An employee will be given advance written notice stating the specific reason(s) for the proposed action and a copy of the material, if any, relied upon to support the reason(s) in the notice. The employee will be given fourteen (14) days to present an oral and/or written reply to the proposal.

For Disciplinary Action of Suspensions of Greater than three (3) days or Discharge: If the employee or his or her Union do not appeal the Xxxxxx action rendered by the Department Director or his or her designee resulting from Step 1, the disciplinary actions involving suspension greater than three (3) days, salary reduction or discharge will be referred to the City Manager/Director of Library Services for review. The City Manager/Director of Library Services may review or modify the Xxxxxx action rendered by the Department Director. If the City Manager/Director of Library Services does not modify the Xxxxxx action rendered by the Department Director, the Xxxxxx action shall be implemented in accordance with the provisions of the Agreement and the Disciplinary Appeal Procedure will end here.

Temporary vacancies of thirty (30) days or less will be filled in the following manner: after Dispatch has assigned an on-call employee to the watch, the actual vacancy will be filled by either the permanent crew member or the on-call employee, whichever one has the most seniority in the vacated classification. For instance, if an AB position is vacant, then the AB dates of the OS crew members and the on-call employee dispatched would be compared and the one with the most seniority in the AB classification would fill the position. If the OS fills the AB position, then the OS position will be filled by either the OS crew member or the on-call with the most senior OS date, etc. No permanent crew member on the watch will be downgraded from his/her permanent position with this process.
Days or Less. A Department Head may suspend an employee for not more than three (3) working days for any one offense. Such suspension shall be reported immediately in writing to the City Manager and the Union.

Pursuant to Section 15 of Article XI, when a vacancy exists for a period up to and including ninety (90) days, it shall be filled by promoting the senior employee of the next lower classification who is working the same shift in the area in which the vacancy occurs. If no Operator Trainee, with retained area seniority, is available, this lowest vacancy will be filled on an assignment basis by an Operator Trainee assigned to that area with the most bargaining unit seniority who is available and qualified to perform the work. In the event the vacancy(ies) cannot be filled by this procedure, the vacancy(ies) will be filled by overtime procedures and will normally be the vacancy which existed in the area before any reassignment.

The Contractor shall provide care for Enrollees in skilled nursing facilities, Intermediate Care Facilities, and Long Term Acute Care (LTAC) hospitals and then reimburse such facilities when the plan of care includes a prognosis of recovery and discharge within 30 days. It is the responsibility of a Network Provider to make the determination whether the Enrollee shall require the service of a nursing facility, Intermediate Care Facility, or LTAC for more or less than 30 days.
