Net Sales Revenues definition

Net Sales Revenues means the revenues generated by or to Fly Tech from the sale, lease, or use of End-Use Products whether during the term of this Agreement or subsequently, less the following amounts: reasonable discounts, rebates, or returns actually allowed or granted, all applicable taxes related to the sale and/or use of the End-Use Product, and initial transportation charges of the End-Use Products to customers.
Net Sales Revenues means the gross amount collected by Atossa for the sale of a Licensed Product, less all: (a) normal and customary cash and trade discounts and rebates (including prompt payment and volume discounts); (b) duties and taxes (including excise, sales, use, and value added taxes); (c) insurance, freight, packaging, handling, shipment, and transportation expenses (including associated insurance costs); (d) amounts allowed or credited due to returns, rejections, recalls, rebates, charge backs, billing errors, or retroactive price reductions; and (e) sales commissions or fees paid. Net Sales Revenues excludes amounts collected by Atossa: (i) that are not directly related to sale of a Licensed Product, including amounts paid for support, maintenance, development, research, clinical trials, training, and products bundled with a Licensed Product; (ii) for transfers made to a third party for resale by the third party or to an affiliate; and (iii) for Licensed Products used for research and development or other non-commercial uses, supplied as commercial samples, or supplied as charitable donations.
Net Sales Revenues means gross revenues from the sale of Additional Gas to third- party customers, less processing and transportation costs paid to Songas pursuant to the Gas Processing and Transportation Agreement on account thereof and less other applicable gathering, processing or transportation expenses.

  • Millennium will provide Abacus with a full accounting of Net Sales Revenues each month and each quarterly period.

  • No later than 60 days after the end of each fiscal quarter during the term of this Agreement, Atossa will deliver to Licensor a written report of the Net Sales Revenues collected during the fiscal quarter.

  • If Atossa’s manufacture, sale, use, importation, or other exploitation of a Licensed Product is subject to one or more patents owned, controlled, or licensable by a third party and Atossa pays the third party to license such patents, then the Licensing Royalty will be reduced by the amount paid to the third party for such license, except that the Licensing Royalty payable to Licensor will not fall below 1% of Net Sales Revenues during any fiscal quarter.

More Definitions of Net Sales Revenues

Net Sales Revenues means all revenues earned from the sale, lease, or other disposition of a Licensed Product to a Third Party. “Net Sales Revenues” excludes
Net Sales Revenues means the total revenues invoiced by Orchid for sales of Kits to third parties for use in the detection of genetic polymorphisms by a method encompassed by at least one claim in the Orchid Patents but using a technology platform other than an Orchid technology platform less (i) sales taxes, tariff duties, and value added or other excise taxes; (ii) transportation costs; (iii) amounts credited on returns, replacements and allowances; and (iv) adjustments for invoice errors (such as pricing errors) that do not involve product returns, and excluding samples provided for promotional purposes.
Net Sales Revenues means NET REVENUES derived from the sale of LICENSE PRODUCTS, where a sale includes any license of use, lease, sale or other transfer of rights to the LICENSED PRODUCT.
Net Sales Revenues means gross sales receipts, including any commissions and royalties received, less (i) expenses incurred from the sale of Licensed Products and related taxes, duty fees and insurance on products sold and (ii) deductions for returns, discounts, allowances, credits and repayments due to rejections and defects.

Net Sales Revenues means the revenues generated by Cove from the sale of End-Use Products whether during the term of this Agreement or thereafter, less the following amounts: discounts and reasonable rebates actually allowed or granted, returns of End-Use Products which are reasonable in light of total revenues generated from sale of End-Use Products and which are actually made, all applicable taxes related to the sale and/or use of the End-Use Product, and initial transportation charges of the Cove product(s) to customers.
Net Sales Revenues means Sales Revenues, less the following items, but only insofar as such items actually pertain to the disposition of Licensed Products by the Licensee or a Sublicensee and are included in the Licensee’s calculation of Sales Revenues and are separately invoiced or separately identified on each applicable invoice:
