Air Emissions Clause Samples
The Air Emissions clause sets requirements and limitations on the release of pollutants or contaminants into the air by a party, typically in the context of industrial or commercial operations. It often mandates compliance with applicable environmental laws and regulations, and may require the implementation of specific control technologies or monitoring procedures to minimize emissions. This clause serves to ensure that operations do not negatively impact air quality, thereby reducing environmental liability and promoting regulatory compliance.
Air Emissions. If CAISO determines that it is necessary to reserve MWh to satisfy potential dispatches under this Agreement without violating present or future limitations on the discharge of air pollutants or contaminants into the atmosphere specified by any federal, state, regional or local law by any regulation, air quality implementation plan, or permit condition promulgated or imposed by any Governmental Authority, the terms and conditions of such reservation shall be set out on Schedule P.
Air Emissions. Air emissions of volatile organic chemicals, aerosols, corrosives, particulates, ozone depleting chemicals and combustion by-products generated from operations are to be characterized, monitored, controlled and treated as required prior to discharge.
Air Emissions a. Does the facility emit any chemicals or wastes into the air?
b. Does the facility have an air permit?
c. Does the facility treat any of its air emissions to remove air pollutants?
d. Describe the ventilation system for the facility.
Air Emissions. 1.2.1 Total greenhouse gas emissions
1.2.2 Total emissions of ozone-depleting substances
1.2.3 Total air emissions
Air Emissions. If ISO determines that it is necessary to reserve MWh to satisfy potential dispatches under this Agreement without violating present or future limitations on the discharge of air pollutants or contaminants into the atmosphere specified by any federal, state, regional or local law by any regulation, air quality implementation plan, or permit condition promulgated or imposed by any Governmental Authority, the terms and conditions of such reservation shall be set out on Schedule P.
Air Emissions. A. Describe air emissions from each source of anticipated air pollutants including fuel burning equipment (describe type of fuel burned) on the Premises:
B. Describe the air pollution control equipment to be used to reduce emissions from each source of air emissions:
C. Describe the method(s) to be used to monitor any air emissions:
D. Identify any permits and/or licenses which must be obtained in connection with any air emissions:
Air Emissions. TENANT shall obtain all the necessary construction and operational permits necessary to construct, install, and operate any air emissions source or atmospheric pollution source, as defined by the Regulation for the Control of Atmospheric Pollution Sources according to the Local and Federal Regulations. This includes but is not limited to (i) ventilation systems to disperse atmospheric emissions resulting from TENANT’s operations; (ii) electric power generators for emergency use; (iii) storage tanks for flammable gases with a capacity greater than five hundred (500) gallons; and (iv) fuel storage tanks (gasoline, diesel, kerosene, acetone, alcohol and others) having a capacity of more than ten thousand (10,000 gallons). TENANT, at its own cost and expense, shall establish the necessary measures and shall install the equipment required to maintain the air quality standards established by the existing laws and regulations and any amendments thereto as required by the permits issued by the Environmental Protection Agency and the local government authority.
Air Emissions. Air emissions of volatile organic chemicals, aerosols, corrosives, particulates, ozone depleting chemicals and combustion by-products generated from operations are to be characterized, monitored, controlled, and treated as required prior to discharge. 7) Product Content Restrictions: Suppliers are to adhere to all applicable laws, regulations and customer requirements regarding prohibition or restriction of specific substances, including labeling for recycling and disposal. Ethics Suppliers/Service Providers shall not engage in any corruption, extortion, embezzlement, or bribery in any form. Violations will result in immediate termination of business.
Air Emissions. All air emissions, water quality improvements and pollution reductions Seller has, is entitled to or applied for, including any air emissions, water quality improvements and pollution reductions where Seller has credit for or has banked, applied to bank or agreed to sell or trade.
Air Emissions. All air emissions permit conditions shall be met during any Test. The Generating Unit(s)’ validated Continuous Emission Monitoring System (“CEMS”) (as such system is defined in South Coast Air Quality Management District’s Regional Clean Air Incentives Market or RECLAIM, Rule 2000(c)(18), as may be amended from time-to-time), shall be the required instrumentation for demonstrating compliance with NOx emissions requirements during the Test for Generating Unit(s) located in the SCAQMD. For Generating Unit(s) located in Air Pollution Control Districts other than the SCAQMD, the preferred instrumentation for demonstrating compliance with NOx emissions requirements during the Test should be installed, maintained and operated in accordance with 40 C.F.R. Part 75 Continuous Emission Monitoring: Subchapter C, Operation and Maintenance Requirements, which includes by reference Appendix A to part 75, Quality Assurance and Quality Control Procedures. For Generating Unit(s) subject to a federal New Source Performance Standard requiring installation of a continuous emission monitoring system (40 C.F.R. Part 60.13 “Monitoring Requirements;” 40 C.F.R. Part 60, Appendix B “Performance Specifications”; and Appendix F “Measurement of Emissions of Other Regulated Pollutants”) must occur during the Tests to demonstrate compliance according to permit conditions for emissions monitoring required by the applicable Air Pollution Control District as stipulated on the Generating Unit(s)’ permit to construct or permit to operate. If the CEMS fails during the Test, temporary, certified emission monitoring equipment may be substituted at SCE’s sole discretion.
