The Settlement Administrator shall timely and properly file, or cause to be filed, all federal, state, or local tax returns and information returns (together, "Tax Returns") necessary or advisable with respect to the earnings on the funds deposited in the Cash Fund (including without limitation the returns described in Treasury Regulation Section 1.468B-2(k)).
Until such time as the Cash Fund is distributed, the Settlement Class shall not possess any rights to demand or receive any portion of the monies or the escrowed monies or to mortgage, pledge, or encumber the same in any manner.
The Cash Fund shall be established as a Qualified Settlement Fund ("QSF") within the meaning of Treasury Regulation Section 1.468B-1, pursuant to the subject matter jurisdiction of the Court under Treasury Regulation Section 1.468▇-▇(c)(1) and an order to be entered by the Court establishing a QSF within the meaning of Treasury Regulation Section 1.468B-1.
The Settlement Administrator shall have the authority to conduct any and all activities necessary to administer the Cash Fund.
All costs associated with providing Class Notice to the Settlement Class shall be paid exclusively by the Settlement Administrator from the Cash Fund.
