Transportation and Insurance. Seller shall at its own expense : i) Obtain appropriate property and liability insurance covering loss or damage to the Supplies and injuries to individuals during the construction of the Supplies and during the transportation of the Supplies from the Seller's plant to the Site. ii) Pay all freight and other transportation charges associated with delivery of the Supplies to the Site, and have a representative present during the transfer of the Supplies from the port of entry to the Site. iii) Maintain worker's compensation insurance during the assembly, installation and testing of the Supplies, as required by applicable law, covering its employees and, upon request from Buyer, provide a certificate of insurance evidencing such coverage. Buyer shall at its own expense: i) Obtain appropriate property and liability insurance covering loss or damage to the Supplies between delivery of the Supplies at the Site and the time when the Seller has been paid in full for the amounts under Section entitled "Purchase Price of the Supplies". In such insurance policies, both the Buyer and the Seller shall be named as insured parties. ii) Arrange for the destruction, pick-up and/or clearing away of all waste, including the Supplies packaging except for the disposal of radioactive waste which is covered in section 12 of appendix "Building Completion Specifications". The Buyer and the Seller shall each take out and maintain at their own expense during the period from receipt of the Supplies at the Site through Acceptance, insurance to provide coverage for both itself and the other party for an amount of at least one million US dollars (US$ 1,000,000) per accident against any direct and indirect liability for bodily injury and death to individuals and all direct or indirect costs, losses and damages to the property of the other arising out of each other's acts or omissions in unloading, assembling, installing and testing of the Supplies.

Transportation and Insurance. CONTRACTOR is required to supply his/her own transportation, automobile insurance, gas and other related expenses in order to provide the service under this Agreement. In connection with services to be provided hereunder, CONTRACTOR shall purchase and maintain adequate worker’s compensation insurance coverage and comprehensive liability insurance naming SMARTECH as an additional insured. Liability limits under the insurance shall be specified by SMARTECH but in no case shall be less than One Million Dollars ($1,000,000.00). CONTRACTOR shall notify SMARTECH no less than ten (10) days prior to the cancellation of any such insurance coverage. CONTRACTOR shall provide SMARTECH a certificate of insurance evidencing each such policy at or prior to, the commencement of the term hereof and thereafter thirty (30) days prior to the expiration of each such policy.
Transportation and Insurance. The transport of the Equipment will be provided and paid as follows: The transport of the expedition to VER and CAE will take place, as follows: NdB – VER - NdB (transport paid by Versailles) NdB- CAE - NdB (transport paid by Caen) according a transport schedule subjected to a mutual agreement between NdB, VER and CAE. The current estimate of NdB is 4 large trucks for transport the Equipment. The number of trucks will be confirmed by NdB after technical rehearsals in Xxxxxxx Theater approx. on January 15,2022. The Parties shall agree, no less than 30 calendar days prior to the transportation, about the exact date of loading the Equipment in the sending venue. Each party will provide staff for loading / unloading the Equipment to / from trucks in their theatre at their own expense. Each Party is solely responsible for the documentation and any additional labour costs on get-out and get-in. Each party will also solely be responsible of all taxes, bonds and import or export duties imposed by any government having jurisdiction over the transaction in relation to their own production. The Equipment shall be checked by the receiving part immediately after all goods have arrived, and shall then immediately inform the other part if the Equipment is not in good condition. In case the sending Party does not send an item(s) to the receiving Party that is listed on the Equipment list, the sending Party shall be responsible for sending the item(s) (door to door) to the receiving Party and all cost connected to the shipping shall be the responsibility of the sending Party. Delivery shall be made in the quickest way possible. The responsibility for The Equipment shall be transferred to the receiving Party at the time the Equipment leaves the house of the other Party. The receiving party shall insure the Equipment during transport against all risks (All Risk) for the value of 117.000 Euros or for the price of acquiring a new Equipment. The exact method of the delivery of The Equipment to the VER/CAE will be specified later, on the base of a confirmatory letter, which will be part of the Contract, following consultation between the technical staffs of NdB and VER/CAE. The contracting parties undertake to store and use the components of the manufactured decorations and costumes under conditions that guarantee their preservation in excellent condition. Transportation and Insurance. (a) All transportation and shipping shall be conducted under the provisions of Incoterms. When ready, all Equipment along with documents as required by the Contract are to be delivered addressed to the shipping delivery address provided by CUSTOMER pursuant to GC-22(c). (b) The waybills issued by public common carrier are acceptable for negotiation purposes. Insurance of the cargo to port of entry will be arranged by ORBIMAGE. Handing over of the equipment will be advised by ORBIMAGE by facsimile to CUSTOMER with full details of the waybill. Along with the equipment, copies of the following documents will be handed over by ORBIMAGE to the carrier: ORBITAL IMAGING CORPORATION CONFIDENTIAL AND PROPRIETARY INFORMATION 22 (i) Five (5) copies of the waybill; (ii) Four (4) copies of ORBIMAGE's detached invoice with itemized unit prices; (iii) Four (4) copies of the Factory Acceptance Test Certificate jointly issued by authorized Representatives of CUSTOMER and ORBIMAGE; (iv) Five (5) copies of the packing list; (v) Four (4) copies of the insurance policy; and (vi) Two (2) copies of the cablegram advising CUSTOMER of shipping arrangements. ORBIMAGE shall provide CUSTOMER with an itemized packing list associated with shipment at least fifteen (15) days in advance of the expected date of shipment.
