Company will recognize three safety committees; one for Fossil Operations; one for Nuclear Operations; and one for Transmission and Distribution Operations. The Company will recognize and pay the Union Safety Committees Chairman and two Representatives designated in writing by the Union for each committee. Each committee shall meet three times per year at a time and place as determined by the respective committee. Additional meetings may be called by the Company or the Union. Section 15.9. Employees shall be granted two rest periods of permitted ten (10) minutes duration each day; in the first half and ten (10) minutes in the second half of a shift for a coffee break on the Project during regular working hours.
14:04 When a mechanic as a condition of employment, is required to carry a full complement of tools, he shall before starting work for the Employer, submit an inventory of tools which will be checked by the management. Upon acceptance, the Employer shall insure those tools and toolbox at the agreed value against fire and/or theft of the complete unit of tools while on the Employer's premises. The Employer shall be responsible for the repair of tools damaged on the job or replace them with tools of equal value. The Employer responsibility for the previous sentence shall apply only in the case of employees who have been emplo yed for a period of one prior year or longer.

14:07 The Employer shall supply a clothes locker, gloves, wristlets, regular and quilted winter coveralls and laundering of same to lunch period those employees employed in the servicing and one between lunch period repair of equipment. The gloves shall remain the property of the Employer and end of will be replaced without charge when worn out gloves are presented for exchange. Regular time Any employee who is laid off, discharged or quits and who has been supplied gloves or coveralls which have not been returned, shall have the cost of these breaks to be determined by items deducted from their last pay cheque, provided the com- panyemployee was assigned a lockable clothes locker. The Employer shall implement a sign-in/sign-out system for monitoring coveralls and gloves.

WORKING CONDITIONS. Section 15.1.
