Settlement Class B definition

Settlement Class B. All persons or entities within the U.S. who, during the Class Period, started Uber’s driver application process but did not become an “active” driver in Uber’s system, who used or subscribed to a wireless or cellular service, and to whom Uber sent one or more non-emergency text messages after the user or subscriber requested Uber to discontinue sending text messages.
Settlement Class B. Members of Settlement Class B will receive an average payment of $510,000. Members of Settlement Class B will receive a minimum of $400,000. The Claims Administrator will have the discretion to award additional amounts based on the information you provide as part of the claims Questionnaire.
Settlement Class B means Persons who, at any time during the Class Ownership Period, owned or own real property located within the area identified as “Class B” on the map attached as Exhibit F. This corresponds to the area geographically depicted by the red shaded area on Exhibit 1 to the Third Amended Master Class Action Complaint (ECF No. 242-1, PageID #7130.)

More Definitions of Settlement Class B

Settlement Class B means Persons who, at any time during the Class Ownership Period, owned or own real property located within the area identified as “Class B” on the attached map. This corresponds to the area geographically depicted by the red shaded area on Exhibit 1 to the Third Amended Master Class Action Complaint (ECF No. 242-1.) Settlement Class A and Settlement Class B collectively comprise the “Settlement Class.” Excluded from the Settlement Class are (1) persons who own Industrial Property within the Settlement Class Area; (2) Defendants in this action (and their corporate officers, directors, and members of the corporate officers’ and directorsimmediate families); (3) any entity in which Defendants have a controlling interest; (4) the legal representatives, heirs, successors and assigns of Defendants; and (5) judicial officers to whom this case is assigned, their staff, and the members of their immediate families. (See ECF No. 274 at 4, PageID #9721.) To facilitate the provision of notice, the Parties agree to provide the Claims Administrator with the information that each may have compiled with respect to mailing addresses of the Settlement Class members.
Settlement Class B or “Settlement Class B Members” means all individuals who applied for employment with and/or were employed by Xxxxxxx in the State of Washington during the Class B Settlement Class Period exclusive of any person who timely opts out of the Settlement pursuant to the procedures set forth below.
Settlement Class B means all current owners of Remington Model 700 and Model Seven rifles containing an X-Mark Pro trigger mechanism manufactured from May 1, 2006 to April 9, 2014 who have not participated in the voluntary X-Mark Pro product recall; and all current and former owners of Remington Model 700 and Model Seven rifles who replaced their rifle’s original Xxxxxx trigger mechanism with an X-Mark Pro trigger mechanism manufactured from May 1, 2006 to April 9, 2014, as set forth in the sub-class definitions for Classes B(1) and B(2), below. Excluded from the class are: (a) persons who are neither citizens nor residents of the United States or its territories; (b) any Judge or Magistrate Judge presiding over the Action and members of their families; (c) governmental purchasers; (d) Remington Arms Company, LLC, Sporting Goods Properties, Inc., E.I. du Pont Nemours & Company, and each of their subsidiaries and affiliates. Membership in Settlement Class B shall be determined as of the date of the Preliminary Approval Order.

Settlement Class B includes Class 2 Residential Property (1-4 Family) properties located on both sides of the boundary streets contained in the Class Definition.

Related to Settlement Class B

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Settlement Classes means the Ontario Settlement Class and the Quebec Settlement Class.

  • Settlement Class Members means any member of the Settlement Class.

  • Settlement Class Member means each person and entity who or which is a member of the Settlement Class.

  • Settlement Class Counsel means the law firm of Xxxxxx Xxxxxx Xxxxx Xxxxxxx LLP.

  • Settlement Class Period means the period from March 3, 2018 through February 10, 2022.

  • Settlement Claim means a claim for settlement benefits made under the terms of this Settlement Agreement.

  • Settlement Cycle means the period of Clearance System Business Days following a transaction on the Relevant Exchange in the Underlying, during which period settlement will customarily take place according to the rules of such Relevant Exchange.

  • Settlement Fund means the Settlement Amount plus any and all interest earned thereon.

  • Settlement Class Representatives means Plaintiffs Xxxxxxxxx Xxxxxxxxx, Xxxxxxx Xxxxxxx, and Xxxxxxxx Xxxxxxx.

  • Settlement Payment means the transfer, or contractual undertaking (including by automated clearing house transaction) to effect a transfer, of cash or other property to effect a Settlement.

  • Settlement Funds means moneys allocated to this state from the environmental mitigation trust specified in par. (d) and received by the state from the trustee.

  • Individual Settlement Payment means the amount payable from the Net

  • Current Class B Interest Distribution Amount As to any Distribution Date, the amount distributed in respect of the Classes of Class B Certificates pursuant to Paragraphs fifth, eighth, eleventh, fourteenth, seventeenth and twentieth of Section 4.01(a) on such Distribution Date.

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

  • Gross Settlement Amount means $240,000 which is the total amount Standard agrees to pay under the Settlement, except as provided in Paragraph 8 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • Current Class A Interest Distribution Amount As to any Distribution Date, the amount distributed in respect of the Classes of Class A Certificates pursuant to Paragraph first of Section 4.01(a) on such Distribution Date.

  • Current Class B-5 Fractional Interest As to any Distribution Date subsequent to the first Distribution Date, the percentage obtained by dividing the Principal Balance of the Class B-6 Certificates by the sum of the Class A Non-PO Principal Balance and the Class B Principal Balance. As to the first Distribution Date, the Original Class B-5 Fractional Interest.

  • Viatical settlement provider means a person, other than a viator, who enters into or effectuates a viatical settlement contract. Viatical settlement provider does not include:

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.

  • Current Class B-4 Fractional Interest As to any Distribution Date subsequent to the first Distribution Date, the percentage obtained by dividing the sum of the Principal Balances of the Class B-5 and Class B-6 Certificates by the sum of the Class A Non-PO Principal Balance and the Class B Principal Balance. As to the first Distribution Date, the Original Class B-4 Fractional Interest.

  • Purchase Contract Settlement Fund has the meaning specified in Section 5.5.

  • Current Class B-2 Fractional Interest As to any Distribution Date subsequent to the first Distribution Date, the percentage obtained by dividing the sum of the Principal Balances of the Class B-3, Class B-4, Class B-5 and Class B-6 Certificates by the sum of the Class A Non-PO Principal Balance and the Class B Principal Balance.   • Structured settlement payment rights means rights to receive periodic payments under a structured settlement, whether from the structured settlement obligor or the annuity issuer, where:

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.
