Contractor Staff Conduct. For reasons of safety and public policy, in any Contract resulting from this procurement, the use of illegal drugs and/or alcoholic beverages by the Contractor or its agents, employees, partners or Subcontractors shall not be permitted while performing any phase of the work herein specified.
Contractor Staff Conduct. CONTRACTOR shall ensure that all staff adheres to the following requirements for conduct: 5.45.5.2.1. CONTRACTOR or staff shall not display favoritism to or preferential treatment of, one (1) inmate or group of inmates over another.
Contractor Staff Conduct a. Contractor staff shall adhere to the standards of conduct governing Department of Corrections’ personnel including adherence to policy and procedure guidelines, particularly rules of conduct, employee clothing requirements and security procedures, and any other applicable rules and regulations. In addition, the Contractor shall ensure that all staff adhere to the following requirements: 1) The Contractor’s staff shall not deal with any inmate except in a relationship that supports services under this Contract. Specifically, staff members must never accept for themselves or any member of their family, any personal (tangible or intangible) gift, favor or service, from an inmate or from an inmate's family or close associate, no matter how trivial the gift or service may seem. The Contractor shall be required to report to the Warden or Contract Manager any violation of these restrictions. In addition, no staff shall give any gifts, favors or services to inmates, their family or close associates. 2) The Contractor's staff shall not display favoritism to or preferential treatment of one inmate or group of inmates over another. 3) The Contractor’s staff shall not have outside contact (other than incidental contact) with an inmate being served, or their family or close associates, except for those activities which are part of the activities that are to be rendered under this Contract. 4) The Contractor’s staff shall not enter into any business relationship with inmates or their families (example - selling, buying or trading personal property) or personally employ them in any capacity. 5) The Contractor’s staff shall not engage in any conduct which is criminal in nature or which would bring discredit upon the Contractor or the State. In providing services pursuant to this Contract, the Contractor shall ensure that its employees avoid both misconduct and the appearance of misconduct. 6) Any violation or attempted violation of the restrictions referred to in this section regarding employee conduct shall be closely scrutinized. Any failure of the Contractor to report a violation or take appropriate disciplinary action against the offending party or parties shall subject the Contractor to appropriate action, up to and including terminating the Contract. 7) The Contractor shall report any incident requiring investigation by the Contractor in writing to the Contract Manager, within 24 hours of the Contractor’s knowledge of the incident. 8) The Department reserves the ...
