Current Feature definition

Current Feature means a feature-length motion picture (i) that has a Home Video Street Date which is during the Term or not more than sixty (60) days prior to the commencement of the Term, and (ii) for which Licensor and/or any other SPE Entity controls during the applicable License Period the Necessary Rights applicable, as the case may be, to Pay-Per-View or Video-On-Demand (it being understood and agreed that the grant by Licensor or any other SPE Entity to a third party of an exclusive license to exploit, or an agreement restricting Licensor’s exploitation of, the Necessary Rights shall not be deemed to divest Licensor or such other SPE Entity of control of such Necessary Rights for any purpose hereunder). Notwithstanding anything to the contrary contained herein, if any motion picture that would qualify as a Current Feature as set forth above has a Home Video Street date that is more than ten (10) months after its Initial U.S. General Theatrical Release date or, in the case of Sony Pictures Classics releases, that is more than twelve (12) months after its Initial U.S. General Theatrical Release (if such motion picture had a Initial U.S. General Theatrical Release), then Licensee shall have the option to include or exclude such motion picture as a Current Feature hereunder (any such motion picture so excluded by Licensee as a Current Feature shall herein be referred to as an “Excluded Delayed Current Feature” and shall be a Library Film hereunder).
Current Feature means a feature-length audio-visual program (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”) in the United States or the Territory, (b) with a VOD Availability Date during the VOD Avail Term, (c) the Availability Date for which is either (i) no more than twelve (12) months after its initial theatrical release in the Territory, or, in the case of a Sony Pictures Classics release, no more than fourteen (14) months after its initial theatrical release in the Territory, or (ii) with respect to DTV, no more than six (6) months after its Home Video Street Date, or (iii) with respect to MFT, no more than six (6) months after its initial television exhibition in the Territory, and
Current Feature means a feature-length audio-visual program (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”) in [the United States or] the Territory, (b) with an Availability Date during the Avail Term, (c) the Availability Date for which is either (i) no more than 12 months after its initial theatrical release in [the United States or] the Territory, or, in the case of a Sony Pictures Classics release, no more than 14 months after its initial theatrical release in [the United States or] the Territory, or (ii) no more than [90] 14 days after its Home Video Street Date, or (iii) with respect to a MFT, no more than 6 months after its initial television exhibition in [the United States or] the Territory, and (d) for which Licensor [unilaterally] 15 controls without restriction all rights, licenses and approvals necessary to grant the rights granted hereunder ( “Necessary Rights”).

Examples of Current Feature in a sentence

  • The “DHE Distributor Price” for each DHE Included Program that is a Current Feature (including a Premium Current Feature) or Library Feature shall be determined by Licensor in its sole discretion.

  • Each Current Feature and Library Film licensed hereunder shall be an “Included Program” and each Included Program shall fall from time to time in one or more of the “Categories” set forth below.

  • Licensor’s mere failure of the foregoing shall in no event deemed to be, or in any way constitute, a breach of this Agreement, and Licensee shall not be entitled to any rights or remedies as a result of such failure, except as otherwise expressly set forth in this Section 5.8. Licensor shall be deemed to control the Necessary Rights in a Current Feature or Library Film if any other SPE Entity controls such rights.

  • The “Deemed Price” for each VOD Included Program that is a Premium Current Feature shall be determined by Licensor in its sole discretion.

  • The VOD License Period for each VOD Included Program shall commence on its VOD Availability Date and shall expire on the date established by Licensor in its sole discretion; provided, that the VOD License Period for each Current Feature shall end no earlier than the earliest of (i) 60 days after its VOD Availability Date (ii) the date on which Licensor’s “standard” residential Video-On-Demand window for the Territory ends and (iii) the termination of this Agreement for any reason.

Current Feature means a feature-length audio-visual program (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”) in the Territory,‌
Current Feature means a feature-length audio-visual program (a) that is initially released theatrically, in the Territory, (b) with an Availability Date during the Avail Term, (c) is in the English language or a Sony Pictures Classics release produced in a language other than English, provided such release contains subtitles (and for clarity, is not dubbed), (d) was produced substantially in color, (e) is not a documentary or a concernconcert film, (f) is not rated by the MPAA more restrictively than “R” (or a comparable rating if a new rating system replaces the MPAA rating system), (g) the applicable Availability Date for which is either (i) no more than 12 months after its initial theatrical release by SPE or another Major Studio in the Territory, or, in the case of a Sony Pictures Classics release, no more than 14 months after its initial theatrical release in the Territory, (h) with a Domestic Box Office of at least $15 million (for VOD) or $12.5 million (for PPV) and (j) for which Licensor or a Licensor Entity unilaterally controls without restriction all Necessary Rights. Notwithstanding the foregoing, Current Features do not include SIT Features.
