Eligible Class Employee definition

Eligible Class Employee means an Employee who falls under one of the following categories:

Eligible Class Employee means each Employee of the City who is eligible to participate as General Members of SDCERS and whose date of hire or rehire with the City is on or after July 1, 2009.

Eligible Class Employee means each Employee of the City who is a member of one of the following classifications and whose initial date of hire or rehire with the City is on or after January 8, 1982:

• No Eligible Class Employee has a vested right to the contribution levels or vesting schedule provided under this Plan.

• Each Eligible Class Employee who is a Participant in the Plan on the Effective Date of this Restatement shall continue to participate, provided he or she is employed by the City on such date.

• Each person who becomes an Eligible Class Employee on or after the Effective Date of this Restatement will be a Participant upon becoming an Eligible Class Employee.

• If an individual not classified by the City as an Employee or an Eligible Class Employee is retroactively reclassified by any governmental or regulatory authority to be an Eligible Class Employee, that individual will still become an Eligible Class Employee only prospectively on the date of the reclassification, and then only if the individual otherwise satisfies the requirements of this Article II.

More Definitions of Eligible Class Employee

Eligible Class Employee means each an Employee of the City.

Eligible Class Employee means each Employee of the Employer, except as hereinafter provided. The term Eligible Class Employee shall not include: (a) any individual whose terms and conditions of employment are determined through collective bargaining with a third party if the issue of retirement benefits has been a bona fide subject of collective bargaining, unless the collective bargaining agreement provides for the inclusion of such person as a Participant in this Plan; (b) any Leased Employee; (c) any Employee who is a non-resident alien (within the meaning of Section 410(b)(3)(C) of the Code) and who receives no earned income (within the meaning of Section 911(d)(2) of the Code) from the Employer which constitutes income from sources within the United States (within the meaning of Section 861(a)(3) of the Code); and (d) any individual who is not classified as an Employee by the Employer regardless of whether such individual is considered an Employee for purposes of any federal or state law. If the Employer reclassifies an individual as an Employee, he/she shall be an Eligible Class Employee prospectively from the effective date of that reclassification only, and then only if he/she otherwise satisfies the requirements of this Section. If an individual not classified by the Employer as an Employee is retroactively reclassified as such by any governmental or regulatory authority, such individual shall nonetheless be deemed to have become an Eligible Class Employee only prospectively on the event of such reclassification (and not retroactively to the date on which he/she was found to have first become an employee for any other purpose), and then only if he/she otherwise satisfies the requirements of this section.

Eligible Class Employee means an Employee who is not a Leased Employee or a person designated, compensated or otherwise classified or treated by the City as an “independent contractor,” regardless of whether any agency or court concludes that the designation was in error.

Eligible Class Employee means each Employee of the City of San Diego who is a member of one of the following classifications and whose initial date of hire or rehire with the City is on or after June 30January 8, 19861982:

Eligible Class Employee means each hourly Employee of the City of San Diego and who is covered by a collective bargaining agreement and is (a) an hourly employee not

Eligible Class Employee means any Employee of the ----------------------- Employer, other than an Employee whose terms and conditions of employment are determined pursuant to a collective bargaining agreement which does not require inclusion of such Employee as a Participant in this Plan, and with respect to which the collective bargaining process included good faith bargaining on the issue of the type(s) of benefit(s) provided under this Plan. In addition, the term Eligible Class Employee shall not include any person who is treated as an Employee pursuant to Section 414(n) of the Code.
