Commercially Released Software definition

Commercially Released Software means Software that is formally released by BlackBerry and/or generally available to BlackBerry customers and fully supported by BlackBerry under BlackBerry’s Maintenance and Support offering. Commercially Released Software is generally identified in the Software Center by BlackBerry as “Generally Available,” “GA,” or “Stable” Software. For clarity, the definition of Commercially Released Software specifically excludes all Experimental Software and Custom Software.
Commercially Released Software means, for a particular version, unmodified Software components that QSS has:
Commercially Released Software means Software in binary form that QSS has formally released together and has identified as fully supported in the License Guide; it includes patches offered by QSS under a Standard or Priority Support subscription to address Software errors, but does not include: (i) experimental, alpha, beta, trial or other unsupported components, (ii) derivative works that you create or obtain from the QNX developer community site hosted by QSS (the "myQNX Portal"), (iii) software that you receive from third parties, or (iv) combinations of Commercially Released Software with other software components (including equivalent components from other releases, or components intended for use on other hardware platforms).

  • If Customer is seeking support for Custom Software or Experimental Software or if Customer wishes to accelerate fixes to the supported Commercially Released Software according to Customer directed priorities, then Customer may purchase add-on services under a separate agreement.

  • Under BlackBerry’s standard Maintenance and Support offering described in the Maintenance & Support Policy, BlackBerry will support the current version of the Commercially Released Software and prior versions of the Commercially Released Software until and unless such software is designated as EOS or EOL by BlackBerry.

  • For a period of ninety (90) days from the effective date of the Order for the Software, BlackBerry warrants to the Customer that any Commercially Released Software delivered to Customer hereunder will materially conform to its published specifications described in the relevant Documentation when used on a supported reference platform as specified by BlackBerry in the applicable Documentation.

  • Under BlackBerry’s standard partner Maintenance and Support offering described in the Maintenance & Support Policy, BlackBerry will support the current version of the Commercially Released Software only.

  • For a period of ninety (90) days from the effective date of the initial Order for the Software, BlackBerry warrants to the Partner that any Commercially Released Software delivered to Partner hereunder will materially conform to its published specifications described in the relevant Documentation when used on a supported referenced platform as specified by BlackBerry in the Documentation which is applicable to the specific type and version of the Software.

  • BlackBerry shall use reasonable commercial efforts to note any such third-party licensing considerations that it is aware of (other than patent licenses relating to the implementation of Standards) in the Third-Party Licensing Considerations Supplement for all Commercially Released Software.

  • Under BlackBerry’s standard Maintenance and Support offering described in the Maintenance & Support Policy, BlackBerry will support the current version of the Commercially Released Software and all prior versions of the Commercially Released Software until and unless such software is designated as “End of Life” or “EOL” by BlackBerry.

  • If Partner is seeking support for Custom Software or Experimental Software or if Partner wishes to accelerate fixes to the supported Commercially Released Software according to Partner directed priorities, then Partner may purchase add-on services under a separate agreement.

  • Contractor Commercially Sensitive Information means the information listed in the Contractor Commercial Sensitive Information Annex to the Contract being information notified by the Contractor to the Authority which is acknowledged by the Authority as being commercially sensitive information.

  • Commercially Sensitive Information Schedule means the Schedule containing a list of the Commercially Sensitive Information.

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Commercially Sensitive Information means the Information (i) listed in the Commercially Sensitive Information Schedule; or (ii) notified to the Authority in writing (prior to the commencement of this Contract) which has been clearly marked as Commercially Sensitive Information comprised of information:

  • Customer information systems means any methods used to access, collect, store, use, transmit, protect, or dispose of customer in- formation.

  • Third Party Software means software which is proprietary to any third party (other than an Affiliate of the Contractor) which is or will be used by the Contractor for the purposes of providing the Services.

  • Cloud Materials means any materials provided or developed by SAP (independently or with Provider’s cooperation) in the course of performance under the Agreement, including in the delivery of any support or Consulting Services to Provider or its Customers. Cloud Materials do not include any Customer Data, Provider Confidential Information, or the SAP Cloud Service.

  • Commercially Reasonable or “Commercially Reasonable Efforts” means, with respect to any action required to be made, attempted or taken by a Party under this Agreement, the level of effort in light of the facts known to such Party at the time a decision is made that: (a) can reasonably be expected to accomplish the desired action without a material increase in costs incurred by such Party; (b) is consistent with Prudent Industry Practices; and (c) takes into consideration the amount of advance notice required to take such action, the duration and type of action and the competitive environment in which such action occurs.

  • Authority Software means software which is owned by or licensed to the Authority, including software which is, or will be used by the Contractor for the purpose of providing the Services but excluding the Contractor Software.

  • Company Software means Software owned or purported to be owned by or developed by or for the Company or any Company Subsidiary.

  • Product Information has the meaning specified in Section 10.12(a).

  • Geographic information system or “GIS” means a system designed to capture, store, manipulate, analyze, manage, and present spatial or geographical data.

  • Company Proprietary Software means all Software owned by the Company.

  • Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

  • Commercially Useful Function means responsibility for the execution of a distinct element of the work of the contract, which is carried out by actually performing, managing, and supervising the work involved, evidencing the responsibilities and risks of a business owner such as negotiating the terms of (sub)contracts, taking on a financial risk commensurate with the contract or its subcontract, responsibility for acquiring the appropriate lines of credit and/or loans, or fulfilling responsibilities as a joint venture partner as described in the joint venture agreement.

  • Client Materials means all works and materials supplied by or on behalf of the Client to the Consultant for incorporation into the Deliverables or for some other use in connection with the Services;

  • Commercially Reasonable Efforts means efforts which are reasonably within the contemplation of the Parties at the time of executing this Agreement and which do not require the performing Party to expend any funds other than expenditures which are customary and reasonable in transactions of the kind and nature contemplated by this Agreement in order for the performing Party to satisfy its obligations hereunder.

  • Customer Proprietary Network Information (“CPNI”) is as defined in the Act.

  • Licensed Materials means any materials that Executive utilizes for the benefit of the Company (or any Subsidiary thereof), or delivers to the Company or the Company’s Customers, which (a) do not constitute Work Product, (b) are created by Executive or of which Executive is otherwise in lawful possession and (c) Executive may lawfully utilize for the benefit of, or distribute to, the Company or the Company’s Customers.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Proprietary Software means computer software developed for and owned by the Failed Bank for its own purpose and use.

  • Coordinated licensure information system means an integrated process for collecting, storing, and sharing information on nurse licensure and enforcement activities related to nurse licensure laws that is administered by a nonprofit organization composed of and controlled by licensing boards.

  • IP Materials has the meaning given to it in clause E8.1 (Intellectual Property Rights).

  • Virtual source means a point from which radiation appears to originate.

  • Program Materials means the documents and information provided by the Program Administrator specifying the qualifying EEMs, technology requirements, costs and other Program requirements, which include, without limitation, program guidelines and requirements, application forms and approval letters.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).
