Active Facility means a Facility providing Flexibility Services at any given time as declared by the Provider in the Performance Report;

Active Facility means a Facility that has planted, cultivated and harvested at least one or more marijuana crops, in a total quantity equal to or greater (cumulatively) than twenty five percent (25%) of the maximum number of plants allowed under the State MED license, at least once during the prior licensing period. An “Inactive Facility” is one that is NOT an Active Facility during the prior licensing period.

Active Facility or “active electric utilities” or “independent power producers” means “any facility subject to the requirements of this subpart that is in operation on October 19, 2015.
