Exempt Allegation definition

Exempt Allegation means an allegation to which one or more of the exemptions to reportable conduct pursuant to the Ombudsman Act 1974 applies. These exemptions are:
Exempt Allegation means an allegation which is not reportable conduct pursuant to the Children’s Guardian Act 2019 (NSW). An exempt allegation includes: (i) conduct that is reasonable for the purposes of discipline, management or care of a child, having regard to the age, maturity, health or other characteristics of the child and to any relevant code of conduct or professional standard; or (ii) the use of physical force if, in all the circumstances, the physical force is trivial or negligible, and the circumstances in which it was used have been investigated and the result of the investigation recorded in accordance with appropriate procedures; or (iii) conduct of a class or kind exempted from being reportable conduct by the Children’s Guardian under section 30 of the Children’s Guardian Act 2019 (NSW).
Exempt Allegation means an allegation to which one or more of the exemptions to reportable conduct pursuant to the Ombudsman Act 1974 (NSW) applies. These exemptions are: (i) conduct that is reasonable for the purpose of the discipline, management or care of children, having regard to the age, maturity, health or other characteristics of the children and to any relevant codes of conduct or professional standards; or (ii) the use of physical force that, in all the circumstances, is trivial or negligible, but only if the matter is to be investigated and the result of the investigation recorded under workplace employment procedures; or (iii) conduct of a class or kind exempted from being reportable conduct by the Ombudsman under section 25CA of the Ombudsman Act 1974 (NSW).

  • Allegation means any written or oral statement or other indication of possible scholarly misconduct made to an institutional official.

  • Unlicensed person means any person who is not a licensed dealer under this chapter.

  • Accused means a person accused of a violation who has not yet entered an Institution’s judicial or conduct process.

  • Licensed person means an individual who is licensed or otherwise legally authorized to practice a professional service by a court, department, board, commission, or an agency of this state or another jurisdiction, any corporation or professional services corporation all of whose shareholders are licensed persons, any partnership all of whose partners are licensed persons, or any limited liability company all of whose members and managers are licensed persons.

  • Exposed person means any person wholly or partially in a danger zone;

  • Released Person means any person who is released on bail or on his personal bond, as the case may be;

  • third party proceeding means any threatened, pending or completed action, suit or proceeding, whether civil, criminal, administrative, or investigative, other than an action by or in the right of the corporation.

  • Third Party Infringement Claim has the meaning set forth in Section 23.5.1.

  • Violent felony means the same as that term is defined in Section 76-3-203.5.

  • Third Party Infringement has the meaning set forth in Section 5.1.

  • Accuser means a person who signs and swears to charges, any person who directs that charges nominally be signed and sworn to by another, and any other person who has an interest other than an official interest in the prosecution of the accused.

  • Improper governmental action means any action by a district officer or employee:

  • Illegal Activity means the wilful possession of an illegal drug, dangerous object, or stolen item.

  • Reprisal means the imposition of, and any threat to impose, discipline, demotion, termination or any other act that adversely affects employment or working condition of a member of Personnel because they made a Disclosure, sought Advice, made a complaint about a Reprisal or participated in an Investigation;

  • Permitted Person shall have the meaning set forth in the definition of “Change of Control.”

  • Released Party means collectively, and in each case in its capacity as such:

  • Harassment, intimidation, or bullying means any gesture, any written, verbal or physical act, or any electronic communication, as defined in N.J.S.A. 18A:37-14, whether it be a single incident or a series of incidents that:

  • Inappropriate use means a use that is inconsistent with an educational purpose or that is in clear violation of this policy and the Acceptable Use Agreement.

Additional Disruption Events: Change in Law: Applicable; provided that Section 12.9(a)(ii) of the Equity Definitions is hereby amended by (i) replacing the phrase “the interpretation” in the third line thereof with the phrase “, or public announcement of, the formal or informal interpretation,” (ii) replacing the word “Shares” with the phrase “Hedge Positions” in clause (X) thereof and (iii) inserting the parenthetical “(including, for the avoidance of doubt and without limitation, (x) any tax law or (y) adoption, effectiveness or promulgation of new regulations authorized or mandated by existing statute)” at the end of clause (A) thereof. Failure to Deliver: Applicable Hedging Disruption: Applicable; provided that:

  • Intentional Wrongdoing means an act or omission taken or omitted by a Party with knowledge or intent that injury or damage could reasonably be expected to result.

  • Exculpated Party means, collectively, and in each case in its capacity as such: (a) the Debtors;

  • Third Party IP Claim has the meaning given to it in clause E8.7 (Intellectual Property Rights).

  • Administrative Action has the meaning set forth in paragraph 4(a) of Annex I.
