Bereavement Leave With Pay. f) An employee may request annual leave, compensatory leave, personal leave or leave without pay to attend the funeral or memorial service of a person who does not meet the definition of “immediate family” set out in paragraph (a) or who is not mentioned in paragraph (c) of this Article. (d) If, during a period of scheduled vacation or compensatory leave, sick leave or vacation leave, an employee is bereaved in circumstances under which he would have been eligible for bereavement leave with pay under a)this Clause, b) or c) of this clause, he/she the employee shall be granted bereavement leave with pay and his/her the compensatory or vacation leave credits shall be restored to the extent of any concurrent bereavement leave with pay grantedaccordingly.

For the purpose of this clause, immediate family is defined as father, mother mother, (or alternatively stepfather, stepmother, stepchild, xxxxxx parent or xxxxxx parentformer guardian of the employee), grand- parent, brother, sister, spouse, child (or child of spouse) or xxxx of the employee, father-in-law, mother-in- law, step-brother, step-sister, spouse (including common- law spouse), child (including child of common-law spouse), xxxx, xxxxxx child, grandchild, father- in-law, mother-in-law, son-in-law, daughter-in-law and sister or a relative permanently residing in the employee’s 's household or with whom the employee permanently resides or for whom the employee has legal responsibilityresides.
(a) When a member of his/her immediate family dies, an and the employee attends the funeral, the employee shall be entitled to bereavement leave with pay for a bereavement period of five up to three (53) consecutive normally scheduled working days which must include and the period of such leave shall encompass the day of the funeral or memorial. During such period he/she shall be paid for those days which are not regularly scheduled days of rest for that employeefuneral. In addition, when necessary, the employee may be granted up to two (2) days’ leave with pay for the purpose of related travel related up to the deaththree (3) calendar days' leave with no reduction in his/her weekly rate of pay.
(b) In special circumstances and at the request of the employee, the five (5) day bereavement period may be moved beyond the day following the day of the funeral but must include the day of the funeral.
c) An employee is entitled to one (1) day’s bereavement leave with pay for up to one (1) day to attend the purpose related to the death funeral of his/her grandparent, grandchild, son-in-law, daughter- in-law, brother-in-law, sister-in-law law, or spouse’s grand-parentin the event of the death of any member of the immediate family in (a) above when the employee is not attending the funeral.
d) If, during a period of compensatory leave, sick leave or vacation leave, an employee is bereaved in circumstances under which he would have been eligible for bereavement leave with pay under a), b) or (c) of this clause, he/she shall be granted bereavement leave with pay and his/her leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted.
e) It is recognized by the parties that the circumstances which call for leave in respect of bereavement are based on individual circumstances. On request, the Employer request management may, after considering the particular circumstances involved, grant leave with pay for a period greater than and/or different from that provided for in clause 19.02 18.02 (a) and c(b).
f(d) An employee may request annual leave, compensatory leave, personal Where in respect of any period of vacation leave or a combination of vacation leave without pay to attend and lieu days, circumstances arise which necessitate bereavement leave in accordance with clause 18.02, the funeral or memorial service of a person who does not meet the definition of “immediate family” set out in paragraph (a) or who is not mentioned in paragraph (c) of this Article. On request, the Employer NAV CANADA may, after considering the particular circumstances involved, grant xxxxx leave with pay for a period greater than and/or different from that provided for in clause 19.02 29.02 (a) and c(b).
f) An employee may request annual leave, compensatory leave, personal leave or leave without pay to attend the funeral or memorial service of a person who does not meet the definition of “immediate family” set out in paragraph (a) or who is not mentioned in paragraph (c) of this Article.
