Borrower Data definition

Borrower Data has the meaning set forth in Section 6.2.
Borrower Data means all personally identifiable information, including nonpublic personal information, and all other information about a Borrower (including authorized users and co-signers, if available and permitted) or applicant (i) received by or on behalf of Seller (including by Genesis) from such Borrower or applicant in connection with such Borrower’s or applicant’s application for an Account, or (ii) otherwise obtained by or on behalf of Seller in connection with the Program, including all transaction and underwriting information collected by or on behalf of Seller with regard to each purchase charged by a Borrower.
Borrower Data means information that is provided to or obtained by a Party in the performance of its obligations under this Agreement or otherwise regarding Applicants and Borrowers, including, but not limited to name, postal address, social security number, email address, telephone number, date of birth, Account number, security codes, valid to and from dates, as well as information and demographic data, data generated and/or created in connection with Account processing and maintenance activities, Account statementing and customer service, telephone logs and records and other documents and information necessary for the processing and maintenance of Accounts, and all “Nonpublic Personal Information” and “Personally Identifiable Financial Information” (as defined in 12 C.F.R. §§ 40.3(n) and (o), respectively).

Examples of Borrower Data in a sentence

  • Certain of the Borrower Data is published in connection with an Eligible Loan, and other information, included in certain documents in the Loan Document Package, is not publicly disclosed and may constitute NPI (collectively, “Non-Public Borrower Data”).

  • Purchaser will not utilize Non-Public Borrower Data for any purpose not in connection with the transactions contemplated under this Agreement, and will not seek the identity of any Borrower or contact any Borrower for any purpose.

  • From and after the Closing, the Buyer shall not, except in connection with an acquisition of the Buyer by merger, consolidation or sale of all or substantially all of the assets of the Buyer, sell the Borrower Data or the Copyrighted Underwriting-Related Works in the form delivered to the Buyer at the Closing to any Person (other than an Affiliate of the Buyer) without the prior written consent of the Sellers.

  • Purchaser will not utilize, and will not permit any Affiliate to utilize, Non-Public Borrower Data for any purpose not in connection with the transactions contemplated under this Agreement, and will not contact any Borrower for any purpose.

  • Purchaser shall not utilize Non-Public Borrower Data for any purpose not in connection with the transactions contemplated under this Agreement, and shall not contact any Borrower for any purpose.


More Definitions of Borrower Data

Borrower Data has the meaning set forth in Section 1.2(a)(ix).
Borrower Data means information that is provided to or obtained by Bank in the Program or otherwise regarding Applicants and Borrowers, including, but not limited to name, postal address, social security number, email address, telephone number, date of birth, Account number, security codes, valid to and from dates, as well as information and demographic data, data generated and/or created in connection with Account processing and maintenance activities, Account statementing and customer service, telephone logs and records and other documents and information necessary for the processing and maintenance of Accounts, and all “Nonpublic Personal Information” and “Personally Identifiable Financial Information” (as defined in 12 C.F.R. §§ 1016.3(p) and (q).
Borrower Data means information that is provided to or obtained by a Party in the performance of its obligations under this Agreement or otherwise regarding Applicants and Borrowers, including (a) name, postal address, social security number, email address, telephone number, date of birth, as well as data generated or created in connection with customer service, telephone logs and records, and other documents and information necessary for the processing and maintenance of Loans, and (b) all Personal Information.
Borrower Data means all information whether personally identifiable or in the aggregate, that is submitted and/or received or obtained by Genesis in connection with an Account or an Application (whether or not completed and whether or not such Applicant becomes a Borrower), including credit information, financial standing, demographic data, and transaction data. “Borrower List” means the list identifying Borrowers, which will be Genesis Confidential Information.

Borrower Data collectively means, to the extent in the possession or control of Seller, any Affiliate of Seller, or any service provider of Seller or any Affiliate of Seller, as of the Cut-off Time, and in each case whether in hard copy or electronic (including image) format, (a) the files, documents and information reflected on or in the systems or files of Seller, Seller’s Affiliates, and any third party used to process or service the Borrower Accounts to the extent relating to the Acquired Assets (including Borrower Account applications, Account Agreements and modifications, amendments, supplements or other changes thereto, general credit information and records reflecting actions taken to cure any delinquency, charge transaction data and historical customer statements, including online statements (as applicable), Program privacy notices, electronic payment authorization agreements, credit bureau reports, adverse action notices, change in terms notices, and other Borrower notices or disclosures relating to the Acquired Assets); (b) the historical reflection of such files and information, in whatever medium such files and information is stored; (c) all correspondence between Seller or Seller’s Affiliates and any Borrowers in connection with the Program; (d) all customer service and collections correspondence, notes and other documentation in connection with the Program; and (e) all correspondence with any Governmental Authority related to the Borrower Accounts or the Program Agreement but only to the extent that such correspondence exclusively relates to the Borrower Accounts (and, for the avoidance of doubt, does not include information about Seller’s other accounts or programs). Borrower Data includes solely the data, files, documents and other materials and information referenced above that arise out of Seller’s or any of Seller’s or its Affiliates’ service provider’s servicing of Borrower Accounts for Comenity under the Program Agreement. Data that Seller or any of its Affiliates possess as both service provider to Comenity and in connection with the provision of the PayPal Wallet or other products or services shall be considered both Borrower Data and data retained by Seller or Seller’s Affiliates that is not subject to the requirements herein regarding Borrower Data.
