WORKPLACE SAFETY INSURANCE BOARD. (a) A Nurse who is injured while at work and as a result of such injury is certified by a medical doctor as unfit to complete the working day, shall receive pay at the regular rate for time lost on the day that such injury is sustained and no deduction will be made from sick leave credits with respect to that particular working day. (b) Where a Nurse is absent from work as a result of an illness or injury compensable under the Workplace Safety and Insurance Act, she/he shall (providing sufficient sick leave credits are accumulated) during the first one hundred and four (104) weeks, have her/his WSIB payment augmented by an amount sufficient to ensure that the payment received from the Employer and the WSIB Benefit is equivalent to the regular daily earnings of the Nurse immediately prior to the illness or injury. The amount provided by the Employer (usually one-quarter) shall be charged to the Nurse's accumulated sick leave. (c) The regular Nurse will receive the WSIB cheque directly. The Employer will pay the amount required to continue regular earnings (usually one- quarter of the daily earnings) on a biweekly basis. Income tax, C.P.P. and E.I. will be deducted from the amount paid by the Employer. (d) The Nurse will be required to complete an OMERS "Disability Elimination Election Form". If she/he elects not to contribute to OMERS during the first seventeen (17) weeks she/he is on WSIB Benefits, the absence becomes a period of broken service, which cannot be purchased as broken service. If the Nurse elects to contribute to OMERS during the disability elimination period (first seventeen [17] weeks) and accrue credited service, she/he shall pay the OMERS amount calculated on her/his regular biweekly pay to the Employer on a biweekly basis and the Employer will match the Nurse's contribution. (e) In the event the sick leave credits are insufficient to carry the Nurse to the seven hundred and twenty-eighth (728th) day of disability (104 weeks), the Nurse shall receive the actual amount paid by the WSIB.

An employee's absence during which she receives Worker’s Safety and Insurance Board shall be considered as time worked only for the purpose of calculating vacation entitlement provided the employee returns to work within twenty-four (24) months after the injury or illness occurred. d. If the anticipated length of an absence due to a compensable accident is four (4) weeks she/he is on WSIB Benefitsor more, the absence becomes Employer will post notice of the vacancy in accordance with the job-posting procedure in this Agreement. An injured employee shall have a period of broken servicetwenty-four (24) months within which she shall retain seniority; within these twenty-four (24) months she shall have the right to return to work, which cannot be purchased as broken service. WORKPLACE SAFETY INSURANCE BOARD. ‌ 35.01 Where an Employee is absent due to illness or injury which is compensable by Workplace Safety & Insurance Board (hereinafter shown as WSIB), the following shall apply: (a) A Nurse The Employer shall continue to pay its share of premiums for benefit plans for Employees who are on WSIB. (c) Provided that the employee returns to work within fifty-two (52) consecutive weeks of the date of illness or injury, time spent on WSIB shall be considered as time worked for the purpose of calculating the current year's vacation entitlement under the terms of the Agreement. 35.02 In case of an absence due to a compensable accident, the Employee will be paid at her regular rate of pay for all scheduled hours on the day of the accident. 35.03 In case of an absence due to a compensable accident, where the anticipated length of such absence is thirty (30) days or more, the Employer will post notice of the vacancy in accordance with the temporary vacancies job posting procedure of this Agreement. Where the anticipated absence is less than thirty (30) days, the Employer may fill the position at his discretion. 35.04 The injured Employee shall have a Nurse period of two (2) years from the date of the injury within which she shall preserve the seniority which she has accrued in accordance with Article 14 and within which she shall have the right to return to work upon the recommendation of the WSIB or the attending physician, which shall indicate to the Employer that the Employee has the physical capability to perform her normal job. 35.05 If a full-time Employee returns to work within fifty-two (52) weeks following the commencement of a WSIB claim or illness, and the Employee's former permanent position still exists, the Employee will be returned to her former job, former shift if designated, classification and rate of pay. All Employees who fill vacancies as a result of the above absences shall likewise be returned to their former permanent positions. 35.06 If an Employee returns to work after fifty-two (52) weeks following the commencement of the WSIB claim but prior to two (2) full year mentioned in Article 35.04 above, she shall be returned to her former job, or to work of a comparable nature at the same salary level and without loss of seniority or benefits accrued in accordance with Article 14. (This would be effected by the returning Employee displacing the employee with the least seniority in the category to which she is returning). 35.07 If, on the recommendation of the WSIB or the employee’s physician, the employee is capable only of performing work of a lighter nature the Employer and the Union will review all work currently within the bargaining unit as well as work contracted out with the view of placing an injured, ill, employee where possible. 35.08 In the event that the Employer challenges WSIB claim, an Employee who is absent from work as a result of an illness or injury compensable under the Workplace Safety sustained at work and Insurance Actwho has been awaiting approval of a claim for WSIB for period longer than one complete pay period, she/he shall (providing sufficient sick leave credits are accumulated) during the first one hundred and four (104) weeks, have her/his WSIB payment augmented by an amount sufficient may apply to ensure that the payment received from the Employer and the WSIB Benefit is for payment equivalent to the regular daily earnings lesser of the Nurse immediately prior benefit she would receive from WSIB if her claim was approved, or the benefit to which she would be entitled under the sick leave plan, Article 35.
