Work Conditions. The Contractor agrees to accept sole responsibility to comply with all federal, provincial and municipal legislation which may have application to the Work and agrees to comply with all provincial and federal legislation affecting conditions of work and wage rates including the Employment Standards Act R.S.P.E.I. 1988, Cap. E-6.2, the Workers Compensation Act R.S.P.E.I. 1988, Cap. W-7.1, or any other laws that impose obligations in the nature of employers’ obligations. Work Conditions. The requirements of 40 U.S.C. 3704 are applicable to construction work. No laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.
Work Conditions. 17.01 The Producer and the Technicians shall work together to assure work conditions are safe and compliance by them with any safety rules contained herein or established by the Producer.
Work Conditions. Bargaining unit members shall not be required to work under unsafe or hazardous conditions or to perform tasks which endanger their health, safety, or well-being. With exception of bus drivers and custodians whose jobs regularly require outdoor work, no bargaining unit member shall be required to work out-of-doors when the wind chill factor reaches 15 degrees F or lower. Bargaining unit members shall not be required to remain at work when the temperature of the work place is less than 60 degrees F or greater than 100 degrees F. No bargaining unit member shall be required to enter a building alone or to be left alone in a building unless it is a part of his/her assignment, i.e.-stationary engineer with boiler start up. The Employer shall provide adequate rest areas, lounges and restrooms for bargaining unit members' use.
Work Conditions. 4.20.1. The Work of this Contract shall be performed on a unit basis when so ordered by the Director. At the award of the Contract and during the life of the Contract, the Contractor will be issued street lighting plans or orders showing the exact locations of the various items of Work and a time for completion (1st Quarter, 2nd Quarter, etc.). In addition, the City of New York – Division of Street Light Specification, indicating methods of installation, will be available on request.
Work Conditions. The Board agrees to maintain safe working conditions. This includes the rules and regulations as established by the Administrator of Workers’ Compensation, with the advice and consent of the Workers’ Compensation Oversight Commission. In the event a situation is thought to be unsafe, the employee shall notify his/her supervisor or the Superintendent immediately. A review of the situation and possible solutions, if appropriate, will be made on an expedited basis. Should the situation pose an immediate or severe health hazard, beyond the customary employment activities and duties, as corroborated by another adult supervisor or employee, the employee may decline to continue to perform the work and shall be temporarily assigned to an alternate location or duty. Each employee has the responsibility to follow all work rules. No employee shall remove, displace, damage, destroy or carry off any safety device or safeguard. No employee shall interfere with the use of adopted protection procedures for employees or the place of employment or fail to follow and obey orders and do every reasonable thing necessary to protect the life, health, safety and welfare of themselves and other employees.
Work Conditions. The City shall take no action which unjustly and arbitrarily has an adverse effect on rights, privileges, and working conditions enjoyed by the employees at the present time. The public safety dispatchers shall be notified 30 days prior to any permanent change in job status and/or job location.
Work Conditions. Contractor represents that it has received and has had an opportunity to examine copies of the Invitation To Bid and other descriptive data and has fully acquainted itself with all the conditions relevant to the work to be performed, and the site of the work, and assumes the risk of any variances between the actual conditions relevant to the work and the same as shown or represented in the invitation to bid document; that it has made all investigations essential to a full understanding of the difficulties which may be encountered in performing the work, and bases its conclusions to execute this Contract on such investigation, independent of any other information prepared or furnished by the City or others; and Contractor will satisfactorily complete the work in accordance with the provisions of this Contract, and will assume full and complete responsibility for such conditions relevant to the work, the site of the work, and all risks in connection therewith.
Work Conditions. If Seller’s work is dependent upon or must be undertaken in conjunction with the work of others, such work shall be so performed and completed as to permit Seller to perform its work in a normal uninterrupted single shift operation. Unless a time for the performance of Seller’s work is specified, Seller shall undertake the work in the course of its normal operating schedule. Seller shall not be liable for any failure to undertake or complete the work for causes beyond its control, and Seller may suspend the work for causes beyond its control, including but not limited to fire, flood or other casualty; the presence on or beneath the work site of utilities, facilities, substances, or objects, including but not limited to any substance that in Seller’s opinion is hazardous or toxic or the reporting, remediation, or clean-up of which is required by any law or regulation; labor disputes or other disagreements; and accidents or other mishaps, whether affecting this work or other operations in which Seller is involved, directly or indirectly. If for causes beyond Seller’s control, Xxxxxx’s work is not completed within twelve (12) months after the date of Xxxxx’s acceptance of the Contract, Seller may cancel this Contract. In such event: (i) Seller shall be relieved of any further obligation with respect to the balance of the work; and (ii) Seller shall be entitled to receive final and complete payment for all work performed by us to the date of cancellation within fifteen (15) days thereafter.
