Bereavement Leave With Pay. For the purpose of this Article, immediate family is defined as father, mother (or alternatively stepfather, stepmother, or xxxxxx parent), brother, sister, spouse, child, (including spouse’s child), stepchild or xxxx of the employee, grandparent, grandchild, father-in-law, mother-in-law, and relative permanently residing in the employee's household or with whom the employee permanently resides.
(a) When a member of the employee's immediate family dies, an employee shall be entitled to a bereavement period of four (4) consecutive calendar days including the day of the funeral. During such period the employee shall be paid for those days which are not regularly scheduled days of rest for the employee. When circumstances dictate, the period may be split into three consecutive calendar days and a fourth day deferred to a later date to allow an employee to attend an internment service. In addition, the employee may be granted up to three (3) days' leave with pay for the purpose of travel related to the death.
(b) An employee is entitled to one (l) day's bereavement leave with pay for the purpose related to the death of his or her son-in-law, daughter-in-law, brother-in-law or sister-in-law.
(c) If, during a period of vacation leave, an employee is bereaved in circumstances under which he or she would have been eligible for bereavement leave with pay under paragraph (a) or (b) of this clause, the employee shall be granted bereavement leave with pay and his or her leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
(d) In the event that an employee’s religious beliefs or individual circumstances require observance at times other than immediately before or after the funeral, NAV CANADA may postpone the period of time (or any part of) provided for in this Article to such alternate time(s).
(e) It is recognized by the parties that the circumstances which call for leave in respect of bereavement are based on individual circumstances. On request, NAV CANADA may, after considering the particular circumstances involved, grant leave with pay for a period greater than that provided for in clause 29.02 (a) and (b).
Bereavement Leave With Pay. For the purpose of this clause, immediate family is defined as father, mother, brother, sister, spouse, child, xxxx of the employee, father-in-law, mother-in-law and relative permanently residing in the employee's household or with whom the employee permanently resides.
Bereavement Leave With Pay. For the purpose of this clause, immediate family is defined as father, mother (or alternatively stepfather, stepmother, stepchild, or xxxxxx parent), grand- parent, brother, sister, step-brother, step-sister, spouse (including common- law spouse), child (including child of common-law spouse), xxxx, xxxxxx child, grandchild, father- in-law, mother-in-law, son-in-law, daughter-in-law and relative permanently residing in the employee’s household or with whom the employee permanently resides or for whom the employee has legal responsibility.
a) When a member of his/her immediate family dies, an employee shall be entitled to a bereavement period of five (5) consecutive working days which must include the day of the funeral or memorial. During such period he/she shall be paid for those days which are not regularly scheduled days of rest for that employee. In addition, the employee may be granted up to two (2) days’ leave with pay for the purpose of travel related to the death.
b) In special circumstances and at the request of the employee, the five (5) day bereavement period may be moved beyond the day following the day of the funeral but must include the day of the funeral.
c) An employee is entitled to one (1) day’s bereavement leave with pay for the purpose related to the death of his/her brother-in-law, sister-in-law or spouse’s grand-parent.
d) If, during a period of compensatory leave, sick leave or vacation leave, an employee is bereaved in circumstances under which he would have been eligible for bereavement leave with pay under a), b) or c) of this clause, he/she shall be granted bereavement leave with pay and his/her leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
e) It is recognized by the parties that the circumstances which call for leave in respect of bereavement are based on individual circumstances. On request, the Employer may, after considering the particular circumstances involved, grant leave with pay for a period greater than and/or different from that provided for in clause 19.02 a) and c).
f) An employee may request annual leave, compensatory leave, personal leave or leave without pay to attend the funeral or memorial service of a person who does not meet the definition of “immediate family” set out in paragraph (a) or who is not mentioned in paragraph (c) of this Article. Such a request shall not be unreasonably denied.
Bereavement Leave With Pay. For the purpose of this clause, immediate family is defined as father, mother (or alternatively stepfather, stepmother, or xxxxxx parent), grandparent, brother, sister, spouse, child, grandchild, stepchild or xxxx of the employee, father-in-law, mother-in-law, step-relative and relative permanently residing in the employee's household or with whom the employee permanently resides.
(a) When a member of the employee's immediate family dies, an employee shall be entitled to a bereavement period of five (5) consecutive calendar days including the day of the funeral. During such period the employee shall be paid for those days which are not regularly scheduled days of rest for the employee. When circumstances dictate, the period may be split into four (4) consecutive calendar days and a fifth day deferred to a later date to allow an employee to attend an interment service. In addition, the employee may be granted up to three (3) days' leave with pay for the purpose of travel related to the death.
(b) An employee is entitled to one (l) day's bereavement leave with pay to attend the funeral or interment service related to the death of his or her son-in-law, daughter-in-law, brother-in-law sister-in-law, aunt or uncle.
(c) If, during a period of paid leave, an employee is bereaved in circumstances under which he or she would have been eligible for bereavement leave with pay under paragraph (a), or (b) of this clause, the employee shall be granted bereavement leave with pay and his or her compensatory leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
(d) In the event that an employee’s religious beliefs or individual circumstances require observance at times other than immediately before or after the funeral, NAV CANADA may postpone the period of time provided for in this Article (or any part of) to such alternate time(s).
