Emissions Allowances definition

Emissions Allowances means authorizations under state or federal (as applicable) air quality regulations to emit either one ton of nitrogen oxides (“NOx”) or sulfur dioxide (“SO2”) at any time during any applicable calendar year.
Emissions Allowances means all authorizations issued to Transferor by a Governmental Authority pursuant to a statutory or regulatory program promulgated by a Governmental Authority pursuant to which air emissions sources subject to the program are authorized to emit a prescribed quantity of air emissions.
Emissions Allowances means an authorization, whether perfected or un-perfected, filed or un-filed, under Environmental Law by a Governmental Authority for any air emissions source at any Acquired Real Property to emit a specified amount of any air pollutant under an emissions budget or similar formal trading program. This specifically includes SO2 and NOX allowances under the applicable federal programs, as well as allowances for these or other emissions, including volatile organic compounds, carbon or carbon equivalents, issued or authorized under any applicable federal, state, local, or regional Environmental Laws.

Emissions Allowances means an authorization by a state or federal regulatory agency, as authorized by laws and regulations applicable to the Facility, to emit a specified amount of air pollutant under an emissions budget trading program. This specifically includes the definition of SO2 and NOx allowances under the Federal Acid Rain program (40 CFR 72), the NOX Budget Trading Program (40 CFR 96), the CAIR NOx Trading Program (40 CFR 96 Subpart AA), and the CAIR SO2 Trading Program (40 CFR 96 Subpart AAA), and any approved regulations implementing these provisions as adopted by the NC State Implementation Plan.
Emissions Allowances means any and all “Allowances” as that term is defined in the Clean Air Act, 42 U.S.C. § 7401 et seq., as amended from time to time, and any regulations and requirements promulgated thereunder, including but not limited to the definition of “Allowance” as set forth in Title IV of the Clean Air Act or any other cap-and-trade program or any other program requiring Allowances or credits under the Clean Air Act, as amended from time to time, and any regulations and requirements thereunder.
Emissions Allowances means NOx Emission Allowances and SO2, Allowances.
Emissions Allowances means all authorizations by a Governmental Body with jurisdiction over the Generating Facility with respect to any of the Purchased Assets under any of the Environmental Laws to emit specified units of pollutants or Hazardous Materials from the Generating Facility during a calendar year or other period of time, including (i) an authorization by the USEPA under the Acid Rain Program of the federal Clean Air Act or from Ohio under any trading program for nitrogen oxide (NOx) or sulfur dioxide (SOx), (ii) any other USEPA or state program for air emissions or (iii) any pollution reduction program with a similar purpose, in each case regardless of whether the Governmental Body establishing such authorizations designates such authorizations by a name other than “allowances.”
Emissions Allowances. All present and future authorizations to emit specified units of pollutants or Hazardous Substances, which units are established by the Governmental Authority with jurisdiction over the Generation Facilities and the Water Treatment Facilities under (i) an air pollution control and emission reduction program designed to mitigate global warming, interstate or intrastate transport of air pollutants; (ii) a program designed to mitigate impairment of surface waters, watersheds, or groundwater; or (iii) any pollution reduction program with a similar purpose. Allowances include allowances, as described above, regardless as to whether the Governmental Authority establishing such allowances designates such allowances by name other than "allowances."
Emissions Allowances means any emission credits, emission allowances, or other appropriate entitlements issued pursuant to applicable Environmental Laws that have been allocated to the Purchased Assets by any Governmental Authority.

  • PM10 emissions means PM10 emitted to the ambient air as measured by an applicable reference method, or an equivalent or alternate method, specified in 40 CFR Part 51, Appendix M as of December 8, 1984, or by a test method specified in these regulations or any supplement thereto.

This includes the protection of such material in process as would otherwise be destroyed, but shall not include deliveries required to maintain plant production. A determination will be made by the Seller of minimum volumes required. Such essential volumes will be dispatched accordingly.

  • Transportation means any land, sea or air conveyance required to Transport the Insured during an Emergency Evacuation. Transportation includes, but is not limited to, air ambulances, land ambulances and private motor vehicles.

  • Allowable emissions means the emission rate of a stationary source calculated using both the maximum rated capacity of the source, unless the source is subject to federally enforceable limits which restrict the operating rate or hours of operation, and the most stringent of the following:
