Accountholder’s Warranties. I make the following warranties and representations with respect to each image of an original check I transmit to you utilizing the Services:
Accountholder’s Warranties. You will comply with all applicable rules, laws and regulations. Each time you submit check images for deposit through Mobile Check Deposit, you also make all the warranties set forth in and subject to the terms of the Utah Uniform Commercial Code ("UCC ") for the image as if it were an item subject to the terms of the UCC. You make the following warranties and representations with respect to each image of an original check you transmit to you using Mobile Check Deposit:
Accountholder’s Warranties. You make the following warranties and representations with respect to your use of Mobile Deposit Services and each image of an original check you transmit to us using Mobile Deposit Services: (a) Each image of a check transmitted to us is a true and accurate rendition of the front and back of the original check, without any alteration, and the drawer of the check has no defense against payment of the check; (b) the amount, the payee, signature(s), and endorsement(s) on the original check are legible, genuine, and accurate; (c) each check that you submit to us for deposit will not be resubmitted in any format to us or to any other person or the original of it negotiated or presented for payment to any financial institution for payment resulting in the same drawer’s account to be debited twice; (d) other than the digital image of an original check that you remotely deposit through Mobile Deposit Services, you did not permit other or duplicate images of the original check to be deposited or put through for collection; (e) each original check was authorized by the drawer in the amount stated on the original check and to the payee stated on the original check, (f) the information you provided to us is true and correct and, in the event such information changes, you will notify us immediately of the change; (g) you have not knowingly failed to communicate any material information to us; (h) you will retain possession of each original check deposited using Mobile Deposit Services for the required (60) sixty day retention period and neither you nor any other party will resubmit the original check for payment; (i) you will not use the Mobile Banking Services for any illegal activity or transactions; (j) files and images transmitted to us will contain no viruses or any other disabling features that may have an adverse impact on our network, date or related systems; and (k) each check you submit for deposit is drawn in United States dollars on a financial institution located within the United States, excluding its territories.

You make the following warranties and representations with respect to your use of the RDC service every time you transmit an item for deposit. • Each image of a check transmitted to us is a true and accurate rendition of the front and back of the original check, without any alteration other than proper endorsement, and the payor of the check has no defense against payment of the check. • The amount, the payee, signature(s), and endorsement(s) on the original check are legible, genuine, and accurate. • Each check that you submit to us for deposit will not be resubmitted in any format to us or to any other entity for payment. • There are no other duplicate images of the original check, other than the digital image of an original check that you remotely deposit through the service. • Each original check was authorized by the payor in the amount stated on the original check and to the payee stated on the original check. • You have not knowingly failed to communicate any material information to us. • You will retain possession of each original check deposited using the service for the required retention period and neither you nor any other party will submit the original check for payment. • You will not use the service or your accounts for any illegal activity or transactions. • Files and images transmitted to us will contain no viruses or any other disabling features that may have an adverse impact on the OCCU network, data, or computer systems.

The amount, the Payee, date, signature(s) and endorsement(s) on the original check are legible, genuine and accurate. • You have possession of each original check deposited using Remote Deposit and no party will submit the original check for payment. • You will not deposit or otherwise endorse the original item (the original check) to a third party, and no person will receive a transfer, presentment or return of, or otherwise be charged for, the item (either the original item, or a paper or electronic representation of the original item) such that the person will be asked to make payment based on an item it has already paid. • Other than the digital image of an original check that You remotely deposit through Remote Deposit, there are no other duplicate images of the original check. • You have instituted procedures to ensure that each original check was authorized by the drawer in the amount stated on the original check and to the Payee stated on the original check. • You are authorized to enforce each item transmitted or are authorized to obtain payment of each item on behalf of a person entitled to enforce such transmitted item. • The information You provided at account opening and thereafter remains true and correct, and in the event any such information changes, You will immediately notify Us of the change. • You will not use Remote Deposit for fraudulent, illegal, or immoral activities. • You have not knowingly failed to communicate any material information to Us. Your failure to comply with any or all of the terms contained herein may result in Us cancelling Your Remote Deposit access.
Accountholder’s Warranties. You agree to scan and deposit only checks as that term is defined in Federal Reserve Regulation CC (“Reg CC”). You agree that the image of the check transmitted to WFTFCU shall be deemed an “item” with the meaning of Article 4 of the Uniform Commercial Code as adopted in Texas. You agree that you will use the Services to scan and deposit any checks or other items as described below:

I must securely store each original check. If I am using the Service to deposit items into an account in the name of a Business to which I am a party I understand this means the original check(s) must be accessible only [under dual control] by my authorized personnel, that I deposit using the Services for a period of 7 days after transmission to you. Persons who have access to the stored checks must be fully bondable and have passed a thorough screening. After such period expires, I will destroy the original check.
