Noncomplying Product definition

Noncomplying Product means any Product received by DOD that, within one year following delivery by Contractor, does not comply with the Specifications, or otherwise does not comply with the provisions of this BPA.
Noncomplying Product means any OEM Product received by HP that does not comply with the [*] as set forth in Exhibit A of this Agreement. Noncomplying Products include, without limitation, dead-on-arrival products, overshipments, and early shipments.
Noncomplying Product means any OEM Product received by GEMS-IT that does not materially comply and/or perform in accordance with the Specifications, or otherwise does not materially comply with the requirements of an Order or other provisions of this Agreement, including applicable warranties. Examples of Noncomplying Product in a sentence

  • If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

More Definitions of Noncomplying Product

Noncomplying Product means any OEM Product received by Philips that does not comply with the Specifications, or otherwise does not comply with the requirements of an Order or other provisions of this Agreement. Noncomplying Products include, without limitation, dead-on-arrival products, overshipment and early shipments.
Noncomplying Product means any Product received by an Eligible Buyer which is (i) defective, or otherwise not in conformity with the applicable, or (ii) not in conformity with the requirements of the relevant Purchase Order or other provisions of this Agreement; as determined by the receiving Eligible Buyer prior to distribution to customers.   • Drug Product means a specific drug in dosage form from a known source of manufacture, whether

  • cGMPs means current good manufacturing practices as described in Parts 210 and 211 of Title 21 of the United States’ Code of Federal Regulations, together with the latest FDA guidance documents pertaining to manufacturing and quality control practice, all as updated, amended and revised from time to time;
