Special Circumstances definition

Special Circumstances means either or both of the following:

Special Circumstances means the events described in “Special Circumstances”. “Subscription Price” means $100.00 per Note.
Special Circumstances means the circumstances that may lead the Council to install a meter on the supply to an "Ordinary Domestic Use" to a customer’s property. This includes, but is not limited to:
Special Circumstances means an application referred to in paragraph 3.6.1 which is made in circumstances where the CAA considers that it has sufficient prior knowledge and experience of the applicant to be satisfied with the applicant’s competence, without carrying out in full the investigations contemplated by paragraph 3.6.1;
Special Circumstances means special, unusual, or unanticipated conditions or circumstances arising out of or required by Covad's Application for Collocation (excluding changes made by Covad to such Application after such Application has been accepted by BA) which could, in the reasonable judgement of BA, cause a construction or other delay in the delivery of collocated space, including, by way of illustration and without limitation, major construction obstacles, asbestos abatement procedures or uncustomary modifications to the Collocation premises. In those instances where Covad changes its requirements which will affect the delivery of collocated space, or where otherwise extraordinary circumstances exist, the interval for construction and delivery of the collocated space shall be extended to reflect those changes upon mutual agreement of the Parties.

Special Circumstances means only such circumstances as are caused by special physical conditions or causes and are unique or peculiar to a pollution source.
Special Circumstances means an Eligible Person who has a disability, an acute condition, a life-threatening illness, who is past the twenty-fourth (24th) week of pregnancy, or who has a condition that Provider reasonably believes could cause harm to the Eligible Person if such care or treatment is discontinued. To be reimbursed for providing continued care and treatment under this section, Provider must identify the Eligible Person's Special Circumstances to Beech, request that the Eligible Person be permitted to continue treatment under Provider's care and agree not to seek payment from the Eligible Person of any amounts for which the Eligible Person would not be responsible if this Agreement were not terminated. Compensation to Provider shall be in accordance with the fee schedule in effect as of the termination date. Treatment of Special Circumstances as described herein shall be governed by the dictates of medical prudence and Medical Necessity. The requirements of this section shall not extend beyond ninety (90) days from the effective date of termination, or beyond nine (9) months in the case of an Eligible Person who at the time of the termination has been diagnosed with a terminal illness, or for a pregnant Eligible Person who at the time of termination is past the twenty-fourth (24th) week of pregnancy, beyond delivery of the child, immediate postpartum care, and the follow-up check-up within the first six (6) weeks of delivery. In addition to the foregoing, termination shall not release Provider or Payor from liability to the other with respect to services rendered to Eligible Persons, monies paid, or other actions through the date of termination, nor shall it relieve Provider of the obligation not to xxxx Eligible Persons for Covered Services. This section shall survive termination of the Agreement for any reason.
