Copyleft Software definition

Copyleft Software means software, content, materials, and/or works of authorship licensed under terms that:

Copyleft Software means any software code that is distributed under Open License Terms that: (a) require, as a condition of use, modification, and/or distribution, that other software code incorporated into, derived from or distributed with such software code also be (i) disclosed or distributed in source code form, (ii) licensed for the purpose of making modifications or derivative works, or (iii) redistributable at no charge; or (b) otherwise impose any other material limitation, restriction, or condition on the right or ability of the Group Companies to use or modify any Group Company’s products or services or distribute any Group Company’s products or services.

Copyleft Software means software, content, materials, and/or works of authorship licensed under terms that (a) grant, impose, or purport to impose a requirement or condition on the software or other technology combined or otherwise used or distributed therewith; (b) require or purport to require that software or other technology combined or otherwise used or distributed therewith be made available in source code form; (c) requires or purports to require that software or technology combined or otherwise used or distributed therewith be licensed for the purpose of making modifications or derivative works; (d) requires or purports to require that software or any other technology combined or otherwise used or distributed therewith be redistributable at no charge; or (e) may grant or purport to grant to third parties any rights or immunities under Magento’s proprietary rights in the Services and/or Software or any portion thereof.

Examples of Copyleft Software in a sentence

• With respect to any Copyleft Software that is or has been used by Company in connection with any Company Owned IP, Company has been and is in material compliance with all applicable licenses with respect thereto.

• Except as set forth on Schedule 3.14(f) of the Company Disclosure Letter, the Company Software, and any other Software used by the Company, does not reference, incorporate, or link to (dynamically or statically) any Open Source Software subject to a Copyleft Software license, in each case in a manner that subjects the Company to the restrictions described in clause (A) or (B) in the definition of Copyleft Software.

• For the Copyleft Software embedded in the Products as of the date hereof, Section 2.8(f) of the Disclosure Schedule identifies (i) the Product that embeds the Copyleft Software, (ii) whether any modification to such Copyleft Software, as embedded in such Product, was made by or for Seller or any of its Subsidiaries; (iii) the name and version number of the applicable license agreement for each such item of Copyleft Software; and (iv) the manner in which such Copyleft Software is embedded in each Product.

• Company and the Company Subsidiaries have not: (i) incorporated Open Source Software into, or combined Open Source Software with, any of the Company Products; (ii) distributed Open Source Software in conjunction with or for use with any of the Company Products; or (iii) used Copyleft Software in a manner that requires the Company Products, any portion thereof, or any other Company Intellectual Property to be freely available for modification or redistribution, or provided in source code form.

• None of the Software owned by Paramount or any of its Subsidiaries that is licensed, distributed or made available to any third party incorporates or is derived from any Copyleft Software.

More Definitions of Copyleft Software

Copyleft Software means any Software subject to any Copyleft License.

Copyleft Software means any Open Source Software that: (a) requires, as a condition of use, modification, and/or distribution, that other software code incorporated into, derived from or distributed with such software code also be (i) disclosed or distributed in source code form, (ii) licensed for the purpose of making modifications or derivative works, or (iii) redistributable at no charge; or (b) otherwise imposes or could impose any other material limitation, restriction, or condition on the right or ability of the Buyer to use or modify the Company’s products or services or distribute the Company’s products or services under terms chosen by the Buyer.

Copyleft Software means any software code that is distributed under Open License Terms that: (a) require, as a condition of use, modification, and/or distribution, that other software code incorporated into, derived from or distributed with such software code also be (i) disclosed or distributed in source code form, (ii) licensed for the purpose of making modifications or derivative works, or (iii) redistributable at no charge; or (b) otherwise impose or could impose any other material limitation, restriction, or condition on the right or ability of Purchaser to use or modify the products or services of the Target Companies or distribute products or services of the Target Companies under terms chosen by Purchaser.

Copyleft Software means Open Source Software that is made available to Company by Third Parties under a license that requires, as a condition to exercising the license, that the source code for the Software be made available.

Copyleft Software means Open Source Software that requires as a condition of its use, modification, or distribution that such Software, or other Software incorporated into, derived from, or distributed with such Software, be: (a) disclosed or distributed in Source Code form if used by or distributed to a third party; (b) licensed to such third party for the purpose of making derivatives; or (c) redistributable by such third party at no charge. Copyleft Software includes, without limitation, Software licensed under any versions of the GNU General Public License, the GNU Lesser General Public License, the Mozilla Public License, the Common Public License, the GNU Affero General Public License, Common Development and Distribution License, or Eclipse Public License.

Copyleft Software means any Software that is subject to a license that requires, as a condition of making available, use, modification, license, sale or distribution of the Software subject to such license, that any other Software or other technology or materials incorporated or integrated into, derived from, bundled or distributed with, linked to or otherwise used in connection with such Software: (a) in the case of Software, be made available, licensed or distributed in Source Code form; (b) be made available, licensed or distributed for the purpose of allowing the making of derivative works; (c) be made available, licensed or distributed under terms that allow the Product to be reverse engineered, reverse assembled or disassembled (other than to the extent permitted under Law); or (d) be made available, licensed or distributed (including any redistribution) at no license fee or otherwise at no charge.

Copyleft Software means software available for use, modification and distribution that is licensed under Copyleft Licence Terms;
