Manifestation Determination definition

Manifestation Determination means a review of the relationship between the student's disability and the behavior subject to disciplinary action that is conducted by the Manifestation Team or the Committee on Special Education (CSE) of the student's home school district.
Manifestation Determination means the process by which the IEP team determines whether the behavior that violated a student code of conduct is a manifestation of a student’s disability pursuant to 34 CFR 300.530(e).

  • Should the need for a Manifestation Determination arise, the SELPA and district of service and the SELPA and district of residence shall collaborate in the process.

  • When required in accordance with the IDEA and Idaho Special Education Manual, the special education multidisciplinary team will conduct a Manifestation Determination to establish whether or not the misconduct of a student with a disability was (1) a demonstration of the disability, that is, an inability to understand impact and consequences or an inability to control behavior; (2) the result of an inappropriate placement; and/or (3) the lack of provision of services consistent with the IEP and placement.

  • If a teacher is scheduled to attend more than the monthly average of two (2) required meetings per week, the teacher should clarify with their principal which meetings are the highest priority for attendance in order to prioritize legally required meetings (IEP, Eligibility, Manifestation Determination).
