Defective definition

Defective has the meaning set forth in Section 12.1A.
Defective means, when modifying the work, refers to work that is unsatisfactory, faulty or deficient in that it:
Defective means that the Work is unsatisfactory, faulty, or deficient, in that it does not conform to the requirements of the Contract Documents, or does not meet the requirements of any inspection, reference standard, test, or approval referred to in the Contract Documents, or has been damaged prior to the determination of final completion of the Work (unless responsibility for the protection thereof shall have been assumed by Fairfax Water following the Date of Beneficial Use).

More Definitions of Defective

Defective. , in relation to a vehicle, means that it requires work to be done to it, or other attention, to make it comply with any requirement of a written law that applies to the vehicle or its equipment; and “defect” has a corresponding meaning;

Defective or “Nonconforming Goods” means not conforming to the Product Warranty under Section 8.1 or any Goods received by Buyer from Seller pursuant to a Purchase Order that do not conform to the agreed upon specifications in the corresponding Xxxx of Materials for the applicable Purchase Order. Where the context requires, Nonconforming Goods are deemed to be Goods for purposes of this Agreement.
