In addition to any reporting requirements required by local health authorities, compliance with which is the sole responsibility of the Recipient, the Recipient will collect and maintain data in electronic form on the usage of Kits, and report the numbers of tests used, tests with negative results, and tests with presumptive positive results to the Distributor of the Kits in the manner requested or directed by that Distributor.
For clarity, and without limiting anything contained herein, the Kits are being made available to the Recipient on an “as is” basis, with Canada making no covenant, representation or warranty regarding there being a warranty for the Kits nor whether the same can be assigned.
The Recipient will use Kits made available by Canada for a non-diagnostic screening program in the workplace, or in the case of not-for-profit corporations in any location a non-diagnostic screening program is deemed useful (“Workplace Screening”).
To the extent that Canada has any assignable rights to a manufacturer’s warranty (if any) for the Kits, Canada hereby assigns the same to the Recipient.
No action or claim may be brought by any person against Her Majesty the Queen in right of Canada, Canada, those for whom Canada is responsible for at law, or any of their respective employees, officers, officials, agents, or contractors, for any loss or damage of any kind whatsoever arising from this Agreement, or from the possession, ownership, removal, transportation or use of any Kits.
