Eligible Item definition

Eligible Item means a Deposit Item that meets the criteria and requirements described in Section 5 of this Part 4;
Eligible Item is a deposit item that is an Official Image of a paper-based Instrument, complete and immediately payable to you as payee, and is a cheque in Canadian Dollars and drawn on a Canadian branch of a financial institution operating in Canada. For the purposes of these Terms, stale-dated Instruments, post-dated Instruments, third party Instruments (is a cheque that is made payable to someone other than the Account holder and is signed over to you), or any Instrument that has been altered after it has been completed shall not qualify as Eligible Items.
Eligible Item means an original paper check that is payable to you and is within the meaning of a “check” as defined in Regulation CC and The Credit Union’s deposit guidelines. The following are NOT Eligible Items: • Checks/items payable to others (even if endorsed over to you); • Demand drafts or remotely created checks/items (checks lacking the original signature of the person authorizing the check); • Substitute checks/items (paper checks/items created from an electronic image); • Checks/items in which any fields on the front side contain obvious alteration(s), anything not authorized by the owner of the account on which the check/item is drawn, or any irregularity of any kind (for example, numerical and written amounts are different); • Checks/items previously returned unpaid for any reason; • Checks/items that are postdated or more than six (6) months old; • Checks/items drawn on a foreign financial institution or payable in a foreign currency; • Checks/items you suspect may be fraudulent or not properly authorized; • Checks/items exceeding the Deposit Limits set forth below; • Checks/items not acceptable under the terms of your Credit Union Membership Agreement

Examples of Eligible Item in a sentence

  • During the time you retain the Eligible Item, you agree to promptly provide the original Eligible Item to us upon request.

  • Company assigns all if its right, title, and interest in each Eligible Item that it submits to TeleCheck for warranty coverage when the Item becomes a Return Item.

  • We will credit funds to your Account upon our receipt of the Eligible Item but you acknowledge that we may place a "hold" on funds that are sent or received through the Mobile Remote Deposit Services and therefore the availability and access to the funds will be subject to any hold that we place on the funds (as well as any other limits or restrictions described in this Agreement).

  • You will receive an electronic confirmation of successful transmission of the image of your Eligible Item.

  • You agree to retain each Eligible Item for at least 90 calendar days from the date it is successfully deposited and to destroy the Eligible Item within 120 calendar days of the successful deposit date.


More Definitions of Eligible Item

Eligible Item refers to a paper “check” as that term is defined in Federal Reserve Regulation CC (“Reg. CC”) and that otherwise fulfills the requirements of this Agreement. When the image of the check is transmitted to us for subsequent presentment and collection, it shall thereafter be an “item” within the meaning of Articles 3 and 4 of the Uniform Commercial Code as adopted by the state where the branch at which you opened your Account is located. Note that any check you attempt to deposit using the Service is subject to verification by us.

Acceptable items include personal checks, government checks, business checks, money orders, traveler’s checks and cashiers or certified checks drawn on a US financial institution and in US funds. It is understood that Member will only be transmitting electronic images of the front and back of items. In order for an item to be processed for deposit, it must be properly endorsed in the proper location on the back of the item and signed by the payee. The following are not Eligible Items: • Checks payable to others (even if endorsed over to you); • Demand drafts or remotely created checks (checks lacking the original signature of the person authorizing the check); • Substitute checks (paper checks/items created from an electronic image); • Checks in which any fields on the front side contain obvious alteration(s), anything not authorized by the owner of the account on which the check is drawn, or any irregularity of any kind (for example, numerical and written amounts are different); • Checks previously returned unpaid for any reason; • Checks that are postdated or more than six (6) months old; • Checks drawn on a foreign financial institution or payable in a foreign currency; • Checks you suspect may be fraudulent or not properly authorized; • Checks exceeding the Deposit Limits set forth below; • Checks not acceptable under the terms of your Membership Agreement and Disclosure.

The following are not Eligible Items: 1) Checks/Items payable to others (even if endorsed over to you); 2) Demand drafts or remotely created checks/Items (checks lacking the original signature of the person authorizing the check); 3) Substitute checks/Items (paper checks/Items created from an electronic image); 4) Checks/Items which you know or should know to be fraudulent, altered, unauthorized or missing a necessary endorsement or checks/Items which contain an irregularity of any kind (for example, numerical and written amounts are different); 5) Checks/Items previously returned unpaid for any reason; 6) Checks/Items that are postdated or more than six (6) months old; 7) Checks/Items drawn on a foreign financial institution or payable in a foreign currency; 8) Checks/Items exceeding the Deposit Limits set forth below; 9) Checks/Items not acceptable under the terms of your Membership Agreement.
Eligible Item means a deposit item of a class specified by a by-law, a Rule, or a standard made under the Canadian Payments Act, and defined therein as an ‘eligible bill’. Under this Account Guide, an Eligible Item supporting an Official Image, must be a paper-based Instrument, complete and regular on its face, immediately payable to you as payee, and be a cheque in Canadian Dollars and drawn on a Canadian branch of a financial institution operating in Canada. For the purposes of this Account Guide, post-dated Instruments and third party Instruments that were either delivered to you with the payee in blank or endorsed over to you shall not qualify as Eligible Items. Further, any Instrument that has been in any way transferred to you from anyone other than the drawer, or hasbeen endorsed over to you, or has been altered after being drawn, shall not qualify as an Eligible Item.