Bereavement Leave With Pay. For the purpose of this clause, the definition of immediate family will include the relatives of a common law spouse in the same manner as would be applied to the relatives of a spouse. For the purpose of this clause, immediate family is defined as father, mother (or alternatively stepfather, stepmother or xxxxxx parent), brother, sister, spouse, child, stepchild, child adopted through Aboriginal custom adoption practices, or xxxx of the employee, father-in-law, mother-in-law, grandparents, employee’s grandchild, and other relatives permanently residing in the employee's household or with whom the employee permanently resides, and also includes anyone for whom the employee holds a legally executed “Power of Attorney”.
a) When a member of the employee's immediate family dies, the employee shall be entitled to bereavement leave with pay for a period of five (5) days for purposes relating to the bereavement and may, in addition, be granted up to three (3) days’ leave with pay for the purposes of travel related to the death.
b) In special circumstances and at the request of the employee, bereavement leave with pay may be extended beyond the day following the day of the funeral but the total number of days granted shall be consecutive, shall not exceed the number provided for in paragraph (a) above, and must include the day of the funeral.
c) An employee is entitled to two (2) days' bereavement leave with pay for the purpose related to the death of his/her son- in-law, daughter-in-law.
d) An employee is entitled to one (1) days' bereavement leave with pay for purposes relating to the death of her brother-in- law or sister-in-law, aunt, uncle, niece or nephew.
e) If, during a period of compensatory leave, an employee is bereaved in circumstances under which she would have been eligible for bereavement leave with pay under paragraph (a), (b), (c), or (d) of this clause, she shall be granted bereavement leave with pay and her compensatory leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
Bereavement Leave With Pay. 51.01 When a member of the employee's family dies, an employee shall be entitled to a bereavement leave with pay.period of seven (7) consecutive calendar days. Such bereavement period leave, as determined by the employee, must include the day of the memorial commemorating the deceased, or must begin within two (2) days following the death. During such period the employee shall be paid for those days which are not regularly scheduled days of rest for the employee. In addition, the employee may be granted up to three (3) days' leave with pay for the purpose of travel related to the death.
(a) At the request of the employee, such bereavement leave with pay may be taken in a single period of seven (7) consecutive calendar days or may be taken in two (2) periods to a maximum of five (5) working days.
(b) When requested to be taken in two (2) periods:
i. The first period must include the day of the memorial commemorating the deceased or must begin within two (2) days following the death; and
ii. The second period must be taken no later than twelve (12) months from the date of death for the purpose of attending a ceremony.
iii. The employee may be granted no more than three (3) days’ leave with pay, in total, for the purposes of travel for these two (2) periods.
51.02 An employee is entitled to one (1) day's bereavement leave with pay for the purpose related to the death of his or her son-in-law, daughter-in-law, brother-in-law, or sister-in-law or grandparents of spouse.
51.03 If, during a period of paid sick leave, vacation leave or compensatory leave, an employee is bereaved in circumstances under which he or she would have been eligible for bereavement leave with pay under clauses 50.01 and 51.02, the employee shall be granted bereavement leave with pay and his or her paid leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
Bereavement Leave With Pay.
D5.01 For the purpose of this article, "immediate family" is defined as father, mother (or alternatively stepfather, stepmother or xxxxxx parent), brother, sister, spouse (including common-law spouse resident with the employee), child (including child of common-law spouse), stepchild or xxxx of the employee, grandparent, grandchild, father-in-law, mother- in-law, son-in-law, daughter-in-law, brother-in-law, sister-in-law, and any relative permanently residing in the employee’s household or with whom the employee permanently resides.
D5.02 Upon the death of a member of the employee’s immediate family, an employee:
a) Shall be entitled to bereavement leave of up to seven consecutive calendar days with pay; and
b) Where travel related to the death is required, an additional period of leave of up to three consecutive calendar days with pay.
D5.03 During periods of bereavement leave with pay, employees shall be paid for those days on which they were scheduled to work but did not work because of such bereavement leave.
D5.04 The period of bereavement leave with pay, as defined in paragraph D5.02, may be split and taken in the following two periods:
a) The first period immediately following the death, and
b) The second period within 13 months from the date of death for the purpose of commemorating the deceased in accordance with bona-fide religious beliefs or attending a traditional ceremony.
Bereavement Leave With Pay. 22.01 Full-time employees shall be granted leave of absence without loss of pay, for scheduled hours of bereavement leave as follows:
(a) five (5) days – husband, wife, children, parents, brother, sister, parents-in-law, grandparents, grandchildren; step-parents, step- children, common-law spouse as defined by law.
(b) three (3) days - brother-in-law, sister-in-law, son-in-law, and daughter- in-law.
(c) one (1) day - grandparents-in-law, aunt, uncle, niece, nephew
Bereavement Leave With Pay. “Day” for bereavement leave with pay for employees on the alternate shift pattern, shall mean twelve hours. All other conditions apply as per the collective agreement.
Bereavement Leave With Pay. This Article applies only to employees who have completed their probationary period and is to be used for the purpose of attending the funeral. Partner is defined as a person of the opposite sex who is legally married to and living with the employee or if the employee so elects, is not living with the person at the time, or a person of the same or opposite sex who is not married to the employee but is an individual who has been co- habitating for a period of one year with the employee and who is publicly recognized as the domestic partner of the employee. In the event of the death of a parent, step-parent, grandparent, grandchild, mother-in-law, father-in-law, brother, sister, partner, child, child of current partner, step-child of an employee, or unborn child, certified by the attending physician, of the employee or the current partner, the Company will grant three (3) days leave of absence with pay. In the event of the death of a child-in-law, brother-in-law, sister-in-law, or grandparent of the current partner, the Company will grant a two (2) day leave of absence with pay. Only two (2) days leave of absence with pay will be granted where because of distance or other reason, the regular employee does not attend the funeral of the deceased relative.
16.02 An employee who would have been entitled to bereavement leave but was on vacation shall have such bereavement leave added to their vacation provided the employee notifies the appropriate Team Leader prior to the scheduled end of the employee’s vacation.
