Changes to the Final Documents and Drawings which are not identified in a Change Order approved by City, other than Permitted Changes in a Change Order submitted to the City for review in accordance with the foregoing, shall not be deemed a Permitted Change and shall constitute a default hereunder.
Except for a Permitted Change (as hereinafter defined), no changes, alterations or modifications shall be made to the Site Plan (either prior to or after approval by the City) without the prior written approval of the CRA, which approval shall not be unreasonably withheld, delayed or conditioned; provided, however such approval may be withheld in the CRA’s sole and absolute discretion if the requested change, alteration or modification consists of a Material Change.
Notwithstanding the involvement of City in the Plan Refinement Process, Developer shall be responsible for insuring that revisions submitted by Developer to, and approved by, City in writing are implemented in the Final Documents and Drawings and any Permitted Change; the failure of which shall be a default hereunder.
If we make a change to the Agreement, the services or the charges which (i) has a negative impact on your use of the service (in Vodafone’s reasonable opinion) and (ii) is not a Permitted Change, as set out in the Changes to the Agreement section above, you will have a right to leave your Agreement without subsidy if applicable, see terms regarding equipment for details).
The Developer shall provide written notice to the CRA prior to making any Permitted Changes except to the extent such Permitted Change is required in an emergency situation, in which event the Developer shall provide notice to the CRA as soon as reasonable possible thereafter.
