DIRITTO APPLICABILE a) Trova applicazione il diritto della Repubblica Federale Tedesca. Resta esclusa la Convenzione ONU sui contratti per la vendita internazionale di beni mobili (CISG).
b) Precedentemente o contestualmente all’avvio di un procedimento legale contro il cliente nel paese di quest’ultimo DKV ha la facoltà, comunicandolo sotto forma di testo o nel testo di citazione, di scegliere il diritto materiale estero applicabile per il Foro competente del cliente previsto dalla legge o concordato (scelta a posteriori del diritto applicabile a favore del paese del cliente). Detta scelta a posteriori a favore del diritto del paese del cliente non sarà efficace qualora il cliente, entro un mese dall’averne preso conoscenza vi si opponga. In tal senso si rimanda il cliente all’esercizio della scelta del diritto a posteriori.
DIRITTO APPLICABILE. Il rapporto giuridico tra ditta e il titolare con la società emit- tente è soggetto al diritto svizzero. Luogo di adempimento esclusivo, foro giudiziario nonché – per ditte e titolari con sede o domicilio all’estero – foro di esecuzione è Zurigo.
