Boundary Property definition

Boundary Property means any building that is part of the Borrower’s portfolio of assets under management and that the Borrower identifies internally as under the Borrower’s operational control. For purposes of this definition, such operational control shall mean that the Borrower or any of its Controlled Subsidiaries maintains, provides service to, and/or has the authority to implement operating policies with respect to energy usage, water usage and/or waste disposal, in any such case, for all or any portion of such building. Any reference herein to the square footage of a Boundary Property shall be a reference to the proportional percentage of total square footage of such Boundary Property that is under the Borrower’s operational control with respect to such Boundary Property.
Boundary Property shall have the meaning specified in Section 4.3(a) of the Ground Lease.
Boundary Property means any building that is part of the Borrower’s portfolio of assets under management and that the Borrower identifies internally as under the Borrower’s operational control. Boundary Property means any building that is part of a Project that is under the Borrower’s operational control for sustainability matters, whether or not the Project is held by an unconsolidated entity. For purposes of this definition, operational control for sustainability matters means that the Borrower or any of its Controlled Subsidiaries maintains, provides service to, and/or has the authority to implement operating policies with respect to energy usage, water usage, and/or waste disposal for the building. Development and major redevelopment projects are excluded until they are operational. For avoidance of doubt, Projects that are not under the Borrower’s operational control for sustainability matters as of the date hereof and therefore not Boundary Properties are (i) the Borrower’s two shopping centers in Canada and (ii) the Charlotte, North Carolina shopping center (which is not Tanger-branded).
